July 1, 2004 Board of Adjustment Meeting - Randall Mann, Chair,- polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Randall Mann made a motion, seconded tDy Michael ' Conlon and unanimously carried to table, with the applicant’s verbal permission, this variance hearing until the August 5, 2004 meeting for additional information concerning alternative locations for the applicants’ proposed septic system and for additional'information from the County Attorney’s office regarding the use of the dedicated road right-of-way. August 5, 2004 Board of Adjustment Meeting - The applicants' were not in attendance. After consideration, Randall Mann made a motion, seconded by Steve Schierer and unanirhbusly earned, testable,,the applicants’ variance hearing until either the August 12, 2004 or the September 2, 2004 meeting^ of the Board of Adjustment with the condition that the applicants must provjde written acceptance of this action by August 12, 2004 otherwise there request is hereby denied. (6:45 p.m.) Donald Fairchild, Lot 4 First Addition to Minnkota Beach, Dead Lake in Maine Township, requested; variances of 107’ and 115’ from the required ordinary high water level setback of 200’ for the placement of a deck 85’ from the ordinary high water level and for the placement of a dwelling 93’from the ordinary high water level. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, seconded by Paul Larson and unanimously carried, to approve a variance of 100’ from the required ordinary high water level setback of 200’ for the placement of a deck and for the placement of a dwelling 100’ from the ordinary high vvater level. The: Board noted that the variance as approved will provide the applicant with a reasonable of his property and the applicant’s proposed project will be an improvement over the existing structure placement. Hardship is a substandard lot of record; Jody Sanborn - Denied. (6:48 p.m.) Jody Sanborn, Lot 2 Block 1 Riverview, West Red River Lake in Friberg Township, requested a variance of 10’ from the required bluff impact zone setback of 30’ for the placement of a structure 20’ from the top of the bluff. Randall Mann, Chair, polled the audience with no one speaking for or against the variance! as requested. Kendra Ferencak appeared along with the applicant at the public hearing. After consideration and discussion, Cecil Femling made a motion, seconded by Dave Trities and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown by the j applicant that would allow for the granting ofthe variance as requested and noting the following; 1.) there is adequate room to meet the required 30’ setback, 2.) this is a relatively new plat that should provide building locations: that meet the required setbacks and 3.) other alternatives are available to the applicant. Dwelling is currently 52’ from the ordinary high water level. Also asking for variance of 4’ from north lot line. Option 1: Part B - 4’ variance for proposed 20’ by 24’ garage. 74’ back from ordinary high water level. Also 5’ variance from road right-of-way. Option 2: Part A - Same as Option 1 Part A. Option 2: Part B - Garage: 5’variance from road right-of-way. 75’back from the ordinary high water • level. Currently at 36% impervious coverage by former property owner. I will give up driveway (752 square feet) and sidewalk (182 square feet) for total of 934 square feet.
