After consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve the placement of
a covered unenclosed porch no closer to the ordinary high water level than the lakeside of the existing dwelling (house not the
deck). It should be understood that the variance as approved does not directly or indirectly grant any other variances for the
proposed development and that the variance as approved will provide the applicants with a reasonable use of their property. It
was also noted that the variance as requested would establish precedence and that there is a variance on file for the location of
the existing house.

The Otter Tail County Board of Adjustment met Thursday, September 4, 2008, with the following persons in
attendance:,

Called to Order - Randall Mann Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the August 7, 2008 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Bruce C. and Beth Jones Martinson - Approved the variance request as modified. (6:32 p.m.)
Bruce C. and Beth Jones Martinson, part of Government Lot 8, Section 31 of CandorTownship by Otter Lake,
requested a variance of 47' frorh the required ordinary high water level setback of 200',for the addition of 8’ deep by
32’ wide unenclosed front porch-153’ from the ordinary high water level. The applicant’s sister appeared with the
applicant at the public hearing. The audience, was polled, with no one speaking ,for or against the variance as ,
requested. After consideration, Steve Schierer:made a motion, second by Paul Larson arid unanimously carried, to
approve the placement of a covered unenclosed porch no closer to the ordinary high water level than the lakeside of
the existing dwelling (house not the deck). It should be understood that the variance as approved does not directly or
indirectly grant any other variances for the proposed deveioprnent and that the variance as approved will provide the
applicants with a reasonable use-of their property. It was also noted that the variance as requested would establish
precedence and that there.is a variance on.file for the location of the existing house.
Robert and Sandra Fagen - Approved the variance as requested with a condition. (6:45 p.m.)
Robert and Sandra Fagen, part of Government Lot 3, Section.2 of Dead Lake Township by Marion Lake, requested
the following: We would like to put a home 24’ by 36’ with attached garage 16’ by 24’ and an attached breezeway 10’
by :24’ on our lot on Marion Lake. Also, relocate our existing 8’ by 12’ storage shed. We are requesting a variance of
a 20’ setback from the 75’ setback placing new dwelling 55’ from ordinary high water level due our substandard lot of
record and terrain of lot. Our existing cabin will be removed upon completion of our new dwelling. The proposed new
cabin will be 33’ farther from the lake than the existing cabin. The audience was polled with no one speaking for or
against the variance as requested. - After consideration, Pauf Larson made a motion, second by Steve Schierer and
unanimously carried, to approve the variance as described in the variance application dated July 28'^, 2008 and as
depicted on the drawing submitted with the application with.the condition.that the existing cabin must be removed on
or before August 1,2009. It was noted that the size.of the proposed development is reasonable and that the
proposed development will be an improvement to the property. The practical difficulties/hardships are the terrain and
configuration of the applicants’ property.

Lyla L. Rath, Lot 24 Bowery Beach First Addition, Big Pelican Lake in Dunn Township, requested the following:
ordinance requires 75’ setback from ordinary high water level. This seasonal cabin was built in late 30’s or early 40’s
and the desired fill in areas are setback approximately 45’ from the ordinary high water level. Requesting variance to
add two 8’ by 8’ additions on the lakeside of the cabin which areas are now covered by deck. Additions do not move
cabin structure closer to water than an existing dining nook now which would be center of two additions. Also,
requesting a variance to cover more than 25% of the eligible lot area with impervious surfaces. Daryl Rath appeared
with the applicant at the public hearing. The audience was polled with no one speaking forior against the variance as
requested. Letters from Roberta and Gerald Lovell, Rick Kuske, Barbara Peppersack and Susan and Richard
Neameyer in support of the variance as requested were noted for the record. After consideration, Randall Mann
made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no
adequate practical difficulty/hardship had been shown that would allow for the granting of the variance as requested,
the applicant has a reasonable use of her property without the granting of the variance as requested and current
impervious surface coverage is far in excess of the allowable coverage. Generally, the Board did not object to the
proposed additions; however, the excessive amount of impervious coverage was very much a concern.

Roberta L. Lovell, Fargo,.ND, requested a variance of 3’ from the required lot line setback of 10’ for an
addition to an existing dwelling 7’ from the lot line. The property is described as Lot 23, First Addition to
Bowrey Beach, Pelican Lake in Dunn Township. The audience was polled with no one speaking for or
against the request. Afte.r consideration and discussion, motion was made by John Everts, seconded
by George Walter and unanimously carried, to approve a variance of 3’ from the required lot line
setback of 10’ for an addition to.an existing dwelling 7’ from the lot line noting that the proposed

lot area with impervious surfaces and a variance of 5’ from the required drainfield setback of 10’ for the
location of an existing drainfield 5’ from an existing building/garage. The applicants are,proposing to
cover 30% of the total lot area with impervious surfaces. The property is described as Lot 52, Provan
Beach, Pelican Lake in Dunn Township. A letter from Elaine Funfar expressing concerns with the
applicants’ request was placed in the filed. The audience was polled with no one speaking for or
against the request. After consideration and discussion, motion was made by Craig Anderson,
seconded by Cecil Pemling and unanimously carried, to deny the variance as requested for the drain
field as it is to close to an occupied building. After additional consideration and discussion, motion was
made by Cecil Femling, seconded by John Everts and unanimously carried, to deny the applicant’s
request to cover more than 25% of his total lot area with impervious surfaces. It was noted that no
adequate hardship had been found to justify the granting of the variances as requested by the .,
applicants.

Bruce C. Martinson, Fairfax, VA, requested a variance of 39’ from the required ordinary high water level

Ralph Blake, Maple Grove, MN, requested a variance of 10’ from the required ordinary high water level
setback of 200’ for a 26’ by 26’ addition to an existing structure 190’ from the ordinary high water level.
The property is described as Lot 5, Block 1, Govern Addition, Dead Lake in Dead Lake Township. The
audience was polled with no one speaking for or against the request. After consideration and
discussion, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried,
to approve a variance of 10’ from the required ordinary high water level setback of 200’ for a 26’ by 26’
addition to an existing structure 190’ from the ordinary high water level. Hardship is the trapezoidal
shape of the applicant’s lot. It was noted that only a portion of the proposed addition is within the 200’
setback area.

Dear Secretary Stern,
I am writing you to express my opposition to the proposed variance of 39 feet requested by Bruce C.
Martinson for the above described property on Otter Lake located in Candor Township. I am the
owner of the adjacent property.
In August 1993 Otter Tail County denied a similar request for the same piece of property for a variance
made by Bruce Martinson, Dennis Martin.son, and Dawn Martinson-Bruesh. Also at the same time.
Otter Tail County required the Martinsons to remove living quarters and other outbuildings that had
been moved to the property and/or constructed there. The decision by the Board of Adjustment in
August 1993 was wise and correct and frankly, I fail to understand why it would even warrant a second
thought at your November 6"' meeting.
Nevertheless, I remain opposed to granting the variance for environmental reasons. Otter Lake is
zoned “Natural.” It is one of the most pristine of Otter Tail County’s 1,000 Lakes, proof positive, I
believe, that Lake Shore Management works. The requested variance is not insignificant. The
construction of a building as proposed so close to the water can only have an adverse effect on its
quality and render meaningless the ordinance as written.
Your predecessors had the courage and foresight to enact legislation to zone our lakes to protect our
natural resources, and in 1993 to affirm the wisdom of that legislation by denying the Martinson’s
request. I urge the current Board of Adjustment to call on its collective strength and wisdom to uphold
the far-sighted legislation of the past and the 1993 decision, ensuring our treasured natural resources in
the future. Thank you for sharing my letter with your colleagues.

Kenneth C, Rye has requested that the portion of the above variance request which was tabled at a previous meeting be
continued until the spring of 1994, After consideration, motion was made by John Everts, seconded by Dan Oehler and
unanimously carried , to table the variance request of Mr, Rye until such time that it would be convenient for Mr, Rye
to prepare the information requested and to appear before the Board of Adjustment,
Clarification/Reconsideration
Scott Dirks, Attorney and Terry Lee Anderson, Surveyor, met with the Board of Adjustment to request reconsideration
of a variance request that was heard at the July 1st, 1993, Board of Adjustment meeting. After consideration, motion
was made by Cecil Femling, seconded by Bert Olson and carried with Craig Anderson voting no, to reconsider the action
of the July 1st, 1993 meeting. During the process of the discussion it was stated that the applicant Mr, Robert
Sammon should have had better information with him at the time of the hearing. It was also stated that the lot does
contain a building site that would not require a variance if the ordinary high water level was marked so that proper
setback measurements could be made. It was suggested that the ordinary high water mark should be established and
that at this time no additional action would be taken by the Board of Adjustment, Mr, Dirks expressed his appreciation
for the opportunity to meet with the Board of Adjustment to clarify the existing situation.

Dear Mr. Stein:
I am writing you to express my opposition to the variance requested
by the above named parties on property they own on Otter Lake,
located in Candor township,
property.
My opposition is based on:
Ecological reasons
"mobile” home and a "camper" trailer so close to Otter
Lake creates, and has for a number of years in my
opinion, a runoff hazard that clearly threatens the
quality of water in Otter Lake - a situation that the
shoreline management ordinance of Otter Tail County was
intended to eliminate.
I am the owner of the adjacent

A request for a variance of 50 feet and 105 feet are not
insignificant but are major deviations of the land
management ordinance.
(2)
In my opinion, a mockery of the lake shore zoning was
made when the trailers were moved to the lake and the
outhouse constructed without permits. To grant such a
significant variance now simply renders meaningless the
legislation that was intended to protect our natural
resources.

Dear Hr. Martinson:
On June 18, 1993 I visited your lot on Otter Lake to investigate a conplalnt
received in our office. Upon visiting the lot, I found vhat appeared to be
two dvelllngs (one mobile home and one recreational camping unit) on the
same lot (Shoreland Management Ordinance of Otter Tall County allows only
one dwelling unit per lot).
At that time.I also noticed a 10'xl2' shed and a 4'x4' outhouse, all of
which are not located properly in accordance with the Shoreland Management
Ordinance.Upon reviewing our files, there were no records of any permits
being Issued for any of these structures.
Please contact our office by July 6, 1993 so we can resolve this matter.
