After consideration, motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to approve a variance of approximately 6” from the required side lot line setback of 10’ for the construction of a 16’ by 36’ addition to an existing dwelling approximately 9.5’ from the side lot line. Emaline Ellen Erickson - Approved Emaline Ellen Erickson, Clitherall, MN, requested a variance to subdivide a 1.75 acre parcel from an existing 6.44 acre parcel. The property is described as part of Government Lot 7, Section 6 of Nidaros Township by Clitherall Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve the proposed subdivision of the 6.44 acre parcel with the understanding that at least a 10’ separation must be maintained between the existing structures and the proposed west property line and with the condition that a registered surveyor’s drawing must be provided at the time of recording. David Roger Lehrke - Approved David Roger Lehrke, Fergus Falls, MN, requested a variance of approximately 6” and a variance of approximately 2’ 8” from the required side lot line setback of 10’ for the addition of a second story and a crawl space to an existing structure being 9’ 6” from the side lot line at one point and being 7’ 4” from the side lot line at another point. Also, requesting a variance to exceed the existing string line by 3’ 11”. A detailed drawing is available for public inspection at the County Auditor’s office. The property is described as Lot 12, North Shore Park, Jewett Lake in Elizabeth Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of approximately 6” and a variance of approximately 2’ 8" from the required side lot line setback of 10’ for the addition of a second story and for a crawl space to an existing structure being 9’6” from the side lot line at one point and being 7’ 4” from the side lot line at another point and a variance to exceed the existing string line by 3’ 11”. It should be noted that the proposed addition will be no closer to the ordinary high water level than the existing structure. It was noted that the extreme angle of the side lot lines to the lake necessities the need for the side lot line variances. It was also noted that the proposed addition will not obstruct the view of the neighbor’s to the east and that considerable effort and planning has been done by the applicant on the development of his property. Hardship is a substandard lot of record. Gary L. Nansen - Approved Gary L. Nansen, Detroit Lakes, MN, requested a variance from the required road right-of-way setback of 20’ for the construction of a 24’ by 26’ garage adjacent to the south property line. The variance request is for placement of a garage adjacent to an existing roadway easement, thereby waiving the 20 foot roadway setback. A summary of the request is included as follows: Proposed Project1. The garage is proposed to be a 24 foot by 26 foot wood frame structure for storage of equipment and vehicles. The structure will be compatible with the residential nature of the surrounding properties. The construction wilt require removal of two pine trees and minimal site grading for construction of the foundation. Site Considerations2. The approximate dimensions of the lot are 68 feet by 220 feet. The well and individual sewage disposal system are located between the house and the lake shore, and are not a factor in the placement of the garage. Roadway Easement The roadway easement is a 66 toot wide corridor for purposes of access to the lake shore properties. The rural section access driveway is less than 20 feet in width and terminates at the garage of Lot T-4. The roadway easement terminates also and will never extend westerly due to the location of existing structures and the steep grade to the west. The easement is maintained by the adjacent property owners. Mr. Henry Moltzan Jr., Candor Township Chairman, is familiar with the roadway location and confirmed that the township does not have jurisdiction and does not maintain the easement. Mr. Moltzan was surprised by the 66 foot width of the easement and of the opinion the present and expected future use of the easement did not justify the 66 foot width. 4. Request for Variance The request for variance is presented for the following reasons: -The proposed garage location has no adverse impact on the roadway easement or use of the easement. -The proposed garage location is within the maintained lawn area of the site and does not adversely affect adjacent properties. -Conformance with the 20 foot setback and the V-shaped lot alignment result in removal of an oak tree, additional fill due to the lot grade and reduces the house and garage separation. -The garage on lot T-4 does not conform to the 20 foot setback and may actually be within the easement corridor. The site conditions do not present the typical concerns associated with roadway setbacks, such as maintenance considerations. The proposed location of the garage has no negative impact on the site or adjacent properties and Is, in fact, the best location for the structure. In conversation at our office while obtaining the permit for moving the guest house you indicated it being unfeasible to set it back the required 100 feet. In good faith we allowed a 75 foot lake setback so as not to cause a hardship. However, upon inspection we f: nd no reason for not meeting the minimum requirements of the ordinance.
