After discussion and consideration, Steve Schierer made a motion, second by Ward Uggerud and carried with Michael Harris
voting no, to approve a variance of 103’ from the required ordinary high water level setback of 200’ for the location of an existing
structure 97’ from the ordinary high water level. It should be noted that the variance as approved does not directly or indirectly
grant any other variance for this existing structure. Hardship/practical difficulty is the terrain/topography of the applicant’s
property.

Tail County Shoreland Management Ordinance, the Otter Tail County Set Back Ordinance and/or the Subdivision
Controls Ordinance. The Otter Tail County Board of Adjustment will assemble for this hearing on
Thursday, August 8, 2013 at 6:30 p.m.,
in the Commissioners’ Room of the Otter Tail County Government Services Center, Fergus Falls, MN. (Please use the

Guy and Pam Olson - Approved the variance application as requested. (6:57 p.m.)
Guy and Pam Olson, Lot 5 Block 1 Fawn Run Estates, Pickerel Lake in Maine Township, requested the following:
This lot was approved in 1983, by the Otter Tail County Board for residential use. In 1992, and though no fault of
ours, the law changed increasing the square footage and lot width requirement for non-riparian lots. We are
requesting this variance, to allow us to utilize the property for residential use, as it was intended. The audience was
polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve
Schierer made a motion, second by Michael Harris and unanimously carried, to declare Lot 5 Block 1 Fawn Run
Estates a buildable lot for residential use. The variance as approved does not directly or indirectly grant any other
variance for future development. The approval is consistent with past actions of the Board in this immediate area.
Gregory and Kathleen Stompro - Approved the variance application as requested, (7:05 p.m.)
Gregory and Kathleen Stompro, Lot 80 Nedberg Nye Survey Lots of Government Lots 1, 2 and 3, Section 1 of Devils
Lake by Edna Township, requested the following: Proposing to replace existing garage with a 24' by 28’ two story
garage. Requesting a variance of 39’ from required 75’ setback placing new addition 36' from ordinary high water
level, also new entry addition of 4’ by 10’. Requesting a variance of 4’ from the required 20’ setback placing new
addition 16' from road right-of-way. Requesting a variance of 8’ from required 10’ setback placing new holding tank at
2’ from lot line. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Michael Harris made a motion, second by Robert Schwartz and unanimously carried, to
approve the variances as requested in the variance application dated July 16, 2013 for the proposed development as
depicted on the drawing submitted with the application and dated July 11, 2013. The proposed development and
requested variances are consistent with other applications that have been received in the recent past from properties
in this general location.

Richard W. Rapatt, part of the Northeast Quarter of the Northwest Quarter and Government Lots 1 and 2, Section 17
of Butler Township by Bear Lake, requested the following: Located a structure on site being 54’ from the ordinary
high water level. Requesting a 146’ variance. Required setback is 200. Requesting a 104’ variance for two existing
non-dwelling structures being no closer than approximately 96’ from the ordinary high water level. The audience was
polled with no one speaking for or against the variance as requested. A letter from Kathleen Rosenthal indicating that
Butler Township stated that a buiiding permit is not required was read for the record. After discussion and
consideration. Ward Uggerud made a motion, second by Thomas Lee and unanimously carried, to approve a variance
of 146’ from the required ordinary high water level setback of 200’ for the location of an existing structure 54’ from the
ordinary high water level and a variance of 104’ for the location of two existing structures 96’ from the ordinary high
water level. Hardship/practical difficulty is the terrain/topography of the applicant's property. It was noted that these
are older structures, which required maintenance.

Regrading Building Permits:
A few years ago we were planning on constructing a few buildings but didn't
know if we needed, or where to go, to get a building permit. So I called the Butler
Township Clerk who happened to be Janice Huwe. She informed me that we did
not need a building permit in Butler Township.
