The Department of Natural Re sources has been involved with this application because the applicant approached Conservation Officer Jerry Matison regarding the project. Mr. Matison has advised Bonrud that no Department of Natural Resources permit can be issued for any fill below the high water mark at this site. He further stated that if any fill were to be done above the high water mark, Bonrud would need a permit from Otter Tail County. Contrary to what Mr. Bonrud implied at the Planning Commission meeting, the Depart ment of Natural Resources does not support this proposal. We, in fact, support the decision by the Planning Commission recommending denial. This decision was also supported by numerous local farmers who have also suffered erosion on their agri cultural land on Upper Lightning Lake, and do not expect to recover land they have lost due to erosion. It is important to note that the Department of Natural Resources is planning to work with local landowners on a project which would result in a lower and more stable lake level. Should this project be completed, it would result in improved water levels and improved waterfowl habitat. Thank you for your consideration of these comments. Sincerely, Terrence R. According to Mr. Fabian, the lake level has increased dramatically the past number of years and is now at a point where Re; 2 it is severely encroaching upon farmlands which are owned by all of you. Mr. Fabian has had a number of conferences with the Department of Natural Resources in and for the State of Minnesota as it relates to the establishment of an appropriate lake level for Lightning Lake. At Mr. Fabian's request, I have prepared an Application for the establishment of the lake level of Lightning Lake which is addressed to the Department of Natural Resources in St. Paul, Minnesota.The purpose of this Application is to request the Commissioner of Natural Resources to establish an appropriate lake level for Lightning Lake and to maintain said lake level pursuant to the statutes of the State of Minnesota. Minnesota Statutes provide that if all of the riparian owners of land located adjacent to the lake request the Commissioner's office to establish an appropriate lake level, then and in that event, the hearing process is considerably shortened and the Department of Natural Resources is then able to go in and make the necessary studies to determine what the appropriate level for this lake should be. I believe that Mr. Fabian has contacted each of you concerning this proposal and we are merely writing this letter to you advising you that we have prepared the necessary application for this purpose and that the application is in our office at this time. P-1222-6 RIPRAP SHORE PROTECTION PERMIT REQUIREMENTS and CONSTRUCTION GUIDELINES Under Minnesota Statutes, Chapter 105, public waters are any waters of the state which serve one or more material beneficial public purposes including navigation, recreation, fish and wildlife habitat, nutrient and sediment entrapment, water supply, ground water recharge, floodwater retention, and scientific and natural areas. A Department of Natural Resources permit is not required if the riprap shore protection is installed within all of the restrictions listed below: 1. The riprap shore protection shall consist of natural rock only. 2. The riprap shore protection shall conform to the natural alignment of the shore. 3. The minimum finished slope shall be no steeper than 3 feet horizontal to 1 foot vertical (3:1). 4. No materials shall be placed more than 5 feet waferward of the OHW. 5. A permit shall be required for the placement of riprap shore protection along Lake Superior and any officially designated trout stream. If the proposed riprap shore protection cannot meet all of the preceding restrictions, a permit from the Department of Natural Resources is required. Contact the appropriate regional office or the Division of Waters in St. Paul for the necessary application forms. Any projecf constructed below the ordinary high water mark (OHW) which alters the course, current, or cross-section of public waters is subject to the regulatory jurisdiction of the Department of Natural Resources. For lakes, the OHW is the highest elevation which the lake has maintained to leave evidence upon the landscape. For watercourses, the OHW is the elevation of the top of the bank of the channel. For reservoirs and flowages, the OHW is the operating elevation of the normal summer pool. A permit is not required from the Department of Natural Resources for riprap shore protection installed within the following restrictions. Local units of government and other agencies, however, may still require a permit for this project. DEFINITION PLACEMENT Riprap shore protection is defined as coarse stones, boulders, cobbles, or artificial broken rock fragments or concrete brick materials, loosely laid against an existing bank of a public water for the purpose of preventing or controlling erosion. Only natural rock riprap shore protection may be installed without a permit. Riprap shore protection is generally placed to prevent erosion by wave ac tion and currents. It is also useful in preventing burrowing animals (muskrat, beaver, etc.) from undermining bank stability. Of the three types of riprap placement - hand-placed, dumped, and gabions - dumped stone is preferred. Dumped stone is the most flexible and will adjust itself to uneven bank settlement.Dump ed riprap is usually applied from trucks and spread by a bulldozer or crane. In most cases, dumped stone is also the least costly. Hand-placed riprap should be roughly square or rectangular to facilitate placement by hand or derrick. Hand-placed riprap is easily disrupted by minor settling. Gabions (wire-enclosed riprap) consist of stone placed in wire baskets or wire-covered mats. Gabions are usually utilized when rock of suitable size is not available. There are two disadvantages in using gabions - their unnatural appearance and the potential failure of the wire enclosure. The use of gabions is discouraged because of maintenance problems. When they are necessary, however, ga bions should be confined primarily to stream banks. LOCATION The placement of riprap should be limited to the area subject to erosion. This information pamphlet outlines guidelines for the placement of natural rock riprap without a permit which includes hand-placed riprap, dumped riprap, and gabions (wire-enclosed riprap). The installation of other types of riprap will require a permit. Riprap shore protection shall be attempted only where site soils are capable of supporting riprap. Such soils may include various combinations of sand, silt, and clay. Soils such as peat and muck are not capable of supporting riprap. CONSTRUCTION A transitional layer of gravel, small stone, or fabric shall be placed between the fine material of an embankment and the riprap shore protection materials. The purposes of the filter are to (1) pre vent fine embankment material from being pulled through the riprap materials, (2) distribute the weight of the overlying riprap to prevent settlement, and (3) to provide relief to hydrostatic pressures inside the embankment. Riprap shore protection shall be Installed with a minimum finished slope of 3:1. No riprap or filter materials shall be placed more than 5 feet waterward of the OHW (see Figure 2). A severely eroding bank may require filling in with a greater depth of natural rock before a stable slope may be achieved. Gently sloping banks are more stable for riprap and result in fewer failures. Bonrud 2770 Shadyview Lane Plymouth, MN 55447 Dear Mr. Bonrud: ORDER OF THE COMMISSIONER, PERMIT APPLICATION 91-1129, UPPER LIGHTNING LAKE (56-967P), OTTER TAIL COUNTY The Department of Natural Resources has completed its review of your permit application. As a result of this review, it has been determined that your permit application must be denied. The area proposed for filling is an extension of that which you previously filled above the ordinary high water mark in late summer of 1987. An examination of the 1910 and 1973 U.S. Geological Survey Quadrangle sheet shows this entire area to be low and within the 1090 contour interval. The area you filled in 1987 had been surveyed and staked by a land surveyor and checked by Area Hydrologist Terry Lejcher prior to the fill. The stakes were located at the ordinary high water mark and represented the maximum extent of filling that was allowed by Otter Tail County jurisdiction. The area waterward of those stakes is within Department of Natural Resources jurisdiction, which is where you are now proposing to fill. Minnesota Rules 6115.0190 and 6115.0191 deal with filling and guides the Department in the decision making process. Your project fails to meet the goal of Minnesota Rule 6115.0190, Subpart 1 which directs the Department to limit the placement of any fill material to minimize encroachment, change or damage to the environment. Department of Natural Resources wildlife experts have determined this filling will result in the loss of shallow wetland habitat important to the ecosystem of the area. These experts have determined this filling would also provide the opportunity for increased hunting pressure and waterfowl harassment. This is contrary to the management objectives of the proposed designation of Upper Lightning Lake as a Wildlife Management Lake. AN EQUAL OPPORTUNITY EMPLOYER October 18, 1991 Dean C. Bonrud Page 2 Minnesota Rule 6115.0190, Subpart 3.B. specifically states as follows: Subpart 3. Nonpermitted placement. Placement shall not be permitted in the following cases: B. to create upland areas . . . This rule clearly prohibits this proposal. Minnesota Rules 6115.0190 contains specific standards for proposed filling projects. Subpart 5.A. requires the project involve a minimum of encroachment, change or damage to the environment, including but not limited to, fish and wildlife habitat. Subpart 5.E. requires the project must represent the minimal impact solution to a specific need with respect to all other reasonable alternatives. This proposal fails to meet both of these requirements. You have already significantly extended the point in 1987, reclaiming that above the ordinary high water mark that was lost due to erosion. Shoreline lost to erosion is addressed by Minnesota Rule 6115.0191, Subpart 4 as follows: Subpart 4. Shoreline lost by erosion. Applications for filling to recover shoreland lost by erosion or other natural forces shall be permitted only where: A. the loss of shoreline is a threat to health and safety through the impending loss or damage to existing shoreline developments; B. the loss of shoreline has occurred as a result of changes in water level or flow conditions caused by artificial manipulation of flows or levels of the waters involved within a period of not more than five years prior to the date when an application for filling is submitted. Since there is no threat to health and safety to existing shoreline development, and because there has been no artificial manipulation of water levels on Upper Lightning Lake, these required standards cannot be meet. Finally, Subpart 8.B. requires that "the proposal will adequately protect public safety and promote the public welfare". Based on the Department's review, it has been determined that filling the excavated area offshore of your property would not protect the "public safety or promote the public welfare". Accordingly, your application is denied in all respects. October 18, 1991 Dean C. Bonrud Page 3 Pursuant to Minnesota Statutes, Section 103G.311, Subdivision 5, the applicant, the managers of the watershed district, the board of supervisors of the soil and water conservation district or the mayor of the city may demand a hearing on the Order provided the demand for hearing and the bond required by Subdivision 5 be filed with the Commissioner within 30 days. No bond or security is required of a public authority which demands a hearing. The Statutes further provide that if no demand for hearing be made or if a hearing is demanded but no bond is filed as required by Subdivision 5, the Order shall become final at the expiration of 30 days after mailed notice thereof and no appeal of the Order may be taken to the Minnesota State Court of Appeals. Subdivision 5 requires that an applicant filing a demand for a public hearing execute and file a corporate surety bond or equivalent security to the State of Minnesota. The amount to be filed is $500.00 as set by the Commissioner. The bond or security shall be conditioned for the payment of certain costs and expenses of the public hearing if the Order is affirmed without material modification; however, the applicant's liability is limited to $750.00. The $750.00 limit does not apply when a public hearing is demanded by a public authority which is not the applicant. Bond forms will be supplied at your request. The hearing will be conducted by Administrative Law Judge Phyllis Reha of the Office of the Administrative Hearings, 400 Summit Bank Building, 310 Fourth Avenue South, Minneapolis, Minnesota 55415, telephone (612) 341-7611. She will conduct the hearing according to Minn. Stat. ch. 14 and the Rules of the Office of the Administrative Hearings, Minn. Rules parts 1400.51U0-1400.8400, which provide generally for the procedural rights of parties, and which are available from the Minnesota Bookstore, 117 University Avenue, St. Paul, Minnesota 55155, telephone 297-3000.
