It was noted that the variance approval is consistent with past actions of the Board of Adjustment. It would be 53’ from ordinary high water level. The proposed storage structure would be 12’ by 2T - 252 square feet. Because the lot Is only 75’ wide, we would like to keep it 10’ from north property line. Requesting a variance of 55’ from north side property line and 13’ variance from south property line. The required setback is 65’. The audience was polled with no one speaking for or against the variance as requested. A letter from Wanda Borchert in opposition to the variance as requested was read for the record. After consideration and discussion, Steve Schierer made a motion, second by Randall Mann and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as requested and noting that the applicants can obtain a reasonable use of their property without the granting of the variance as requested. It was also noted that the applicants’ lot is simply not wide enough to accommodate/support the proposed development. Dale and Darlene Pixley - Approved the variance application as requested. (7:58 p.m.) Dale and Darlene Pixley, Lots 7 and 8 Block 2 Woodland Acres, Loon Lake in Candor Township, requested the following: Variance is needed to declare property buildable for single family use. Lot does not meet required 300’ width for back lot. Plat was recorded September 23, 1980. The audience was polled with Neil Strawhorn, Loon Lake Association, asking a number of questions concerning the application and then indicating support for the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to declare Lot 7 and Lot 8, Block 2 Woodland Acres as a single buildable lot for residential purposes. It was noted that the variance approval is consistent with past actions of the Board of Adjustment. Marian Bogenreif- Approved the variance application as requested with a condition. (8:05 p.m.) Marian Bogenreif, part of Government Lot 5 Section 11 and part of Government Lot 4 Section 14 of Elizabeth Township by Long Lake, requested the following: Change roof design on existing home from hip roof to gable roof. Asking for variance of 47’ for a setback of 53’ from the ordinary high water level and also asking for variance of 27’ for setback of 3’ from top of bluff. The audience was polled with no one speaking for or against the variance as requested. Ray Williams, Contractor appeared with the applicant at the public hearing. A letter from Cory Heit in support of the variance as requested with conditions was read for the record. After consideration and discussion, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve the variance as described in the application for variance dated October 14, 2009 with the condition that for pollution control reasons the applicant must meet with the Land and Resource Department to determine the best method available to direct runoff/drainage from the roof away from the lake. It was noted that the proposed project is basically structure maintenance. It was also noted that the foot print of the existing structure will not be changed. Paula J. Ruud - Approved the variance application as requested with a condition. (8:11 p.m.) Paula J. Ruud, part of Lot 2 Block 3 Crystal Lida Beaches, Lake Crystal in Lida Township, requested the following: 8’ variance in shore impact zone, making it 42’ from ordinary high water level. It will still pass the string test and install a shared drain field 3' from property line, a 7’ variance. The applicant's husband and contractor also attended the public hearing. The audience was polled with no one speaking for or against the variance as requested. A letter from Richard West, Otter Tail County Highway Engineer, was noted for the record. After consideration and discussion, Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve the variance as stated in the application dated October 12, 2009 with the condition that no more than 25% of the total eligible lot area can be covered with impervious surfaces. It was also noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. The variance as approved will provide the applicant with the ability to enjoy the same rights and privileges as others in this immediate area.
