The Department of Natural Re­ sources has been involved with this application because the applicant approached Conservation Officer Jerry Matison regarding the project. Mr. Matison has advised Bonrud that no Department of Natural Resources permit can be issued for any fill below the high water mark at this site. He further stated that if any fill were to be done above the high water mark, Bonrud would need a permit from Otter Tail County. Contrary to what Mr. Bonrud implied at the Planning Commission meeting, the Depart­ment of Natural Resources does not support this proposal. We, in fact, support the decision by the Planning Commission recommending denial. This decision was also supported by numerous local farmers who have also suffered erosion on their agri­ cultural land on Upper Lightning Lake, and do not expect to recover land they have lost due to erosion. It is important to note that the Department of Natural Resources is planning to work with local landowners on a project which would result in a lower and more stable lake level. Events The Minnesota Department of Natural Resources will be hosting an informational meeting concern­ ing management of Upper Light­ ning Lake on March 12 at 7 p.m. at the Western Township town hall, Section 22, Western Town­ ship, Otter Tail County. The DNR will present a proposal to regulate the water level in the lake to im­ prove the wildlife value and water quality of the lake. All interested parties are invited to attend and provide input and ideas. Upper Lightning Lake is a me­ andered, shallow lake of about 625 acres that has historically been important as a waterfowl migra­ tion staging area and as breeding habitat for waterfowl and other wetland wildlife species. Recently, however, the lake has lost most of the cattails and bullrush stands due to extended high water condi­ tions. Under the DNR’s proposal, the vegetation in the lake could be restored by managing the lake at a lower elevation over the long term and also by a temporary drawdown of the lake that would expose some of the shore of the lake to promote seed germination of wetland plants. Impleinenting the proposed plan would require several permits and easements from inchvidual landowners and agencies. The proposed management plan is designed to promote better stands of wetland vegetation in the lake to improve the habitat for several species of wildlife. Reha on March 4, 1992 at the South Dakota Room, Otter Tail Power, Fergus Falls, Minnesota. The record closed on April 14, 1992, upon receipt of the Department’s reply memorandum. The Department of Natural Resources ("Department" or "DNR") was represented by Donald A. Kannas, Special Assistant Attorney General, Suite 200, 520 Lafayette Road, St. Paul, Minnesota 55155. Dean C. Bonrud ("Applicant") was represented by Dennis W. Hagstrom of the law firm of Nycklemoe Ellig and Hagstrom, Attorneys at Law, Professional Building, 106 East Washington, P. O. Based on all of the proceedings herein, the Commissioners of Natural Resources makes the following: FINDINGS OF FACT The ALT’S Findings of Fact numbered 1-32 in her Report are hereby adopted, as the Commissioner’s Findings of Fact 1-32, subject to the following exception to correct an apparent typographical error; the last sentence of Finding of Fact No. 14 is amended to read: Using the evaluations provided by the DNR, Mr, Anderson determined the lake elevation on the date of his survey to be 1083.86 or a little more than .3 of a foot over the OHWL. This amendment makes no substantive change in the Findings of Fact. Based on the foregoing Findings of Fact, the Commissioner makes the following: CONCLUSIONS 1. The Minnesota Department of Natural Resources duly acquired and has jurisdiction in this matter. All parties have fulfilled all relevant, substantive and procedural requirements2. of law and rule. At the time the Applicant made an application to place fill in a portion of Upper Lightening Lake, it constituted protected public waters of the State as those terms are used in Minn. Stat. § 103G.005, subd. 15. The ordinary high water level (OHWL) delineates the boundary of the public water. The OHWL of Upper Lightening Lake is 1083.5. Any proposed construction below this OHWL which changes or diminishes the course, current, or cross section of public waters by any means, including filling, or placing of materials below the OHWL requires a public works permit firom the DNR pursuant Miim. Stat. § 103G.245, subd. 1. A portion of the area proposed to be filled extending 300 feet waterward from Banker’s Point is below the OHWL of 1083.5. The Applicant has the burden of proving by a preponderance of the evidence that the proposed project is reasonable, practical and will adequately protect the public safety and and promote the public welfare pursuant to Minn. Stat. § 103G.315, subd. 6. The proposed filling project of the Applicant fails to minimize encroachment, change or damage to the environment contrary to Minn. The Applicant has failed to prove by a preponderance of the evidence that the proposed fill project will adequately protect the public safety and promote the public welfare consistent with Minn. The Applicant has failed to prove by a preponderance of the evidence that the proposed filling project is reasonable with respect to all other alternatives and there are no feasible and practical means to attain the intended purpose without filling consistent with Minn. Rule 6115.0191, subpart 8.A. 12. The proposed filUng project pLthe Applicant constitutes impairment of the State’s natural resources pursuant to Minn. Stat. § 116D.04, subd. 6. 13. There is a feasible and prudent alternative (See Findings 17 and 22) to the implementation of the proposed project, consistent with the reasonable requirements of public health, safety and welfare and the State’s paramount concern for the protection of its air, water, and other natural resources from pollution, impairment or destruction. Therefore, granting the proposed permit would violate Minn. Stat. § 116D.04, subd. 6. 14. The Applicant did not prove by a preponderance of the evidence that the proposed project is reasonable, practical and will adequately protect public safety and promote the public welfare as required by Minn. Stat. § 103G.315. 15. Any of the foregoing Findings of Fact which are more properly termed conclusions and any of the conclusions more properly termed Findings of Fact are hereby expressly adopted as such. -3- Based upon the foregoing Conclusions, the Commissioner makes the following: ORDER It is hereby ORDERED that the application of Dean C.
