James and Marcia Vavricka - Approved
Motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried to approve a variance of 32’
from the required ordinary high water level setback of 100’ for the construction of a 24’ by 24’ garage and for a 32’ by
26’ dwelling 68’ from the ordinary high water level. It should be noted that the applicants’ proposed development I
would substantially improve the existing situation.

Richard Ressler -
Pat Eckert, Land and Resource Management presented a request from Richard Ressler for consideration as a
modification to the variance as previously granted on Thursday, September 2, 1999. Mr. Ressler was
requesting a change in the size of the proposed structure. After consideration and discussion, motion was
made by Mark Steuart, second by Randall Mann and unanimously carried, not to modify the previously granted
variance noting that his revised request is significantly different from the request previously considered and
noting that the appropriate course of action for Mr. Ressler is to submit a variance application for consideration
by the Board of Adjustment at a future meeting date.
James and Marcia Vavricka -
On Thursday, September 10, 1998, a variance of 32’ from the required ordinary high water level setback of
100’ for the construction of a 24’ by 24’ garage and for a 32’ by 26’ dwelling 68’ from the ordinary high water
level was granted. The size of the dwelling was not correctly stated in the hearing notice and was not
discovered at the hearing. James and Marcia Vavricka are ready to proceed with their building project and
have just recently learned of the dwelling size, which was stated in the notice and subsequently in the motion
approving the variance as requested. The secretary of the Board of Adjustment is requesting on their behalf
whether or not the size of the dwelling is significant to the motion as previously granted. By general consent
the Board indicated that the size of the dwelling did not matter so long as the variance as previously granted is
not affected and so long as no other setbacks or ordinance requirements are violated by the increased size.
Ralph R. Heidorn -
Mr. Heidorn had forwarded to the County Auditor’s office a proposed variance application for consideration by
the Board of Adjustment. Mr. Heidorn was requesting preliminary review of this application since an earlier
application had been deny by the Board. Mr. Heidorn felt that this new variance application addressed the
Board’s concerns and he was interested in their opinion of his new request. By general consent the Board did
not indicate a strong positive position as it related to his new request, but indicated that if Mr. Heidorn decided
to submitted a formal application for consideration they would review his property again, consider his request
and listen to his position, but until such time would not make a decision regarding his proposed variance
application.
With no further business Randall Mann, Chairman, declared the meeting adjourned.

James and Marcia Vavricka, Wolverton, MN, requested a variance of 32’ from the required ordinary
high water level setback of 100’ for the construction of a 24’ by 24’ garage and for a 32’ by 26’ dwelling
68’ from the ordinary high water level. The property is described as part of Lot 2 and all of Lot 3,
Sunset Lodge in Government Lot 8, Section 4 of Lida Township by Lake Franklin. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by
Randall Mann, seconded by Cecil Femling and unanimously carried to approve a variance of 32’ from
the required ordinary high water level setback of 100’ for the construction of a 24’ by 24’ garage and for
a 32’ by 26’ dwelling 68’ from the ordinary high water level. It should be noted that the applicants’
proposed development would substantially improve the existing situation.
John Johnston - Denied
John Johnston, Fargo, ND, requested a variance of 7’ from the required side lot line setback of 10’ and
a variance of 5’ from the required holding tank setback of 10’ for the construction of a 24’ by 12’
extension to an existing bath house 3’ from the side lot line and 5’ from the septic tank. The property is
described as Lot 24, Broadwater Beach, Pelican Lake in Dunn Township. The audience was polled with
no one speaking for or against the request. A letter from William O. Folendorf in support of the
applicant’s request was read for the record. After consideration, motion was made by John Everts,
seconded by Frank Lachowitzer and unanimously carried, to deny the variance as requested as no
adequate hardship had been shown, an alternative site not requiring a variance does exist and the
applicant’s project as proposed would be considered a second dwelling.
James R. and Mary F. Cook -Tabled
James R. and Mary F. Cook, Wahpeton, ND, requested a variance “to remove the existing deck (8 ft. x
2314 ft.) and use that space for an addition the same size. We want to add a wrap around deck - 4 ft.
wide along the south side of cabin and 6 ft. across the front. Being 4’ 10” from the north lot line and 5’
1” from the south lot line. “ The property is described as the North Half of Lot 4, Clearmont Beach,
Otter Tail Lake in Everts Township. The applicants were not in attendance at the scheduled public
hearing. After consideration, motion was made by John Everts, seconded by Cecil Femling and
unanimously carried to table the applicant’s request until the October 8, 1998 Bd^rd of Adjustment
meeting.
Stephen F. Boedigheimer-Approved
Stephen F. Boedigheimer, Perham, MN, requested a variance of 27’ from the required ordinary high
water level setback of 150’ for the construction of a structure 123’ from the ordinary high water level.
The property is described as the North 250’ of the East 785.8’ of the Northwest Quarter of the
Northeast Quarter, Section 18 of Otto Township by the Otter Tail River. The audience was polled with
no one speaking for or against the request. After consideration, motion was made by Cecil Femling,
seconded by Frank Lachowitzer and unanimously carried to approve construction of the proposed
structure being at least 20’ from the road right-of-way and with the south side of the proposed
construction being no closer to the river than the south side of the existing garage (note the applicant’s
drawing). It was noted that the distance from the south side of the proposed development to the river
will vary, but where the new construction joins the existing garage on the south side the distance will be
approximately 123’. Hardship is a substandard lot of record.
