Timothy Hart - Denied Timothy Hart, Pelican Rapids, MN, requested a variance of 4’ from the required holding tank setback of 10’ and a variance of 14’ from the required drain field setback of 20’ for the location of a 24’ by 38’ garage, with a basement, 6’ from the holding tank and 6’ from the drain field. The property is described as Lot 2, Second Addition to Historic Monument Beach, Prairie Lake in Pelican Township. The audience was polled with the contractor for the proposed project speaking in favor of the project design. After consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to deny the variances as requested as the granting of the requested variances from a dwelling area would establish a precedence. Donald and Norma Johnson - Table Donald and Norma Johnson, Pelican Rapids, MN, requested a variance to subdivide a metes and bounds parcel of less than 5 acres. The existing metes and bounds parcel is approximately 1.78 acres. The applicants would like to subdivide the existing metes and bounds parcel into two separate metes and bounds tracts identified as Parcel A and Parcel B on the drawing on file with the County Auditor’s Office. Parcel A would have approximately 32,500 square feet of area and approximately 215 feet of lake frontage. Parcel B would have approximately 32,500 square feet of area and approximately 187 feet of lake frontage. The minimum size required for metes and bounds parcels within the shoreland area is 5 acres. The minimum size required for platted lots on a recreational development lake is 40,000 square feet of area and 150 feet of lake frontage. The applicant presently has an existing dwelling, nine cabins and four campsites. Per the requirements of the Shoreland Management Ordinance the applicant's property would support an average of 9 units. The property is described as part of Government Lot 9, Section 25 of Dead Lake Township by Dead Lake. The audience was polled with Duane Donnely, Hillary Barry and Walter Morton speaking in favor of the applicant’s request. It was noted that the applicant has made many improvement to the resort since acquiring ownership and has cooperated in all respects with county planning and zoning requirements. It was noted that even with the addition of a dwelling and the added camp site there will be no appearance on the applicant’s property that it is over developed. The resort improvements have been carefully planned and developed. The property is described as the East 15’ of Lot 12 and the West 67’ of Lot 13, Oak Haven Beach, Tamarac Lake in Scambler Township. The audience was polled with Jim Venaas speaking in favor of the applicant’s request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to allow construction of the proposed dwelling no closer to the ordinary high water level than the property identified on the applicant’s drawing as the Iversons. The parcel would be approximately 4.4 acres. The property is described as part of Government Lots 5, 6, and 7, Section 20 of Hobart Township by Rose Lake. J. H.
