Existing attached porch has cement floor & screened windows & would be attached to new home. Three oak trees would be removed to accommodate wider home. Existing home has non-repairable furnace & replacement for this vintage home no longer available. Water runs through walls & around windows during heavy rains. (Roof was resealed in 1996.) Walls are no longer rigid. Should this variance be granted, I would also like to replace existing septic tank with mound system.” It appears that variances from the ordinary high water level setback are needed for the placement of the mobile home and the septic system. The required structure setback from the ordinary high water level is 150’ and the required septic tank and drain field setback from the ordinary high water level is 100’. The property is described as part of the Southeast Quarter of the Southeast Quarter, Section 7 of Qtto Township by the Otter Tail River. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by John Everts and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback of 150’ for a building setback of 100’. It was noted that any deck or 3’ high and/or any porches must be setback at least 100’. Hardship is the wetlands and terrain features of the applicant’s property. Scott M. Dirks - Approved Scott M. Dirks, Pelican Rapids, MN, requested a variance “to divide two surveyed parcels of less than 5 acres for the purposes of being permanently attached to lots in the plat of North Star Beach, and that these conveyances be treated as exempt from the Subdivision Controls Qrdinance as if being attached to an adjacent contiguous parcel. Deeds of these parcels will contain appropriate language permanently attaching these parcels to appropriate lake lots in the plat of North Star Beach.” Qne parcel will be approximately 14,000 square feet and the other parcel will be approximately 9,000 square feet. “These parcels contain no wetlands, and a final survey will be provided at the time the deeds are recorded. A permanent road easement will be provided for the use of all lake lot owners in the area in the location of the road as actually built.” The property is described as part of Government Lot 7, Section 28 of Dunn Township by Lake Lizzie. The audience was polled with no one speaking for or against the request. Scott Dirks along with Melony Stainbrook and Maurice and Estelle Bolgrean were presented at the public hearing. After consideration, motion was made by Randall Mann, seconded by Rod Boyer and unanimously carried, to approve the proposed subdivisions with the condition that a registered surveyor’s drawing must be provided and with the condition that the proposed parcels must be permanently attached to the platted lots of North Star Beach. It was noted that the granting of this variance would improve the overall situation in the area.
