Drainage System No. 16
County Attorney, David Hauser, referred to the Ditch No. 16 Public Hearing held October 18, 2010.
He reported that the Engineer's findings that the culverts under Bonnie Beach Road and North
Clitherall Road, as they exist, have insufficient hydraulic capacity to operate as the ditch was originally
designed and constructed. There was general agreement at the Public Hearing that 48” elliptical
culverts would be safer with larger capacity and without an excessive increase in cost. Mr. Hauser
indicated that there is no evidence that the culverts were installed after 1947. Therefore, it has been
determined that these culverts were installed pre-1947, which then makes the ditch system
responsible for the repair.
Motion by Huebsch, second by Lindquist, and unanimously carried to accept the Engineers Report, as
submitted at the public hearing, which finds that the culverts have insufficient hydraulic capacity, order
the culverts to be corrected, and submit bids for the repair and clean out project that was presented at
the public hearing at an approximate cost of $180,000. The bid opening date will be set by the
Engineer between November 19, 2010 and December 3, 2010. The bid opening date flexibility is
needed to obtain the best overall project results. Discussion took place regarding vegetation that
needs to be eliminated. The Ditch Inspector will research this issue and report back to the Board.
Planning Commission Recommendations
Conditional Use Permit - Roger Pinckney XII:
Motion by Erickson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to upgrade an old logging road to a driveway for a possible building site as presented. The
property is described as Pt of GL 2 (18.50 AC) & pt of GL 5 (2.10 AC), Section 31 of Candor
Township: Otter Lake (56-577), NE.
Conditional Use Permit - Lorin L & Anna Mae Remmick:
Motion by Froemming, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to construct two large rip rap boulder retaining walls with conditions as recommended by the
Planning Commission. The property is described as Lot 3 BIk 1 West Shady Nook Beach, Section 15
of Maine Township; Pickerel Lake (56-475), RD.
Conditional Use Permit - Wee Villa Resort LLLP:
Motion by Erickson, second by Rogness, and unanimously carried to approve a Conditional Use
Permit to replace a roof on an existing mobile home as presented. The property is described as Lot 4
ex trs (36.15 AC), Section 14 of Elizabeth Township; Long Lake (56-784), RD.
Conditional Use Permit - Gwen Howe LLC:
Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use
Permit to replace failing timber retaining walls and patio with conditions as recommended by the
Planning Commission. The property is described as EVz of Lot 8 & WVz of Lot 9 & vac rd adj Pelican

Conditional Use Permit - John & Susan Martodam:
Motion by Huebsch, second by Rogness, and unanimously carried to approve a Conditional Use

Meeting of the Otter Tail County Planning Commission was held on October 13, 2010 at
6:30 P.M. in the Commissioner's Room, Government Services Center, Fergus Falls,
Minnesota.
Roll Call:
Members Present: Rod Boyer, Marion Gill, Bert Kinzier, Joe Maske, Bert Olson, Robert
Schwartz, David Trites, and Leona Zimmerman.
Members Absent: Ken Erickson and Rick Wilson.
David Hauser represented the County Attorney's Office and Bill Kalar represented the Land
& Resource Management Office.
Minutes of September 8, 2010: A motion by Maske, second by Schwartz to approve the
September 8, 2010 Minutes as presented. Voting: All members in favor.
Roger Pinckney XII - Approved As Presented:
A Conditional Use Permit Application {as stated by the Applicant on the Application): Changed an
old logging road into a driveway that leads to a possible building site. Driveway is approx.
500 ft. long & 45’ wide. Trees were cut (they are still stacked at the site) & approx. 180 yds
of fill was moved around. This is an After-The-Fact Request. The property is described as
Pt of GL 2 (18.50 AC) & pt of GL 5 (2.10 AC), Section 31 of Candor Township: Ctter Lake
(56-577), NE.

Randall D. Samp - Tabled To November 17, 2010:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Cluster
Development consisting of: 1 residential dwelling and 6 campsites. The property is
described as Pt of GL 3, (16.92 AC), Section 8 of Sverdrup Township: Pleasant Lake (56-
449), RD.
Randall and Diane Samp represented the Application.
Phyllis Bergem expressed concerns regarding the effect on nature & wildlife, & had
questions regarding the use of the campsites. Gary Denbrook (Little Anna) expressed
concerns regarding density & the number of units being requested. Glen Wells (sold
property to Mr. Samp) expressed concerns regarding the proposed use, loss of tranquility
of the area, agreeing with the previous comments. Allan Dummer spoke against the
request and expressed concerns regarding the existing easement, traffic, and his loss of
privacy. Susan Groff expressed concerns regarding density, the effect on wildlife: spoke in
opposition.
Motion: A motion by Trites, second by Maske to table (at the Applicant’s request) to the
November 17, 2010 Planning Commission Meeting to allow the Applicant time to provide a
drawing that meets the presentation requirements of the Shoreland Management
Ordinance. The drawing must be submitted to the Land & Resource Management Office
by October 29, 2010. Voting: All members in favor.

wants to cut dirt out to make a walkout basement. Cut will be 4’ deep x 20’ long and 15’
towards lake. Backfill from house to township road right-of-way; backfill will be 3’ 6” at
foundation of house to 0’ at right-of-way. Also sloping around corner of house 5’. Parking
area on south side of lot - 30’ x 25’ x 3’. Total cubic yards for project = 147 c.yd. The
property is described as Heilberger Lake Estates Lot 43, Section 10 of Friberg Township;
Heilberger Lake (56-695), RD.
Rick Leitch (excavator) & Karleen Krause represented the Application.
Motion - August 11, 2010: A motion by Boyer, second by Maske to table (at the
Applicant’s request) to September 8, 2010 to allow the Applicant time to stake the project
area, staking must be done no later than August 25, 2010.
Motion: A motion by Gill, second by Erickson to approve as presented, may work beyond
the October 1®‘ deadline with the condition that the Applicant provides Land & Resource
with a proposed completion date and a stabilization plan. Voting: All members in favor.

Mark & Julie Bechtel - Approved With Conditions / Denied Request #3:
A Conditional Use Permit Application (as stated by the Applicant on the Application): 1) 1 would like
to level an area on south side of cabin to place a V2 circle patio. It would be level with the
walk-out door & also allow to place 2 windows along the south basement wall allowing for
an egress window in the basement bedroom. I would shave into the hill eastward approx.
3 ft tapering to 0 (approx. 100 cu. yds) level & move it westward to level the area. I would
then erect a boulder wall (as shown on diagram) to hold soil stable. 2) I would like to level
the area to west of the house 24 ft westward (approx. Ill cu. yds) running along the house
50 ft. I would remove all the old railroad ties & erect a tapering boulder wall on the west
side. This would help to control surface water run off that puddles on the neighbor’s
property to the west as it would have greater surface area to perk through. If not able to
level this area then a boulder wall would be placed in area (denoted on diagram) to contain
north side of patio. Septic tank would be moved north. 3) Place boulders 20 ft back from
rip-rap shoreline on the elevated slope to hold/stabilize hill. (Diagram is available for
viewing at Land & Resource Mgt.) I will have the shoreline rip-rap by Oct. 1®* but would like
until Nov. 1®' to finish project & will stabilize soil by that date. The [property is described as

This letter is a reminder that Violation #2643 is unresolved. An After-The-Fact
Conditional Use Permit is required for the earthmoving (driveway) project that was started
in the fall of 2008. The area that was disturbed needs to be stabilized and silt fences need
to be installed to help with any possible erosion issues that may occur.
1 have enclosed all the necessary paperwork for your project. Please complete the
application along with scale drawing plus 10 copies as required. Return all paperwork to
our office on or before the August 19, 2009. This will be the final extension you will
receive from our office (see copies of previous letter and violation). Failure to comply will
result in court action.
