Dale Hintzler spoke in support of Mr. Schmidt’s tubing business and stated that they have worked
hard to do it right. Beverly Drager, Otter Tail River property owner, stated that her residence is
near the proposed site and expressed opposition because of the large number of tubers and
environmental issues with an engine repair shop. Ron Drager spoke in opposition. Bea
Richardson, owner of the Riverfront Lounge property, stated that at first the business was
regulated but now it is not. Larry Johnson has sold tubes (maximum of 50 per day) from 1991
through 1996. He stated that there were no complaints. Now, Mr. Schmidt has too many tubes
going down the river and it is upsetting the surrounding property owners.
Chair Froemming closed comments from the floor. Commissioners discussed the issue further;
specifically, the issue that the CUP request has changed from the original request. Commissioner
Lee and Mosher withdrew the motion and second respectively. Motion by Froemming, second by
Nelson, to deny a Conditional Use Permit to establish a one-man automotive/small engine repair
shop and relocate tube rental business as recommended by the Planning Commission. The
property is described as S 181.5’ of Lot 7 ex W 413’ (lAc), Beg 413’ E & 231.5’ NLY from SW cor
GL 7, SLY 50’, ELY 155’ to waters edge, NLY 50' WLY to beg (.18 Ac), Section 36 of Maine
Township and Lot 2 N of Hwy ex W413’ (.34 Ac), Section 1 of Sverdrup Township: Otter Tail River
(56-OTR). Chair Froemming called for a roll call vote:

Conditional Use Permit - Sandra Brownstein:
Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use Permit
to build a driveway to proposed building sites with conditions as recommended by the Planning
Commission. The property is described as Pt GL 4, Section 9 of Candor Township; Leek
(Trowbridge) Lake (56-532).
Conditional Use Permit - Sally A. Cavalier:
Motion by Lee, second by Mosher, and unanimously carried to deny a Conditional Use Permit to
prepare for a future walk-out type basement home as recommended by the Planning Commission.
The property is described as Lot 3, BIk 1, Haven Hills First Addition, Section 2 of Dora Township;
Loon Lake (56-523).
Conditional Use Permit - Scenic Point Resort/Terrv Colton & Brenda Burton:
Mr. Kalar stated that this request is to split an existing cluster development into two cluster
developments. Motion by Block, second by Lee, to deny a Conditional Use Permit to split Scenic
Point Resort as recommended by the Planning Commission. The property is described as Part
Gov Lot 2, Section 13 of Clitherall Township; Clitherall Lake (56-238). Mr. Kalar further discussed
the formula used to determine maximum density numbers. Based on Otter Tail County’s SMO, the
county has been applying the computations correctly.I

proposed shed would cause a visibility problem and that the volume of tubers needs to
be addressed. Mark McMorrow spoke against the proposal, stating that he would like to
see it totally eliminated, it is an eyesore, expressing concerns regarding safety and public
drunkenness. Becky Roberts spoke against, stating that the tubers do not have respect
for property, expressing concerns regarding intoxication and pollution. Colleen Houo
expressed concerns regarding rudeness & swearing of the tubers, they ruin property.
Dan Sandahl Indicated that the pictures presented with the letter show an old fuel barrel
next to the river that needs addressing. Jan Gladson indicated that this location is not a
place for a shop^unkers & expressed concerns regarding the numbers of tubers.
Break: At 9:25 P.M., the Commission took a break to allow Bill Kalar to obtain the files
for the existing tubing businesses (Johnson & Riverfront).
Dale Hinsverk indicated that he has been helping Mr. Schmidt with his business, stating
that it is not perfect, but that it has improved and they try do things right. He infomied the
Commission that they do a river clean-up and have received several positive comments.

December 13. 2000 / Tabled: A motion by Trites, second by Lachowitzer to table the
Application to the March Meeting, per the Applicant’s request, to provide time for the
Applicant to stake the revised road location and the proposed building site.
March 14. 2001 / Tabled: A motion by Boyer, second by Bergerud to table the
AppHcaUon to April 18, 2001 as requested by the Applicant.
Motion: A motion by Sha, second by Boyer to approve with the following conditions: 1.
A reasonable backslope, inslope & ditch bottom be installed. 2. The project must be
stabilized immediately. 3. An erosion control plan must be approved by Land &
Resource Management. Voting: All members in favor.
Motion: A motion by Bergerud, second by Schwartz to deny the request for the following
reasons: 1. This request is incompatible with the are'a. 2. Approval would create a
crowded situation and increase traffic and congestion. 3. This plan does not appear to
provide adequate parking outside of the 100’ river setback and the 20’ road right-of-way
setback for structures. Voting: All members In favor.
Sally A Cavalier - Denied:
A Conditional Use Permit Application stating: Preparation dirt work for a future, walk-out
type basement home. This would Involve moving about 275 cubic yards of dirt from the
top of the hill, which slopes from the lake about 70 feet, and leveling out the lot on the
west side. The east side of the lot would be sloped back for the walk-out type home and
about 25 cubic yards of dirt moved for a driveway. Install 3 bedroom sewer system with a
drainfield. Install a well water system. Install a horseshoe type driveway. The property
is described as : Lot 3 BIk 1 Haven Hills First Addition, Section 2 of Dora Township; Loon
Lake (56-523), RD.
October 11. 2000 / Tabled: A motion by Trites, second by Lachowitzer to table (per the
Applicant’s request) the Application to allow the Applicant to provide more specificity
(detailed plans, stake proposal(s) onsite, etc.), to a date no later than December 13,

LIndv’s Lakevlew Resort/Scott & Christie LIndemann - Withdrawn:
A Conditional Use Permit Application stating: We have requested a variance from the
Board of Adjustment to create three separate parcels. If approved, we wish to request
approval for the remaining resort cabins as a cluster development. Our reasons are as
follows: (1) The separation of our private residence from the resort property. (2) To
reduce crowding and density by reducing the resort from nine cabins (19 bedrooms) of
weekly rental to six cabins (13 bedrooms) of seasonal rentals. (3) To create a 26,000 sq.
ft. parcel for sale to our father/father-in-law so that he can build a 1,000 sq. ft. home
valued at $80,000 with separate weil and septic. The property is described as Sublot 2 of
Government Lot 4 of Section 23, Rush Lake Township; Rush Lake (56-141), GD.
Bill Kalar informed the Commission that Land & Resource Management received a letter
from Scott D Lindemann requesting to withdraw their Application.
Recognition of Withdrawal: Chairman Olson recognized the withdrawal.
Sandra Brownstein - Approved With Conditions:
A Conditional Use Permit Application to obtain a permit to build a driveway to proposed
building sites. This 20 acre parcel is being split into two 10 acre parcels. In order to
avoid a “land locked” situation, it is proposed to build a driveway to both parcels with an
easement from the first parcel to provide access to the second parcel. Both building sites
have been determined and the avoidance of existing natural low areas provided limited
driveway placement options. Request approval to build a driveway, which begins from a
junction of an existing driveway and continues for 975 feet. The driveway will serve both

Meeting of the Otter Tail County Pianning Commission was held on March 14, 2001 at
7:00 P.M. in the Commissioner's Room, Courthouse, Fergus Palis, Minnesota.
Roll Call:
Members Present: Linda Bergerud, Rod Boyer, Joe Maske, Bert Oison, Robert
Schwartz, Richard Sha, David Trites and Leona Zimmerman.
Member Absent: Les Estes and Frank Lachowitzer.
Barb Hanson and Nicoie Hansen represented the County Attorney's Office and Biil Kalar
represented the Land & Resource Management Office.
Minutes of February 14. 2001:
A motion by Trites, second by Maske to approve the February 14, 2001 Minutes as
maiied. Voting: Ail members in favor.
Sandra Brownstein - Tabled to April 18. 2001:

for vacating pad 11; 40 x 100 pole bam 20 feet from SW boundary; owners unit 20 feet
from north property line and 30 feet from east line and a 16 x 22 addition to cabin #1.

I am writing this letter to request an extension of the review of our
Conditional Use Application which is scheduled for March 14, 2001. The
ground is still frozen and covered with snow. It will make it impossible to
stake the road for your review. I would like to request to delay our
presentation until the April meeting. We will submit a plan prior to that
meeting. Al Sather will once again be representing me since I will be in
Arizona.

natural rock for the terrace walls and steps. (A drawing is on file at Land & Resource
Management, Courthouse showing measurements and elevations.) The property is

Proposed Shoreland Management Ordinance Revisions:
Bill Kalar and David Hauser discussed with the Commission the following proposed
revisions to the Shoreland Management Ordinance. The Commission considered 5
proposals:
1. Definition for Lot Width of Backlots: A motion by Lachowitzer, second by Trites to
approve as proposed (see attached). Voting: All members in favor.
2. Modification of Size for Mobile Home and Recreational Camping Units: A motion by
Trites, second by Lachowitzer to approve the proposed change (see attached).
Voting: All members in favor.
3. Definition for Vision Obstructing Fences: A motion by Maske, second by Sha to leave
the Ordinance as it exists, and not recommend a change regarding vision obstructing
fences. Voting: All members in favor.
4. impervious Surface Reouirement For Cluster Developments: A motion by Trites,
second by Lachowitzer to include the impervious surface requirement in the Cluster
Development portion of the Ordinance and have it calculated by total area as
proposed (see attached). Voting: All members in favor.
5. Exemption (from CUP1 for SWCD Projects: A motion by Trites, second by
Lachowitzer to approve the proposed exemption (see attached). Voting: All members

LANDS RESOURCE
The majority of the road will be 15 feet wide with 3 or 4 areas at 20 feet wide. The road
base will be class 5 gravel.
The grading will begin approximately 100 feet before the top of the hill and continue
approximately 500 feet.
Tlie cut depth of the hill will be approximately 4 to 5 feet at the maximum depth. This
dirt will be used to fill in the roadbed to create an adequate slope to continue the road at
the bottom of the hill. The estimated amount of dirt to be moved is approximately 2,000
cubic yards. The area that will be moved is a radius of approximately 60 feet at the top of
the hill.
The edge on the left (N. W.) side of the driveway will be revegetated to provide
stabilization. If necessary, we will put in a retaining wall to provide stabilization.
Erosion control blankets will be necessary.
Surface drainage is defined on the enclosed site design. Drainage will go to existing low
areas and be held in those areas.
The house will be 40 feet away from the driveway at its closest point.
