As a result of this motion, the structure must be moved to a complying location or change the structure to comply with the requirements for a Water Oriented Accessory Structure. Dalos, Lots 89 and 90 Sater Humphrey Camp Ranch, Ten Mile Lake in Tumuli Township, requested a variance of 7' from the required north lot line setback requirement of 10’ and a variance of 20' from the required road right-of-way setback of 20' for the placement of a 24’ by 24’ garage 3’ from the lot line and 0’ from the road right-way. The audience was polled with no one speaking for or against the variance as requested. A letter from the Tumuli Township Board in support of the variances as requested was read for the record. After consideration and discussion, Randall Mann made a motion, second by Steve Schierer and carried with Paul Larson voting no, to approve a variance of 5' from the required side lot line setback of 10’ and a variance of 10’ from the required road right-of-way setback of 20’ for the construction of garage 5’ from the side lot line and 10’ from the road right-of-way. The Board noted that the variance as approved is consistent with a previously granted variance in this immediate area. The Board also noted that the variance as approved does provide the applicant with a reasonable use of her property. The Board also noted that placing the garage 0 to 3’ from the road right-of-way would present a safety issue for the pubic. Would change this building to a storage building.” The audience was polled with no one speaking for or against the variance as requested. (8:32 p.m.) Darwin and Cynthia Hendrickson, Lot 6 Block 1, Jerry-Marg Beach, Scalp Lake Seven in Hobart Township, requested a variance of 5’ from the required sealed septic tank setback of 10’ for the placement of a 22’ by 24’ attached garage 5’ from the sealed septic tank. A letter from Craig Olson in support of the variance as requested was read for the record. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and noting that the applicants have other alternatives to consider that would provide them with a reasonable use of their property without the need for the variance as requested. The Board also noted that the denial is consistent with past actions regarding this type of request. Douglas and Barbara Poush - Denied. (8:38 p.m.) Douglas and Barbara Poush, Lot 24 Nirvana, Stuart Lake in Nidaros Township, requested a variance of 58’ from the required ordinary high water level setback of 100’ and a variance of 8’ from the required shore impact zone setback of 50’ for the conversion of an existing IV2 story structure to a 2 story structure located 42’ from the ordinary high water level. George Gunderson, Contractor, appeared with the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Cecil Femling made a motion, second by Steve Schierer and carried with Paul Larson abstaining to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and noting that the applicants have a lot of area for development purposes to the rear of the existing structure.
