EXPLAIN YOUR REQUEST
We are applying for a permit for a "CLUSTER DEVELOPMENT" in accordance
with your manual chapter 11. We are a privately held, private use only hunting
club that use these premisies approximately 6 weeks per year. We have been
hunting on this property for 15 years. We are applying to have up to 5 dwelling
units on our property, a combination of RV's and Manufactored homes. We
have well over a mile of shore line on a lake that is used for duck hunting. There
is no fishing, no cabins, and no resorts on this lake. We are not visible from the
lake or from any public road.

Sue Froslee expressed concerns that there is only 135’ of water frontage for the
proposed use. Deb Uselman expressed concerns on the allowance of 6 families with
only 135’ of water frontage. Jack Planton (Old Town Camp) commented on the water
frontage of parcels in the area.

John Walkup expressed concerns with the Applicant not receiving permits from the
Township & with the potential for just anyone using the property. Roger Borowski asked
just what are they requesting, the campers are already onsite, he indicated he was
opposed to the request.Motion: A motion by Sha, second by Estes to approve as presented, there shall be only
1 central dock area with 2 boat slips.Motion: A motion by Estes, second by Bergerud to approve provided the necessary

A Conditional Use Permit Application to: 1. The request is for approval of a plan to install
adequate fill (estimated at 120 cubic yards) to Lots 3 & 4 to insure drainage away from
the existing structure on Lot 4 & to provide for a future building site on Lot 3. A settling
area will be located in the SW corner of Lot 4 & on the lake front of Lot 3. The majority of
the low area on Lot 3 would be stripped (if possible) & filled with gravel. The black dirt
would be spread over the gravel & additional dirt fill installed to insure adequate soil to
support lawn growth. A barrier will be erected between Lot 3 & Lot 2 to protect the east
property from stormwater runoff. Lot 2 will have pooling of rainwater but the volume
would be significantly reduced. 2. The request is to remove 6 stumps from the shoreline
of Lot 3 & rework the ice ridge of both lots to match up with adjoining properties. Upon
completion of the work on the shoreline, the entire frontage will be riprapped according to
standards to protect the shore from additional erosion & ice damage. The property is
described as Lot 3 & 4 of the Subdivision of Lot 9 BIk 2 Crystal-Lida Beaches Plus 10’ adj
to the E of Lot 3, Section 11, Lida Township; Lake Lida (56-747), GD.
Paul Tellefson represented the Application.
Gene Watenworth expressed concern regarding drainage & questioned the need for an
engineer’s study to ensure proper water drainage.
Motion: A motion by Trites, second by Schwartz to table (with the Applicant’s approval)
to November 10, 1999 in order to provide the Applicant time to: 1. Review his request:
2. Obtain services of an engineer to resolve the drainage issues. 3. Work with Land &
Resource regarding the issuance of a Grade & Fill Permit for the ice ridge/riprap project.

Mike Arends - Approved As Reouested:
A Conditional Use Permit Application stating: I have built timber stairs on my bluff zone
to access the lake from my house. The stairs were built with 5x6 inch timbers and were
done professionally. When building the stairs i did remove about 1 yd of soil to make
grade. I have no erosion and good vegetation on the bluff. This is an After-The-Fact
request. The property is described as Lot 3 Eagle Nest Shores, Section 34 of
Tordenskjold Township; Stalker Lake (56-437), RD.
Mike Arends represented the Application.
Motion: A motion by Schwartz, second by Lachowitzer to approve, reasons as follows:
1. Applicant needs access down the bluff. 2. It has minimal erosion potential. 3.
Applicant worked with the natural topography. 4. A minimal amount of dirt and vegetation
was disturbed. 5. Vegetative screening exists. 6. Removal would cause severe erosion.
Voting: All members in favor.
Wade Siolie - Denied:
A Conditional Use Permit Application to level off a portion of my lot by the lake to improve
the lot, be able to get a vehicle to the lake, put on a shed/gazebo. The property is
described as 5 Ac Tr in GL’s 1 & 2, Section 1, Star Lake Township; Star Lake (56-385),
GD.
Wade & Marcia Sjolie represented the Application.
Motion: A motion by Estes, second by Trites, to deny, not allowing any fill to be placed
into the wetland & not allowing the ice ridge to be cut.Upper Lightning Hunt Club. Inc. - Approved With Conditions:

A Conditional Use Permit Application stating: A compromised proposal to move existing
road easement along edge of lowland/wetland. New proposal reduced to approximately
56% of original. New proposal would move road easement through wooded area
adjacent to lowland/wetland. In fact, at the closest point the far edge of the easement
would be 10 to15 feet from any open water to lessen the impact upon the
lowland/wetland. Area to be impacted is a tenth of an acre or less. Ability to move road

Motion by Portmann, second by Froemming, and unaninnously carried to approve a conditional use
permit for Eagle Lake Township, near Christina and Unnamed Lakes (Sec. 31 & 32, Twp. 131,
R. 40, Eagle Lake Township, Lake No. 56-275 & 21-375) with conditions as recommended by the
Planning Commission.
Conditional Use Permit - Dennis Hanson:
Motion by Lindquist, second by Lee, and unanimously carried to approve a conditional use permit
for Dennis Hanson on Swan Lake (Sec. 30, Twp. 132, R. 42, Dane Prairie Township, Lake
#56-781) with conditions as recommended by the Planning Commission.
Conditional Use Permit - Thomas & Jodie Collins Et Al:
Motion by Lee, second by Lindquist, and unanimously carried to approve a conditional use permit
for Thomas & Jodie Collins, et al on Dead Lake (Sec. 34, Twp. 135, R. 41W, Star lake Township,
Lake #56-383) as requested.
Conditional Use Permit - John H. Walsh:
Mr. Kalar acknowledged receipt of a letter from Benjamin R. Skjold in opposition of this conditional
use request for a cluster development. Two other Clitherall Lake property owners expressed
opposition to this proposed cluster development. Lengthy discussion took place regarding the
difference between single family home shoreland regulations vs. cluster developments, lakeshore
frontage and total area density used to determine criteria for total number of units allowed.
Motion by Lindquist, second by Portmann, and carried with Nelson opposed, to approve the
conditional use permit of John H. Walsh on Clitherall Lake (Sec. 12, Twp. 132, R. 40, Clitherall
Township, Lake #56-238) with conditions as recommended by the Planning Commission.
Conditional Use Permit - Upper Lightning Hunt Club, Inc:
Motion by Lindquist, second by Lee, and unanimously carried to approve a conditional use permit
for the Upper Lightning Hunt Club Inc. on Upper Lightning Lake (Sec. 25 & 36, Twp. 131, R. 44,
Western Township, Lake #56-957) with conditions as recommended by the Planning Commission.
Conditional Use Permit - Mike Arends:
Motion by Lindquist, second by Froemming, and unanimously carried to approve an after-the-fact
conditional use permit for Mike Arends on Stalker Lake (Sec. 34, Twp. 132, R. 41, Tordenskjold

Conditional Use Permit - Wade Siolie:
Motion by Lee, second by Portmann, and unanimously carried to deny a conditional use permit for
Wade Sjolie on Star Lake (Sec. 1, Twp. 135, R. 41, Star Lake Township, Lake #56-385) as
recommended by the Planning Commission.
Conditional Use Permit - Don Monk:
Motion by Portmann, second by Froemming, and unanimously carried to deny a conditional use

MINUTES OF THE MEETING
OF THE
OTTER TAIL COUNTY BOARD OF ADJUSTMENT
September 2,1999
The Otter Tail County Board of Adjustment met Thursday, September 2, 1999, with the following persons in
attendance:

Call to Order - Chairman John Everts called the meeting to order at 6:30 p.m.
Minutes Approved -
Hearing no corrections or additions the minutes of the August 12, 1999, meeting was approved as mailed.
The following variance requests were heard:
Clinton Brandt - Denied
Clinton Brandt, Wadena, MN, requested a variance of 10’ from the required lot line setback of 10’ for an 8’
by 10’ addition to an existing 8’ by 12’ utility shed located 0’ from the lot line. The property is described as
Lot 1, Bing’s Addition, Big Pine Lake in Pine Lake Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Mark Steuart, second by
David Holmgren and carried with Frank Lachowitzer voting no, to deny the variance as requested as no
adequate hardship had been shown. It was noted that the granting of the variance request would make a
substandard situation more substandard and other alternatives are available to the applicant.
Upper Lightning Hunt Club Inc. - Approved with a condition.
Upper Lightning Hunt Club Inc., St. Paul, MN, requested a variance for the “placement of RV’s and
Manufactured units (total of 5) less than 200 feet from the high water mark. Placements were selected
placing them equal distance from the high water marks to the north and the south (approximately in the
center of the property). Units are hidden from view from the water and are not visible from any public road.
Upper Lightning Lake is a duck hunting lake, no cabins, no fishing, no camping, no access, and no resorts.
We are a private hunt club using the area about 6 weeks of the year. We have owned the property 10
years and have had the units there for about 8 years. We are also applying for a conditional use permit.”
The property is described as part of Government Lot 4, Section 25 and part of Government Lots 6, 7, 8 and
9, Section 36 of Western Township by Upper Lightning Lake. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Frank Lachowitzer, second
by Cecil Femling and unanimously carried to approve the variance as requested, noting the various
ordinary high water level setbacks as shown on the applicant’s drawing, with the condition that an existing
outhouse must be brought into compliance with the requirements of the ordinance. Hardship is the unique
shape and topography of the applicant’s property.
