Letter of Complaint
Commissioners forwarded a letter of concern about medical care at the Otter Tail County Detention Facility
to the County Attorney, Sheriff, Jail Administrator and County Administrator.
Recess & Reconvene
At 10:18 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners
fora committee meeting. The Board of Commissioners meeting was reconvened at 10:40 a.m.
Owner’s Representative Agreement for Permitting
County Attorney David Hauser, Land & Resource Director Bill Kalar, and the Board discussed the option of
allowing an Owner’s Representative Agreement to facilitate the permit process from the Land & Resource
Department. Lengthy discussion took place. Commissioner Johnson submitted an example of a
document that was not an original signed agreement but a photocopy of the original. Mr. Kalar indicated
that would be accepted in his office.

Little McDonald, Paul & Kerbs LID Environmental Assessment Review
Mr. Hauser submitted a draft Environmental Impact Statement (EIS) Negative Declaration with sections
identified that needed more information. The Negative Declaration could be a Positive Declaration to
require an EIS if the missing information cannot be provided. A Memorandum from Moore Engineering,
Inc. dated May 7, 2015 in response to the Minnesota Department of Natural Resources (DNR) comments
was submitted. A draft Operation & Maintenance Plan for the LMKP LID-DLD LID Pump Station outlet to
Otter Tail River dated May 7, 2015 was submitted by the Proposers. Mr. Kalar reviewed the responses to
the DNR comments which addressed downstream water levels, Aquatic Invasive Species, ice safety, when
the pump can operate, and downstream native mussels. Discussion continued with the Board completing
the missing information throughout the draft EIS document. Several questions were asked by the public
regarding times of operation of the pump and the AIS filtering process. Responses were provided.
A motion was offered by Johnson and seconded by Huebsch to proceed with a Negative EIS Declaration in
the matter of the Proposal of Little McDonald, Kerbs, and Paul Lakes Improvement District to use the Otter
Tail River as an Outlet. The Chair called for a roll call vote as follows:

Conditional Use Permit - Deanna Alama:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditionai Use Permit
to allow the applicant to; 1) add the circular patio with maximum of 20’ diameter with the fire pit, 2) remove
existing timber retaining walls and replace with boulders, and 3) construct a patio under the existing deck;
provided there is no removal of existing trees between the house and the lake, or any earthmoving or
placement of structures within the shore impact zone. These conditions are as recommended by the
Planning Commission. The project is located in Pt of GL 4 (3.32 AC), Section 20 of Leaf Mountain
Township: Spitzer Lake (56-160), NE.

Motion by Froemming, second by Huebsch, and unanimously carried to approve the Preliminary Plat titled

Conditional Use Permit - Tami Bover and Robert & Teri Lanalie:
Motion by Huebsch, second by Rogness, and unanimously carried to table this Conditional Use Permit
application as requested by the Applicants in written communication received April 23, 2015. This includes
the Applicants agreeing to waive the 60-day rule. The motion remands this topographical/earthmoving
alteration request back to the Planning Commission for further review and/or modification at their 2"'^
meeting in May 2015. The proposal is located on Lots 14, 15 & 16 Freedom Flyer Estates, Section 29 of
Hobart Township: Long Lake (56-388), RD.
Interim Use Permit- Mark & Erika Sailer: :
Motion by Huebsch, second by Froemming, and unanimously carried to approve an Interim Use Permit
during construction of a new house as presented and recommended by the Planning Commission. The

Conditional Use Permit - Woodland Beach Resort Association:
Motion by Froemming, second by Huebsch, and unanimously carried to approve a Conditional Use Permit

Conditional Use Permit - Craig Dresser:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for this land alteration project which will reduce current impact on the lake as presented. The project is
located in Engstrom Beach 5“^ Addition Lot 19 BIk 1, Section 18 & 19 of Edna Township; Big McDonald
Lake (56-386), RD.
Conditional Use Permit- Paul Ross Tst:
Motion by Froemming, second by Huebsch, and unanimously carried to deny a Conditional Use Permit to
construct a private access approach off of N Silver Lake Rd due to safety and water drainage concerns as
recommended by the Planning Commission. The proposal is located on Silver View Park Lots 8 & 9,
Section 21 of Everts Township: Silver Lake (56-302), RD.
Heisler’s Country Store. Marvin & Sandra Heisler/Chad Canton:
Land & Resource Director Bill Kalar read a letter from the City of Vergas requesting a fence be built to
effectively screen view by the public due to the number of abandoned vehicles on this site. Mr. Kalar
indicated that Mr. Canton has been cleaning up the site. Discussion followed. Motion by Rogness, second
by Huebsch, and carried with Lindquist opposed, to approve a Conditional Use Permit to operate a vehicle
repair shop as presented with the following condition; The Applicant must submit a site storage plan which

Meeting of the Otter Tail County Planning Commission was held on April 15, at 6:30 P.M. in
the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Loren Bailey, Rod Boyer, Brent E. Frazier, Richard Gabe, Bert Olson,
Jack Rosenthal, Robert Schwartz, David Trites, and Rick Wilson.
Members Absent: David Wass.
Heather Brandborg represented the County Attorney's Office, Bill Kalar and Alex Kvidt
represented the Land & Resource Management Office.
Minutes of November 12, 2014: A motion by Bailey, second by Frazier to approve the
November 12, 2014 Minutes as presented. Voting: All members in favor.
Heisler’s Country Store. Marvin & Sandra Heisler/Chad Canton - Approved With
Conditions:
A Conditional Use Permit Application (as stated by the Applicant on the Application): To operate full
service shop - repairing cars, trucks and ag equipment. Hours of operation: Monday -
Friday 8-5, and Saturday 8-3, year around. Business is already operating as shop &
store (Heisler’s Country Store). The project is located in the NE1/4 NW1/4 ex trs & GL 3
(66.05 AC), Section 35 of Candor Township: Loon Lake (56-523), RD.
Chad Canton represented the Application.
Motion: A motion by Wilson, second by Gabe to approve as presented provided the
Applicant submits a plan for the sightly storage of a maximum of 20 vehicles to Land &
Resource Management for their approval. Voting: All Members in favor.
Otter Tail County Highway Department - Approved With A Condition:
A Conditional Use Permit Application (as stated by the Applicant on the Application): To replace
deficient Bridge No. 56508, located on CSAH 28 in Erhards Grove Township over the
Pelican River in the El/2 NW1/4 & El/2 SW1/4, Section 9. Bridge to be replaced with 3
lines of 10’ x 8’ box culvert. Approximately 120 feet of highway reconstruction is associated
with the project. MNDNR, USAGE & USF&W permits are in progress. An MPCA permit is
not required. Highway & Construction Easements will be obtained prior to construction.
Plans are on file in the Otter Tail County Engineer’s Office. Work is to be completed in
2015. Project is located in the Shoreland Area of the Pelican River (56-PR), AG.
Charles Grotte (Assistant County Highway Engineer) represented the Application.
Ordeen Berg had questions regarding the road construction easterly of the bridge.
Motion: A motion by Schwartz, second by Rosenthal to approve as presented provided the
appropriate Agency Permits are received. Voting: All Members in favor.
Deanna Alama - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Add steps
from dock to patio area (4’ x 25’). Add retaining walls (2) and patio (13’ x 20’ patio) 25’ x 4’
wall & 25’ X 3’ wall. Add patio with fire pit - patio circular 20’ diameter. Remove existing
timber walls and replace with boulder walls (T x 25’) & (T x 35’). Add patio under existing
deck (8’ X 25’). Approximately 20 yds fill. The project is located in Pt of GL 4 (3.32 AC),
Section 20 of Leaf Mountain Township: Spitzer Lake (56-160), NE.

The City of Vergas Planning Commissioners and City Council have reviewed the public hearing notice
regarding Marvin and Sandra Heisler. This property is located on two main roads that tourist enter our
community on.
This property has an abundance of broken down vehicles which are an eyesore. We would like to
request the following condition be made on this conditional use permit.
A non-see thru fence placed along County Hwy 4 from their service road to Highway 130 and from
County Hwy 4 for 200 feet along Hwy 130.
This request is being made to help the view of our natural resources and help Otter Tail County preserve
tourism.
