The property is described as Lot 11, Oak Manor Shores, Loon Lake in Candor Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to deny the variance as request as no adequate hardship had been shown, as the granting of the variance would compromise the state health code and other reasonable alternatives exist. Robert Jensen - Approved Robert Jensen, Plymouth, MN, requested a variance of approximately 54’ from the required ordinary high water level setback of 75’ and a variance of 16.5’ from the required shore impact zone setback of 37.5’ for the construction of a 10’ by 18’ screened porch approximately 2T from the ordinary high water level. The property is described as Lots 3, 4, 5 and 6, William Reese’s Lakeshore and part of Government Lots 2 and 3, Section 26 of Rush Lake Township by Rush Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and carried with Randall Mann voting no, to approve a variance of approximately 58’ from the required ordinary high water level setback of 75’ and a variance of 20.5’ from the required shore impact zone setback of 37.5’ for the construction of a 10’ by 18’ screened porch approximately 17’ from the ordinary high water level or approximately 2T from the shoreline with the condition that the contractor must meet with the Land and Resource Department to review and discuss current regulations and permit requirements. It was noted that the addition will be no closer to the ordinary high water level than the existing structure. Hardship being a very substandard lot of record. Julie A. Kjelland - Approved Julie A. Kjelland, West Fargo, ND, requested a variance from the required ordinary high water level setback of 75’ for the construction of a 30’ by 27’ cabin less than 75’ from the ordinary high water level. The property is described as Lot 11, Block 4, Lida Shores, Lake Lida in Lida Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve the construction of a 30' by 27’ cabin starting 10’ in front of the existing septic tank and extending 27’ toward the lake. Hardship being a substandard lot of record. It should be noted that less than 25% of the total lot area will be covered by imperious surfaces after the construction of the cabin. Don and Paulette Lafferty - Approved Don and Paulette Lafferty, New York Mills, MN, requested a variance to subdivide an existing 2.5 acre parcel. The top one-third of the parcel would be attached to an adjacent 40 acres currently owned by the applicants. The property is described as part of Government Lot 2, Section 20 of Otto Township by Rush Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve the variance as requested with the condition that a registered surveyor’s drawing and a letter stating that their are no property line disputes must be provided at the time of recording. It should be noted the parcel meets the minimum size required for platted lots on a general development lake. Edmund and Marilyn Molt - Approved Edmund and Marilyn Motl, Fargo, ND, requested a variance of approximately 3’ from the required side lot line setback of 10’ and a variance of approximately 12.5’ from the required road right-of-way setback of 20’ for the construction of a 24’ by 26’ garage approximately 7’ from the side lot line and approximately 7.5’ from the road right-of-way. The property is described as Lot 15, Clearwater Beach First Addition, Lake Six in Hobart Township. The audience was polled with no one speaking for or against the request. A letter from Bill and Pam Gallagher in favor of the variance request was read for the record. After consideration, motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried to approve a variance of 3’ from the required side lot line setback of 10’ and a variance of approximately 12.5’ from the required road right-of-way setback of 20’ for the construction of a 24’ by 24’ garage approximately 7’ from the side lot line and approximately 7.5’ from the road right-of-way. It was noted that an existing shed will be removed and that the doors on the new structure will open at a right angle to the road. Hardship being a very substandard lot of record. It was noted that the granting of this variance will provide the applicants with a reasonable use of their property.
