A 6?7>Pq7 19 Time:7 P MDate of hearing: MOTION AS FOLLOWS: Motion was made by Craig Anderson, seconded by Cecil Fending and unanimously carried, to table the variance request until the April 6th, 1995, Board of Adjustment meeting for additional information and recommendations from the Land and Resource Office. Specifically the Board requested that Hr. Hanson, the proposed buyer, meet on site with Tim Griep, Land and Resource Inspector, to discuss the proposed location and the size of the mobile home on Lot 38, the possibility of locating the garage at a right angle to the existing roadway, to discuss possible erosion problems and to determine the location of a water and septic system that would not require any variances. The Board expressed concerns regarding the very fragile nature of this property, the existing tightness of this area, and for the safety of the public. The Board received a report regarding the previously held meeting between Mr. Hanson and Mr. Griep. Drawings were presented and alternatives were discussed. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to approve the placement of a garage and the placement of a mobile home in the areas outlined on the drawing identified as drawing number 2. Hardship being a substandard lot of record. It was noted that the entrance to the garage would be at a right angle to the road right- of-way. \ Ottice of Counsy County of Otter Tail 1 (»f«y Ih* w« ■*! tor to tto or and w4t Uta '4 Catniy Aaoontor _____Os)>u»y MIHUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT March 23rd, 1995 The Otter Tail County Board of Adjustment met Thursday, March 23rd, 1995, with the following persons in attendance:■ Craig Anderson John Everts Leslie Estes Cecil Femling Randall Mann George Walter Kyle Westergard, Land and Resource Management Wally Senyk, County Attorney Call to Order - The meeting was called to order at 7 p.m. by Chairman George Waiter. Minutes Approved - February 8th, 1995 Hearing no corrections or additions the minutes of the February 6th, 1994, meeting were declared approved as mailed. The following variance requests were heard: T.M. and Ethel Leverson Estate C/0 Horene Bunker Tabled T.M. and Ethel Leverson, Estate, c/o variances: Norene Bunker, Fargo, KD, requested the ioiiowing 1. ) a variance of 53' from the required ordinary high water level setback of 1G)0' and a variance of 15' from the required road right of way setback of 20' for the placement of either a 24' by 30’ garage or a 36’ by 24' garage 47’ from the ordinary high water level and 5’ from the road right-of-way, 2. t a variance of 53' froin the required ordinary high water ievei setback of 100’ and a variance of S' from the required road right-of-way setback of 20' for the placement of a mobile home 47' from the ordinary high water level and 12' from the road right-of-way, 3.) a variance of 5 to 10' from tne required side lot line setback of 10' and a variance of 5’ from the required building setback of 10' for the placement of a septic tank 0 to 5’ from the side lot line and 5’ from the proposed dwelling, and 4.) a variance of 15' from the required building setback of 20' and a variance of 5 to 10' from the required side lot line setback of 10’ for the location of a soil treatment area 5’ from the proposed aweiling and 0 to 5’ from the side lot line. The property is described as Lots 37 and 36, Block 1, Trowbridge Point, Leek Lake in Candor Township. The audience was polled with Jeff Rustvold speaking to the variance request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to table the variance request until the April 6th, 1995, Board of Adjustment meeting for additional information and recommendations from the Land and Resource Office. Nenenan Denied Ronald S. Neneman, Omaha, HE, requested a variance to screen-in an attached 8' by 32' porch located within the shore impact zone. The property is described as Sub Lots 16 and 17 of Government Lots 2 and 3, Section 16 of Dead Lake Township on Dead Lake. Ernest West represented the applicant at the hearing. The audience was polled with no one speaking for or against the request. A letter from Gary F. Kaiser in favor of the requested variance was read for the record. After consideration, motion ws made by Craig Anderson, seconded by Cecil Femling to grant a 75' variance from the required south lot line setback of 90' for an attached 8' by 32' screened-in porch with the condition that all of the water - oriented accessory structure guidelines be followed. It was noted that both the roof and the floor of the proposed structure are pre-existing. The motion failed with John Everts, Leslie Estes and Randall Mann voting no. After additional discussion and consideration, motion was made by John Everts, seconded by Randall Mann and carried with Craig Anderson and George Walter voting no, to deny the variance as requested as no adequate hardship had been shown and the proposed screened-in area would be too close to the lot lines. Peter C. Lund - Approved Peter C. Lund, Pelican Rapids, MR, requested a variance of 4' from the required side lot line setback of 10' for a 20' by 18' living room addition and for a 22' by 22' two car attached garage addition to an existing dwelling 6' from the side lot line. The property is described as Lot L, Poss Survey Lots of Government Lot 7, Section 31 of Dunn Township on Lake Lizzie. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to grant the applicant an 18' addition, on the south side of the existing dwelling, and being no closer than 8' to the south property lot line. It should be noted that the applicant's addition cannot advance more than 18' towards the south property line nor can the addition be any closer to the side lot line than 8'. The Board received a report regarding the previously held meeting between Mr. Hanson and Mr. Griep. Drawings were presented and alternatives were discussed. Krause, Fairmount, HD, requested a variance of 26' from the required ordinary high water level setback of 100' for the location of a 28' by 32' dwelling 74’ from the ordinary high water level and a variance of 55' from the required side lot line setback of 65' for the location of a 12' by 20' water-oriented accessory structure (Boathouse) 10' from the side lot line. The property is described as Lot 42, Heilberger Lake Estates, Heilberger Lake in Friberg Township. The audience was polled with no one speaking for or against the request. Karleen D. Krause indicated that the 36' measurement stated on the drawing should have been 56'. The members of the Board of Adjustment expressed concern over the fact that the building site was not marked. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to deny the variance as requested. After additional discussion, motion was made by George Walter, seconded by John Everts to grant a 14' by 32' addition on the back of the existing building towards the road. This motion was later withdrawn.
