SPECIFY VARIANCE REQUESTED
I have an existing sealed holding tank on my lakelot property, which I use on a
seasonal basis. The tank is 45 feet from my well, whereas the requirement for a new
installation is 50 feet. I request a variance to leave the tank in its present
location without having to move the well or the tank. I agree to install a new
septic system if I ever use the property on a year-round basis, if I ever increase the
number of bedrooms on the property, or if there is ever any indication that the
tank might be leaking.

Motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve the location of a
holding tank 2’ from the north property line and 8’ from the west property line. It should be noted and clearly
understood that the Board of Adjustment is not granting any variance for the 45’ separation of the well from the
holding tank and additionally it should be noted that it is the responsibility of the applicant to contact the Minnesota
Department of Public Health for a variance which would allow the applicant’s well to remain less than the required 50’
from the applicant’s holding tank. The Board of Adjustment stated that they are concerned with potential health issues
when a holding tank is placed less than the required 50’ from a well. The noted hardship for the approve lot line
variances is a substandard lot of record.

Jerry Leaf, Detroit Lakes, MN, requested a variance to subdivide a .9831 acre tract from an existing
11.08 acre parcel for the purpose of conveyance and permanent attachment to Lot 4, Ripples Beach.
The property is described as part of Government Lot 7, Section 34 of Dunn Township by Franklin Lake.
Gerald Sorenson the purchaser of the proposed tract appeared along vyith the applicant. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by
Cecil Femling, second by Bert Olson and carried with Mark Steuart voting no, to approve a variance to
subdivide a .9831 acre tract from an existing 11.08 acre parcel with the following conditions:
1. the proposed tract must be permanently attached to Gerald Sorenson’s lake lot,
2. a registered surveyor’s drawing must be provided at the time of conveyance,
3. the area contained within the proposed tract cannot be used when calculating the 25%
impervious surface rule for front (lake) lot development,
4. the area contained with.the purchaser’s lake lot cannot be used when calculating the 25%
impervious surface rule for back (nevy tract) lot development,
5. the proposed tract can only be used as a parking area, for a storage structure and/or for the
placement of a well.
The granting of this variance will allow for the enhancement of the purchaser’s substandard lake lot. It
was also noted that this is the second metes and bounds spilt request by variance by this applicant and
the board highly recommends that if any additional substandard metes and bounds subdivisions are
being considered the applicant should strongly consider platting the property.
