The delays are due to interruptions from a lawsuit and easement issues involving the neighbor as well as family health issues and the passing of my wife in December of 2019. We are asking to build the deck larger by adding another 10' to have a 22' x 8' being 7' to 8' in height. The previous variance also allowed us to construct dormers on the dwelling which we are no longer doing. The dwelling was constructed in the late 1940's therefore making it difficult to meet setbacks. When the dwelling was constructed in 1992 the structure setback was 75’ as this was a General Development Lake. In May of 2009 the Lake was reclassified to a Natural Environment Eake. Neil Strawhom submitted an email which was forwarded on to the Board for their review and he also spoke at the meeting in regard to the variance application w ith concerns about how close this is to the water, water quality, impervious surface coverage, substandard lot with 3 existing non-conforming structures and he also expressed concerns about there being no other properties w ith decks located in the shore impact zone. The current impervious surface calculation is 51.37% and will be reduced to 38.8%. The existing building impervious surface is at 23.34% and the proposed will be 24.7%. James & Lynne Giordano, property owners and JD Larson represented the variance application via GoToMeeting. The audience was polled w ith Russell Freeman speaking against the variance with concerns about the coverage on the 50’ lot and changing the character of the area. Sara Lebans also spoke again the variance application w ith concerns about the lotline setbacks and height of the detached garage as well as the negative effect in the area. Tony Stoll, Architect spoke about the detached garage indicating that they could replace the garage in the same location without a variance and the proposed location provides access to the site. He also indicated that they could move the dwelling closer to the lake, but the chose to move it back. After consideration and discussion, Michael Donoho made a motion, seconded by Douglas Larson, and failed by roll call vote to deny the variance as requested. The recent Quid Pro Quo deal does not change the facts or my objection to allowing an additional variance. Please consider just the facts relating to the new variance application at the hearing on October 8, 2020 1 oj- I am against granting multiple variances in this case because the proposed alterations to the property will adversely effect my property. And also because it effects every property owner on the lake and everyone that uses the lake resource. I understand that the plight of the landowner is due to circumstances unique to the property. The property is a substandard lot with a nonconforming cabin and two additional structures. A WOS and a bunkhouse or guesthouse. The lot is less than one third of the area and less than one half of the width required of a standard lot. The cabin lies entirely within the SIZ and does not meet the setback from the OHWL or the property line. It also exceeds the maximum impervious surface within the SIZ. And the WOAS is encroaching on the property line. Obviously there will be practical difficulties developing this property. However most of these difficuffies can be overcome with proper planning and without the need for a variarioe. The most recent revision to the ordinance allows many new options. I also understand that there is no limit to the number of variances that can be granted. But variances can be cumulative and when taken together they may not be in harmony with the general purposes and intent of the ordinance and will alter the essential character of the locality. I opposed increasing the impervious surface in the shore impact zone in 2017 and I oppose it now. The general purpose of this Ordinance is ,among other things, to prevent pollution and enhance our natural resources. Increasing the impervious surface in the shore impact zone again to 1124 sq. ft. Is certainly not in harmony with the purpose and intent of the Ordinance. Existing 940 sq. ft. + previous variance 118 sq. ft. + proposed variance 58 sq. ft = 1124 sq. ft. This is more than 4 times the allowed 260 sq. ft. The impervious surface of the lot is also not in harmony with the purpose of the Ordinance. Using section IV 8 B 4 of the Ordnance the impervious surface of the applicable lot area would be approximately 75%. This is 3 times the allowed 25% Impervious surface is important because it affects water quality and the value of all the properties on the lake. If this variance is approved it will involve 5 different provisions of the Ordinance. Impervious surface. SIZ. 1124 sq. ft. 260 sq. ft. allowed Impervious surface. Lot. 75% 25% allowed OHWL setback. 17 ft. 100 ft. required Property line.setback. 8 ft. 10 ft. required Structures in SIZ. 2 WOAS and deck only 1 allowed This substandard lot is less than one half the required area and width and has 3 nonconforming structures. The practical difficulties we see today were created by Mr.Peterson when he acquired the lot in 2001. And any future expansion will require even more variances. There are no other properties in the area with a deck in the shore impact zone. If this variance is approved it is important that conditions are imposed the will not allow the dormers and the 8X12 deck to be constructed. Thank you for your consideration in this matter.
