The current tract and garage location do not allow for safe access onto County Road 67; the buses must back onto the road as the are still exiting the garage. The audience was polled with a member of the Butler Town Board expressing concerns with the school's decision to locate the garage in Butler Township. Steven John Lommel - Approved Steven John Lommel, Wahpeton, NI), requested a variance to purchase a substandard lot and to have the lot considered a buildable lot and a variance of 50’ from the required ordinary high water level setback of 200’ for the construction of a dwelling 150' from the ordinary high water level. A standard lot on Belmont Lake requires 200' of frontage and 80,000 square feet of area. Lots 3, 4 and 5, Block 1 of Belmont Heights are presently owned by Robert and Phyllis Fawcett. Lots 3 and 5 meet the minimum shoreland ordinance requirements for platted lots on a natural environment lake. The property is described as Lot 4, Block 1, Belmont Heights, Belmont Lake in Leaf Mountain Township. Orvis Jibben, realtor, appeared with the applicant at the hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback of 200’ for the construction of a dwelling 150’ from the ordinary high water level and to declare Lot 4, Block 1 of Belmont Heights a buildable lot. Hardship being the unique shape of the lot. It was noted that this lot was platted after 1971 and prior to the revisions of the Shoreland Management Ordinance in 1992 this lot would have been considered a buildable lot and not a substandard contiguous lot. It was also noted that the lot has adequate water frontage and lot width. The lot has 78,500 square feet of area and is just slightly less then what the ordinance requires. The granting of the variance will not establish a precedence.
