Beverly Drager, Otter Tail River property owner, stated that her residence is near the proposed site and expressed opposition because of the large number of tubers and environmental issues with an engine repair shop. Ron Drager spoke in opposition. Bea Richardson, owner of the Riverfront Lounge property, stated that at first the business was regulated but now it is not. Larry Johnson has sold tubes (maximum of 50 per day) from 1991 through 1996. He stated that there were no complaints. Now, Mr. Schmidt has too many tubes going down the river and it is upsetting the surrounding property owners. Chair Froemming closed comments from the floor. Commissioners discussed the issue further; specifically, the issue that the CUP request has changed from the original request. Commissioner Lee and Mosher withdrew the motion and second respectively. Motion by Froemming, second by Nelson, to deny a Conditional Use Permit to establish a one-man automotive/small engine repair shop and relocate tube rental business as recommended by the Planning Commission. The property is described as S 181.5’ of Lot 7 ex W 413’ (lAc), Beg 413’ E & 231.5’ NLY from SW cor GL 7, SLY 50’, ELY 155’ to waters edge, NLY 50' WLY to beg (.18 Ac), Section 36 of Maine Township and Lot 2 N of Hwy ex W413’ (.34 Ac), Section 1 of Sverdrup Township: Otter Tail River (56-OTR). Chair Froemming called for a roll call vote: Commission District 5 Block Yea Commission District 2 Lee Yea Commission District 4 Froemming Yea Commission District 1 Nelson Yea Commission District 3 Mosher Abstain Conditional Use Permit - Sandra Brownstein: Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use Permit to build a driveway to proposed building sites with conditions as recommended by the Planning Commission. The property is described as Pt GL 4, Section 9 of Candor Township; Leek (Trowbridge) Lake (56-532). Conditional Use Permit - Sally A. Cavalier: Motion by Lee, second by Mosher, and unanimously carried to deny a Conditional Use Permit to prepare for a future walk-out type basement home as recommended by the Planning Commission. The property is described as Lot 3, BIk 1, Haven Hills First Addition, Section 2 of Dora Township; Loon Lake (56-523). Conditional Use Permit - Scenic Point Resort/Terrv Colton & Brenda Burton: Mr. Kalar stated that this request is to split an existing cluster development into two cluster developments. Motion by Block, second by Lee, to deny a Conditional Use Permit to split Scenic Point Resort as recommended by the Planning Commission. The property is described as Part Gov Lot 2, Section 13 of Clitherall Township; Clitherall Lake (56-238). Mr. Kalar further discussed the formula used to determine maximum density numbers. Based on Otter Tail County’s SMO, the county has been applying the computations correctly.I Planning Commission April 18, 2001 Page 4 proposed shed would cause a visibility problem and that the volume of tubers needs to be addressed. Mark McMorrow spoke against the proposal, stating that he would like to see it totally eliminated, it is an eyesore, expressing concerns regarding safety and public drunkenness. Becky Roberts spoke against, stating that the tubers do not have respect for property, expressing concerns regarding intoxication and pollution. Colleen Houo expressed concerns regarding rudeness & swearing of the tubers, they ruin property. Dan Sandahl Indicated that the pictures presented with the letter show an old fuel barrel next to the river that needs addressing. Jan Gladson indicated that this location is not a place for a shop^unkers & expressed concerns regarding the numbers of tubers. Break: At 9:25 P.M., the Commission took a break to allow Bill Kalar to obtain the files for the existing tubing businesses (Johnson & Riverfront). Dale Hinsverk indicated that he has been helping Mr. Schmidt with his business, stating that it is not perfect, but that it has improved and they try do things right. He infomied the Commission that they do a river clean-up and have received several positive comments. 9:45 P.M. - Frank Lachowitzer left the meeting. Planning Commission April 18.2001 Page 5 parcels. Motion: A motion by Sha, second by Boyer to approve with the following conditions: 1. A reasonable backslope, inslope & ditch bottom be installed. 2. The project must be stabilized immediately. 3. An erosion control plan must be approved by Land & Resource Management. Voting: All members in favor. Motion: A motion by Bergerud, second by Schwartz to deny the request for the following reasons: 1. This request is incompatible with the are'a. 2. Approval would create a crowded situation and increase traffic and congestion. 3. This plan does not appear to provide adequate parking outside of the 100’ river setback and the 20’ road right-of-way setback for structures. Voting: All members In favor. Sally A Cavalier - Denied: A Conditional Use Permit Application stating: Preparation dirt work for a future, walk-out type basement home. This would Involve moving about 275 cubic yards of dirt from the top of the hill, which slopes from the lake about 70 feet, and leveling out the lot on the west side. The east side of the lot would be sloped back for the walk-out type home and about 25 cubic yards of dirt moved for a driveway. Install 3 bedroom sewer system with a drainfield. Install a well water system. Install a horseshoe type driveway. The property is described as : Lot 3 BIk 1 Haven Hills First Addition, Section 2 of Dora Township; Loon Lake (56-523), RD. If approved, we wish to request approval for the remaining resort cabins as a cluster development. Our reasons are as follows: (1) The separation of our private residence from the resort property. (2) To reduce crowding and density by reducing the resort from nine cabins (19 bedrooms) of weekly rental to six cabins (13 bedrooms) of seasonal rentals. (3) To create a 26,000 sq. ft. parcel for sale to our father/father-in-law so that he can build a 1,000 sq. ft. home valued at $80,000 with separate weil and septic. The road base will be class 5 gravel. The grading will begin approximately 100 feet before the top of the hill and continue approximately 500 feet. Tlie cut depth of the hill will be approximately 4 to 5 feet at the maximum depth. This dirt will be used to fill in the roadbed to create an adequate slope to continue the road at the bottom of the hill. The estimated amount of dirt to be moved is approximately 2,000 cubic yards. The area that will be moved is a radius of approximately 60 feet at the top of the hill. The edge on the left (N. W.) side of the driveway will be revegetated to provide stabilization. If necessary, we will put in a retaining wall to provide stabilization. Erosion control blankets will be necessary. Surface drainage is defined on the enclosed site design. Drainage will go to existing low areas and be held in those areas. The house will be 40 feet away from the driveway at its closest point.
