Hardship being a substandard lot of record and the terrain and topography of the applicant's property. It should be noted that public safety concerns were also expressed. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. ( Rocky and Dixie Hiller - Approved/Denied Rocky and Dixie Miller, West Fargo, ND, requested a variance of 39' from the required ordinary high water level setback of 100' for placement of a dwelling 61' from the ordinary high water level and the following variances for the placement of a 12' by 18' shed (water-oriented accessory structure): 1.) a variance of 11' from the required ordinary high water level setback of 20', 2. ) a variance of 61' from the required south side lot line setback of 65’, 3.) a variance of 11' from the required north side lot line setback of 65', and 4.) a variance of 1' from the 10' maximum height requirement. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve the construction of a dwelling provided the dwelling does not exceed what the string line would permit. After additional consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to deny the variances as requested for the 12' by 18' shed as no adequate hardship had been shown.
