Motion was made by Cecil Femling, second by Joe Maske and unanimously carried, to approve the variance as
requested and as depicted on the applicant’s registered surveyor’s drawing. It was noted that this was a proactive
approach, between two neighbors, to resolve a boundary line/driveway encroachment issue.

George Ford, Perham, MN, requested a variance for a boundary line adjustment. The reason for the
boundary line adjustment is to resolve a driveway encroachment from parcel “B”, as depicted on the
applicant’s drawing, onto parcel “A” as depicted on the applicant’s drawing. The property is described as
part of Government Lot 1, Section 34 of Candor Township by Loon Lake. Jim Peterson, Anderson Land
Surveying, Inc., represented the applicant at the public hearing. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Cecil Femling, second by
Joe Maske and unanimously carried, to approve the variance as requested and as depicted on the
applicant’s registered surveyor’s drawing. It was noted that this was a proactive approach, between two
neighbors, to resolve a boundary line/driveway encroachment issue.
Leo J Hesse - Approved with condition. (7:52 p.m.)
Leo J Hesse, New Dim, MN, requested a variance “from the uniform lot width of 150 feet on a recreational
development lake. SMO III Para. 4A, to subdivide an existing lot into two lots. The widths at the public
road will be 60-foot plus each. A single driveway approach will serve both lots. This is a former resort. A
conditional use permit was obtained to allow a 4 dwelling cluster development. However, one family
member has acquired the ownership and desires to divide the tract into two single-dwelling lots. This will
reduce the number of dwellings from 4 to 2.” Also requesting a variance to subdivide, by metes and
bounds description, a 3.10-acre parcel into two parcels. The minimum size for metes and bounds
subdivisions within the shoreland area is 5 acres. The property is described as part of Government Lot 5,
Section 22 of St. Olaf Township by Sewell Lake. Robert Bigwood, Attorney, appeared along with the
applicant at the public hearing. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Mark Steuart, second by Joe Maske and unanimously carried, to
approve the proposed subdivision with the condition that all structures currently located within the shore
impact zone must either be removed or placed in locations, which comply with the setback requirements of
the shoreland management ordinance.
Bill Thompson - Approved with condition. (8:02 p.m.)
Bill Thompson, Pelican Rapids, MN, requested the following: “last fall I repaired a deck and added a roof
over it. The deck (part of) and roof (part of) fall within the 50’ setback area from the lake. I therefore
request a variance on this structure.” Requesting a variance of 58’ from the required ordinary high water
level setback of 100’ for the location of the above described project 42’ from the ordinary high water level.
The property is described as Lot 6, Silent Acres, West Silent Lake in Dora Township. The audience was
polled with no one speaking for or against the request. The applicant presented a letter of support signed
by eight individuals. After consideration, motion was made by Steve Schierer, second by Paul Larson and
carried, with Mark Steuart voting no, to approve a variance of 58’ from the required ordinary high water
level setback of 100’ for the location of the applicants’ project, as described in the application, 42’ from the
ordinary high water level with the condition that, on or before August 1, 2002, the existing 8’ by 8’ storage
shed must either be removed or placed in a location which meets all of the setback requirements of the
shoreland management ordinance. It was noted that only a small portion (80 square feet) are located
within the shore impact zone. It was noted that the project as completed does not restrict view from the
adjacent properties.
