This motion died for lack of a second. After additional consideration and discussion, Paul Larson made a motion, seconded by Thomas Lee and unanimously carried, to approve a variance of 2’ from the required side lot line setback of 10’ for the placement of a garage 8’ from the side lot line. It was noted that the size of the proposed garage is not restrict to the size requested as long as the structure is placed 8’ from the lot line and meets all other ordinance requirements. Hardship/practical difficulty is the shape of the lot. Assessor and the MN DNR 0 bk 072011-001 MINUTES OF THE MEETING OF THE OT'I ER I AIL COUNTY BOARD OF ADJUSTMENT riuirsday, May II, 2017 The Otter Tail County Board of Adjustment met Thursday, May 11,2017, with the following persons in attendance; Rod Boyer Darren Newville Alex Kvidt, Land and Resource Management Paul Larson Steve Schierer Thomas Lee Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.ni. Minutes Approved - The Board of Adjustment approved the minutes of the April 13, 2017 meeting as mailed. The Board of Adjnstineiit considered the following applications for variance: James Schenck- Variance application approved with a modification. (6:32 p.m.) James Schenck, Lot 22 Oak Manor Shores, Loon Lake in Candor Township, requested the following: to build a 26’ by 30’ detached garage four to five feet from property line (Substandard Lot of Record). Barbara Schenck appeared with the applicant. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a motion to approve a side lot line setback of 5’ for the proposed detached garage. This motion died for lack of a second. (6:45 p.m.) Philip and Michelle Jensen, part of Government Lot 3 Section 21 and part of the Northwest Quarter of Northwest Quarter Section 28 of Otter Tail Township by Otter Tail Lake requested the following: Replace the roof on the existing cabin which lies within the Bluff Impact Zone (BIZ) and replace pavers with a concrete slab (approximately 11’ 6” by 20’) that also lies within the Bluff Impact Zone (BIZ). Requesting variance of 26’ into Bluff Impact Zone placing new structure 4’ from top of bluff Structure will remain in existing foot print. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Dan'en Newville, made a motion, seconded by Thomas Lee and carried with Paul Larson voting no, to approve the variance as requested in the application dated April 6, 2017 and as depicted on the drawing submitted with the application. The variance is necessary to tie the roof of the new structure into the roof of the older staicture. It was noted that the new structure will be away from the bluff The variance as approved does not directly or indirectly grant any other variances for the proposed development or for any future development. Mike and Wanda Sclionhardt - Variance application approved as requested. (6:54 p.m.) Mike and Wanda Schonhardt, Lot 48 Block 1 and an interest in Lot 11 Timberlane Beach Rearrangement, Round Lake in Everts Township, requested the following: This lot w'as approved on September 26, 1974 for residential use by Otter Tail County. In 1992 and through no fault of ours, the laws changed increasing the square footage and lot width requirements for a non-riparian lot. We are requesting a variance so we may use the property for residential use again. Per recent ordinance change it meets square footage requirements not frontage requirements. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, seconded by Rod Boyer and unanimously carried, to declare Lot 48 Block 1 'fimberlane Beach Rearrangement a buildable lot for residential purposes. The granting of the variance as requested is consistent with past actions of the Board of Adjustment and will provide the applicants with the ability to enjoy the same rights and privileges as others in this immediate area. The variance as approved does not directly or indirectly grant any other variances for future development.
