Minntsoi* < • • ‘ September 12,1996 '8 Motion was made by Craig Anderson, seconded by Robert Schwartz and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. After additional discussion and consideration the previous motion was withdrawn and the following motion was offered by Randall Mann, seconded by Craig Anderson and unanimously carried, to allow the applicant to subdivide the existing 3.08 acre parcel by creating one lake lot having access to the public road, having at least 40,000 square feet of area and having approximately 280' feet of water frontage and by creating one back lot having public road access, having no access to the lake across the front lot, having at least 80,000 square'feet of area and at least 300’ of lot width, as defined by the ordinance, with the provision that a letter indicating that their are no property lines disputes must be provided at the time the subdivision is record and with the condition that no other variances will be granted to build on either the front lot or the back lot. September 12,1996 3 Tim Sucher - Variance Not Required Tim Sucher, Ottertail, MN, requested a variance of 22’ 6” from the required side lot line setback of 50’ for the construction of a 10’ by 20’ screened porch to an RV located on Lot 19 of the resort. The property is described as Sub Lot 1 of Government Lots 3 and 4, Section 23 of Rush Lake Township by Rush Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Craig Anderson, to allow for a non grandfather unattached 10’ by 20’ non-permanent screened porch with the condition that it must be removed when the season is over and with the condition that the wheels cannot be removed from the RV. This motion failed with Craig Anderson, Randall Mann and Robert Schwartz voting in favor of the motion and with John Everts, Cecil Femling, and George Walter voting against the motion. After additional consideration, motion was made by Craig Anderson, seconded by Randall Mann and carried with John Everts voting no, to allow for a non grandfather unattached 8’ by 16’ non-permanent screened porch with the same conditions as stated above. After additional discussion and consideration, it was noted that the applicant’s request is actually from the 20’ road right-of-way setback and not from the 50’ side lot line setback, therefore, no variance is required as the applicant meets the setback requirement from the road right-of-way. Motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to withdraw the previously passed motion and to authorize a partial refund of the application fee. Lee - Approved Linda Lee, Fargo, ND, requested a variance to subdivide, by metes and bounds description, an existing 3.08 acre parcel into two parcels. Each parcel would have approximately 140’ of lake frontage. One parcel would have approximately 60,600 square feet of area and an average width of 210’ and the other parcel would have approximately 75,250 square feet of area and an average width of 155’. A registered surveyor’s drawing is on file with the County Auditor’s office. The minimum size required for metes and bounds parcels within the shoreland area is 5 acres. The property is described as part of Government Lot 1, Section 34 of Candor Tovmship by Loon Lake. Robert Oslund, Surveyor, appeared along with the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After discussion, motion was made by Craig Anderson, seconded by Robert Schwartz and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. Rose Shores Campground (Daniel A. and DeAnn Elaine Vukelich) - Approved Rose Shores Campground, C/0 Daniel A. and DeAnn Elaine Vukelich, Frazee, MN, requested a variance to add nine additional campground sites to the second tier. The Land and Resource Department has calculated the total allowable density at 22 units. The applicants currently have 16 units in the first tier. The property is described as part of Government Lot 9, Section 8 of Hobart Township by Rose Lake. Charles Krekelberg, Attorney, appeared along with the applicants at the public hearing. The audience was polled with Frank Noyes and the owner of the Loon Lake Resort speaking in favor of the applicant’s request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve the variance as requested based on the recommendations of the Planning Commission and subject to the applicants meeting the stipulations of the Planning Commission and to the purchase of the adjacent land.
