DNR public access roadway status is complicated du to federal funding. Request approval of variance to subdivision ordinance or allow parcel to be split according to metes and bounds method. After discussion and consideration, Steve Schierer made a motion, seconded by Thomas Lee and unanimously carried, to waive the public road dedication requirement for the proposed preliminary plat of Bollinger Addition noting the existence of the DNR Public Access Roadway, which is very useable. Access to the proposed lots will be by either the DNR Public Access Roadway or the proposed easement which will exist by conveyance and not as a part of the plat. It was noted that the Planning Conmiission has approved the preliminary plat of Bollinger Addition contingent upon the granting of a variance from the public road dedication requirement. Hardship/practical difficult is the issues related to funding and dedication of the DNR Public Access Roadway. Minutes Approved - The Board of Adjustment approved the minutes of the June 8, 2017 meeting as mailed. The applicant noted that the size of the building was changed from 40’ by 50’ to 40’ by 48’. Thereby reducing the requested variance from the required ordinary high water level from 20’ to 18’. After discussion and consideration, Paul Larson made a motion, seconded by Thomas Lee and carried with Chris McConn and Steve Schierer voting no, to approve a variance of 18’ from the required ordinary high water level setback of 200’ for the placement of a 40’ by 48’ storage building 182’ from the ordinai y high water level with the condition that it cannot exceed the maximum allowable height of 20’. The variance as approved does not directly or indirectly grant any other variances for the proposed or fliture development. Todd and Brenda Gross - Denied. (6:45 p.m.) Todd and Brenda Gross, part of Government Lot 1, Section 7 of Dunn Township by Pelican Lake, requested the following: The rafters were changed from an 8-12 pitch to a 10-12 pitch, thus allowing (for less chance of head injury) a slightly elevated ceiling on the upstairs storage room. The added room acquired, made the garage 21.9’ in height. The required height for a non­ dwelling is 20’. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a motion, seconded by Richard Gabe to approve the variance as requested in the variance application dated June 5, 2017 and as depicted on the drawing submitted with the application. This motion failed to pass with Paul Larson, Daixen Newville and Steve Schierer voting no. Those members voting in favor of the motion noted that this situation was not the fault of the property owners, but was caused by the contractor and that the property owners acted in good faith. Those members voting against the motion indicated that the site permit stated the maximum allowable height, indicated that had a request been presented for the additional height before the construction was started they would not have approved a variance to exceed the maximum allowable height and noting that granting the variance as requested would establish precedence that they do not wish to establish. The Board noted that the applicants should work with the Land and Resource Department to resolve the issue on or before October 15, 2017. My purpose in writing is to summarize the status of the above-referenced parcel. I will first set forth the pertinent facts. I have been advised that Mr. Dwight Eric Robertson conveyed the property to Ms. Peterson and her children by quitclaim deed, with that property having the following address and tax identification number: 42123 Spitzer Lake Trail, Clitherall, MN (Tax Id. No.: 36-000-99-0299- 000). I have attached to this letter a copy of the recorded deed (Doc. No.: 1180518). Mr. Robertson then apparently forged Ms. Peteron’s signature on a separate quitclaim deed in an attempt to regain title to the property (Doc. No. 1184829). I have also attached a copy of this recorded deed. I have advised Ms. Peterson that the later-recorded deed is invalid and should be set aside. In my opinion, no prospective buyer would be satisfied that Mr. Robertson has clear title to the property given the two deeds referenced above. Indeed, the later-recorded fraudulent deed fails to include the signature of Ms. Peterson’s spouse. That fact alone renders the deed improper. Under Minnesota Statutes § 609.64, whoever intentionally presents for recording a false or forged instrument affecting real property may be sentenced to imprisonment for not more than three years, and be ordered to pay a fine of not more than $5,000.00, or both. Because of Mr. Robertson’s actions in recording a document he knew to be fraudulent, I intend to refer this matter to the County Attorney in Otter Tail County for criminal prosecution. Ms. Peterson also intends to file suit against Mr. Robertson for slander of title, and will seek a court order setting aside the fraudulent deed at issue. Our property has many topographical features that only allow for one optimal building site. Putting the house at the required 100’ setback pushes it off a small bump hill into a grove of trees to the south. Using this setback will impede the natural land drainage, require more trees to be cut and possibly places the foundation too close to the water table. We are requesting that part of the house (approximately 17’) closest to the lake be set at 76’ back from the ordinary highway water level. The main part of the house 89’ back from the ordinary high-water level and the garage would be 97’ back from the ordinary high-water level. Our end goal is to have a beautiful lake home to move into while preserving as much of the natural beauty of the land and lake as possible.
