Hardship is the terrain, the unique shape of the applicants’ property and water on two side of the applicant’s property. It was noted that the variance as requested is a reasonable request and is a reasonable location for the proposed structure. //r. Minnesota September 14, 2000 Page 2 Virgil and Lois Scholtz - Denied Virgil and Lois Scholtz, Pelican Rapids, MN, requested a variance of 14’ from the required road right-of- way setback of 20’ for the construction of a garage 6’ from the road right-of-way. The property is described as part of Reserve Lot A, Olson’s Maplewood - Lida Beach, Lake Lida in Lida Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, second by David Holmgren to approve a variance of 14’ from the required road right-of-way setback of 20’ for the construction of a garage 6’ from the road right-of-way. Noting as the hardship the terrain and the substandard lot of record. This motion failed with Mark Steuart, Randall Mann and Steve Schierer voting no. They noted that adequate space was available to provide the applicants with a reasonable use of their property without the granting of the variance as requested. Ralph Heidorn - Denied Ralph Heidorn, Montevideo, MN, requested a variance of 45’ from the required ordinary high water level setback of 75’ and a variance of 5’ from the required lot line setback of 10’ for the construction of a dwelling 30’ from the ordinary high water level and for the placement of a holding tank 5’ from the lot line. The property is described as Lots 1 and 2, Evergreen Beach, Big Pine Lake in Corliss Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by David Holmgren, to approve the placement of a dwelling 37.5’ from the ordinary high water level with the condition that an existing cabin must be removed prior to the issuance of a site permit, to approve the relocation of a smaller shed 37.5’ from the ordinary high water level and 10’ from the lot line and to approve the placement of a holding tank 5’ from the lot line with the condition that a letter from the township authorizing the location must be obtained. Terrain was noted as the hardship. This motion died for lack of a second. After additional consideration and discussion, motion was made by Steve Schierer, second by Linda Bergerud and unanimously carried, to deny the variance as requested as a reasonable use of this very small lot does exist. Glenn and Pat Metzger - Approved Glenn and Pat Metzger, Fargo, ND, requested a variance for the placement of a proposed water oriented accessory structure 30’ from the Outlet A line bordering the east side of our lake lot. The setback distances to the lot lines bordering the south and north of the lot would fall within county requirements. The structure will be 80’ from the lake on the east side. The required lot line setback for water oriented accessory structure on a recreational development lake is 65’. The property is described as Lot 16, Block 1, Woodland Acres, Loon Lake in Candor Township. A letter from Gerhardt N. Fick, General Partner of Pick Farms L.P., in support of the applicants’ request was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Mark Steuart, second by Steve Schierer and unanimously carried, to approve a variance for the placement of a proposed water oriented accessory structure 30’ from the Outlet A line bordering the east side of our lake lot as depicted on the applicants’ drawing.
