Motion was made by Cecil Femling, seconded by Rod Boyer and unanimously carried, to approve a variance of 15'
from the required ordinary high water level setback of 100’ for the placement of a 34’ by 32’ dwelling 85’ form the
ordinary high water level. It was noted that the 85’ setback site had been recommend by the Land and Resource
Department.

Glenn and Pat Metzger - Approved
Glenn and Pat Metzger, Fargo, ND, requested a variance “that will allow us to build a 34’ by 32’ home
on the above named lake lot 85’ from the “high water mark” on the lot’s west side.” The required
ordinary high water level setback is 100’. The property is described as Lot 16, Block 1, Woodland
Acres, Loon Lake in Candor Township. The audience was polled with no one speaking for or against
the request. After consideration, motion was made by Cecil Femling, seconded by Rod Boyer and
unanimously carried, to approve a variance of 15’ from the required ordinary high water level setback of
100’ for the placement of a 34’ by 32’ dwelling 85’ form the ordinary high water level. It was noted that
the 85’ setback site had been recommend by the Land and Resource Department.
JoAnn M. Steffen • Denied
JoAnn M. Steffen, Osseo, MN, requested a variance that would allow Lots 5 and 6, Chippewa Island, to
be considered as two separate buildable lots. The property is described as Lots 5 and 6, Chippewa
Island, East Battle Lake in Girard Township. William Steffen represented the applicant at the public
hearing. The audience was polled with no one speaking for or against the request. After consideration,
motion was made by John Everts, seconded by George Walter and unanimously carried, to deny the
variance as requested as no adequate hardship had been shown that is supported by the ordinance
and the granting of this variance would establish a precedence.
Janet Bengtson - Tabled
Janet Bengtson, Battle Lake, MN, requested a variance of 9’ from the required ordinary high water level
setback of 75’ and a variance of 5’ from the required septic tank setback of 10’ for the placement of
dwelling 66’ from the ordinary high water level and 5’ from the septic tanks. The property is described
as Tract C and Lot 3, Section 10 of Eagle Lake Township by Eagle Lake. The audience was polled with
more than one neighbor speaking to the request. After consideration, motion was made by George
Walter, seconded by Randall Mann and unanimously carried, to table the applicant’s request until the
September 10, 1998 Board of Adjustment meeting for additional information concerning the location of
the property lines, the road right-of-way line and the distance the proposed development is located from
these lines.
Colleen Buhr-Approved
Colleen Buhr, Buffalo, ND, requested a variance of 3’ from the required holding tank setback of 10’ for
the location of an existing garage 7’ from the holding tank. The property'is described as Lot 2, Seifert
Beach, Lake Lizzie in Dunn Township. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by John Everts, seconded by Cecil Femling and carried
with Randall Mann voting no, to approve a variance of 3’ from the required holding tank setback of 10’
for the location of an existing garage 7’ from the holding tank. Hardship is a substandard lot of record.
It was noted that adequate space would exist for the maintenance and serving of the holding tank. It
was also noted that the Town Board established the right-of way line from which the applicant’s garage
is setback 20’.
VARIANCE REQUESTED
We request a variance that will allow us to build a 34' X 32' home on the
above named lake lot 85 feet from the "high water mark" on the lot's west
side.
We are asking for this variance from the 100 feet "high water mark"
requirement for the following reasons:
1. Our lake lot is unique in that it is affected by bodies of water on
two sides rather that just one.
2. The unusual shape of our lake lot limits us to a relatively small
portion of land on its northeast corner on which we may build.
3. A private road ("Outlot A") running adjacent to the east side of our
lake lot dictates our request for building closer to the west
"high water mark", rather than the east "high water mark".
4. The covenant binding Woodland Acres, of which our lake lot is a
part, restricts us to building at least 20 feet "from any side
lot line", rather than the standard requirement of 10 feet. (See
attached copy of Covenant.)
5. Our request is based on "high water mark" measurements made by
DNR Repr. Kyle Wentz, whom we consulted in regards to our
anticipated structure. He recommended that, based on the
dimensions of our lake lot and his measurements, we apply for
a variance.

"WOODLAND ACRES" PLAT U/^^/?Po

The undersigned, being the owners and developers of
WOODLAND ACRES, certified plat of which is on file and of
record in the office of the Recorder in and for Otter Tail
County, Minneosta, do hereby adopt the following code of
restrictive covenants to apply to said WOODLAND ACRES.
1. These uniform restrictive covenants are for WOODLAND
ACRES except Lots 13 and 14 of Block 3 and Out Lot A.
All references hereafter to VJOODLAND ACRES shall mean all
of the lots of WOODLAND ACRES except Lots 13 and 14 of
Block 3 and Out Lot A. .The purpose of these restrictive.covenants
is to insure the use of the Tots of WOODLAND ACRES for"
attractive residential puposes only and to prevent nuisances.
2. All of the lots in said subdivision shall be
restricted to residential purposes only. No st;ructure shall
be erected on Lots 10 through 16, inclusive, of Block One
and Lots 1 through 14, inclusive, of Block Three other
than a single family swelling, together with either a
boathouse or a one or two car garage or both. In lieu of
a boathouse which can be constructed on the shore of the
lake, the owner of any lot may construct a garage-like
storage building on the rear of said lots. No structure
shall be erected on Lots 1 through 9, inclusive, of Block
One and Lots 1 through 9, inclusive of Block Two other
than a single family dwelling or a one or two car garage
or a garage-like storage building or any combination of the
above.

3.The exterior portion of all buildings erected on
any lot shall be completed within twelve (12) months from the
commencement of construction.
4. No dwelling or building of any kind shall be
constructed or placed nearer than twenty (20) feet from
any side lot line.
5. No trailer, mobile home, basement, tent, shack,
garage, barn or other outbuilding erected on any lot shall at
any time be used as a residence, temporarily or permanently,
nor shall any structure of a temporary character be used as
a residence.
All residences or dwellings erected on any lot
shall have permanent siding, roofing and foundation.
These covenants and restrictions shall run with all
of the lots in WOODLAND ACRES and shall be binding upon all
of the lots in WOODLAND ACRES, their owners, executors, .
administrators, successors and assigns, and shall be en
forceable in law or in equity against any person or persons
