I need to maintain a roof over the deck we have added to our property,
mentioned above.
In order to maintain the same plane of the existing structure and due to the
fact the topographic nature of the shoreline angles back on the property, I
am reguesting a variance of 10' (100' to 90') of setback for the roof over
the deck.
I UNDERSTAND THAT I HAVE APPLIED FOR A VARIANCE FROM THE REQUIREMENTS OF THE SHORELAND
MANAGEMENT ORDINANCE/SUBDIVISION CONTROLS ORDINANCE OF OTTER TAIL COUNTY.
I ALSO UNDERSTAND THAT OTHER PERMITS MAY BE REQUIRED, IT IS MY RESPONSIBILITY TO
CONTACT LAND & RESOURC^MANAGEMENT REGARDING THIS MATTER.

Duane M and Marie A Fillipi - Approved with condition.
Motion was made by Steve Schierer, second by David Trites and unanimously carried, to approve a variance of 10’
from the required ordinary high water level setback of 100’ for the placement of a portion of a roof over an existing
deck 90’ from the ordinary high water level with the condition that an existing 8’ by 8’ storage shed must be placed in a
location which would meet all of the setback requirements of the ordinance by May 1,2001. It was also noted that if
the applicants should decide not to move the existing storage shed then the roof must be brought into compliance by
May 1, 2001.

Tim Collins, Henning, MN, requested a variance to create a metes and bounds parcel of less than 2.5
acres. The property is described as part of the Northeast Quarter of the Northeast Quarter, Section 22
of Inman Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Randall Mann, second by David Holmgren and unanimously
carried, to approve the variance as requested with the condition that a registered surveyor’s drawing
must be provide at the time of conveyance.
Kenneth James and Linda Koester - Approved
Kenneth James and Linda Koester, Glyndon, MN, requested a variance of 15’ from the required
ordinary high water level setback of 100’ for the placement of a 40’ by 8.5’ Park Model 85’ from the
ordinary high water level. The property is described as part of Government Lot 2, Section 20 of Dunn
Township by Lake Lizzie. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by David Holmgren, second by Steve Schierer and unanimously
carried, to approve a variance of 15’ from the required ordinary high water level setback of 100’ for the
placement of a 40’ by 8.5’ Park Model 85’ from the ordinary high water level noting that this structure
will be at least 10’ further back from the ordinary high water level than the existing structure. It was also
noted that many other structures in the immediate area are much closer. Hardship is the terrain and
the topography of the applicant’s property.
LeRoy and Carol Stine - Denied
LeRoy and Carol Stine, Dallas, TX, requested the following: “75’ variance on North Shore Setback.
Request is to position residence as indicated on attached survey. Approx. 45’ from crest of bluff on
south and 200’ from shore on north. Area of residence is 2.55% of total land area. All water drainage
is from the bluff away from the lake on the south towards the north. Placement of home will not impact
south shore or bluff area and meets setback requirements on north.” The property is described as a
5.72-acre parcel in Government Los 2 and 3, Section 9 of Sverdrup Township by Anna Lake. Steve
Nelson represented the applicants at the public hearing. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Steve Schierer, second
by Cecil Femling and unanimously carried, to deny the variance as requested noting that another site
meeting the 200’ setback requirement may be available and that this is a new subdivision which should
not require a variance for development.

Duane M and Marie A Fillipi, Warren, MN, requested a variance of 10’ from the required ordinary high
water level setback of 100’ for the placement of a roof over an existing deck 90’ from the ordinary high
water level. The property is described as Tracts 16, 17, and 18, Moltzan Survey Lots of Government
Lot 7, Section 16 of Candor Township by Leek Lake. The audience was polled with no one speaking for
or against the request. After consideration, motion was made by Steve Schierer, second by David
Trites and unanimously carried, to approve a variance of 10’ from the required ordinary high water level
setback of 100’ for the placement of a portion of a roof over an existing deck 90’ from the ordinary high
water level with the condition that an existing 8’ by 8’ storage shed must be placed in a location which
would meet all of the setback requirements of the ordinance by May 1,2001. It was also noted that if
the applicants should decide not to move the existing storage shed then the roof must be brought into
compliance by May 1,2001.
