Conditional Use Permit - James H. & Constance M. Day:
Motion by Lee, second by Froemming and unanimously carried to approve a Conditional Use
Permit to construct a driveway and 50’ x 50’ pad for a pole barn building site with conditions
as recommended by the Planning Commission. The property is described as Pt GL 1 (17.74
AC), Section 35 of Dunn Township; Franklin Lake (56-759).
Conditional Use Permit - Susan & Joel Reimers:
Motion by Mosher, second by Nelson, and unanimously carried to approve as presented a
Conditional Use Permit to construct a driveway and parking area. The property is described
as Pleasant Pointe Lot 4 BIk 2, Section 5 of Sverdrup Township; Pleasant Lake (56-449).
Conditional Use Permit - Paul & Grace Ellefson:
Motion by Froemming, second by Mosher, and unanimously carried to approve an after-the-
fact Conditional Use Permit for driveway construction, with conditions as recommended by
the Planning Commission. The property is described as those parts of Lot 8 & 9..., Auditor’s
Subdivision #116, Section 22 of Leaf Lake Township; East Leaf Lake (56-116).
Preliminary Plat and Conditional Use Permit - “Bluegill Bay Estates’VBalgaard Family
Enterprise:
County Attorney, David Hauser, read a letter addressed to Chairman Malcolm Lee, from
Knutson Ventilation Consulting, Inc., Gerhard W. Knutson, Ph.D., CIH. The letter was dated
August 15, 2003, and expressed opposition to approval of the Preliminary Plat of Bluegill Bay
Estates and the established ordinary high water level. Jim Peterson of Anderson Land
Surveying stated that he provided elevations to Terry Lejcher for his review as to whether this
was lakeshore or not. Mr. Lejcher approved these elevations and found them to be
adequate. Land & Resource Director, Bill Kalar, stated that 1298.0 is the correct OHWL
according to information received by the DNR and the County’s Ditch Inspector has reported
that the outlet for Lake Sewell is flowing at capacity. The lake is 1 to VA ft. lower from earlier
this year.
Motion by Mosher, second by Block, and carried with Nelson opposed, to approve the
Preliminary Plat known as “Bluegill Bay Estates’’ based on the revised drawing of July 29,
2003, and a Conditional Use Permit to build a road for the development, with conditions as
recommended by the Planning Commission. The property is described as Pt Gov Lots 3 & 4
& Pt of the NV2 of SWV4 of of NE% of NE/4 (13.6 ac). Section 23 of St. Olaf Township;
Sewell Lake (56-408).
Conditional Use Permit - John Stumpf:
Motion by Lee, second by Froemming, and unanimously carried to deny the Conditional Use
Permit request to replace a failing retaining wall. The property is described as Lot 2 BIk 1
Perrin’s Subdivision, Section 10 of Lida Township; Crystal Lake (56-749).
Preliminary Plat and Conditional Use Permit - “Sportsman LandingVBrian Clouse:
Land & Resource Director, Bill Kalar, reported that the Planning Commission approved this
Preliminary Plat with a condition that if the purchase agreement with the DNR for Lot 3, Block
1 is not completed, this lot would be considered unbuildable. Applicant, Brian Clouse, and
his Attorney, Tom Gedde, represented the application. Mr. Gedde expressed concern with
the condition placed on the property and requested that the County Board approve this plat
request without conditions. Allen Haugrud (Jewett Lake Association) felt that the condition is

“Mullen’s Country Court’’ / Vincent Mullen - Approved With A Condition:
A Preliminary Plat titled "Mullen’s Country Court” consisting of 3 Single Family
Residential Lots, 1 Block. A Conditional Use Permit Application stating: Construct road
to specs of Appendix 3 of the Subdivision Controls Ordinance to service proposed plat of
“Mullen's Country Court”, The property is described as Pt GL 3 & 4 & Pt NE1/4 NW1/4
(60.38 AC), Section 15 of Maine Township; Round Lake (56-476), NE.
Terry Anderson (Surveyor) and Vince Mullen represented the Application.
Motion: A motion by Trites, second by Sha to approve provided there is a reconciliation
between the Wetland Delineation Report and the Surveyor’s Drawing pertaining to the
wetland location. Note: Due to the distance, the road does not have to extend to the
westerly lotline. Voting: All Members in favor.
-James H & Constance M Day - Approved With Conditions:
A Conditional Use Permit Application stating: Permission to construct a driveway approx.
450’ in length & 12-14’ in width that will follow the natural slope using approx. 80 cu. yds.
of topsoil & vegetation and approx. 80 cu. yds. of class 5 gravel. We, also, request
permission to prepare a 50’ x 50’ pad for a pole bam bldg, site with an average cut of
4.5’; removing approx. 420 cu. yds of topsoil. Approx. 80 cu. yds. of the soil from this
pad will be used on the driveway; the remaining approx. 340 yds. will be spread SW of
the pad to level that area. Stumps will be removed from driveway & bldg, site & placed
SW of the pad. The property is described as Pt GL 1 (17.74 AC), Section 35 of Dunn
Township; Franklin Lake (56-759), RD.
James & Constance Day represented the Application. The Applicant made a note that
the request states SE and it should be SW.
Motion: A motion by Sha, second by Estes to approve as presented, provided: 1. The
Applicant must comply with the MPCA Stormwater Permit requirements. 2. Appropriate
erosion control measures must be implemented. 3. Spoil material(s) must not be placed
in the drainage area. Voting: All Members in favor.
Susan & Joel Reimers - Approved As Presented:
A Conditional Use Permit Application stating: To construct a 300’ long x 16’ wide
driveway, starting from Pleasant Lake Road to our lot. In addition, we request permission
to construct a 50’ x 50’ parking area on our lot. Cut ditches 2’ deep on both sides of
driveway to be used on road bed. The property is described as Pleasant Pointe Lot 4 BIk
2, Section 5 of Sverdrup Township; Pleasant Lake (56-449), RD.
Wayne Evavold (Contractor) represented the Application.
Motion: A motion by Trites, second by Lachowitzer to approve as presented. Voting:
All Members in favor.

block. A Conditional Use Permit Application stating: To build approximate 2,960 feet of
road for the proposed development of ’’Bluegill Bay Estates”, The proposed road to be
constructed to the minimum road standards of Appendix 3 of the Otter Tail County
Subdivision Ordinance. The property is described as Pt Gov Lots 3 & 4 & Pt of the N1/2
of SW1/4 of NE1/4 of NE1/4 of NE1/4 (13.6 ac), Section 23 of St. Olaf Township; Sewell
Lake (56-408), RD.
Jim Peterson (Anderson Land Surveying), Jason Kerr (West Central Environmental
Consultants) & Gerald Balgaard represented the Application.
Gerhard Knutson distributed a handout and spoke against the development, expressing
concerns regarding the increase in development on the lake and the high elevation of the
lake. James Puchtel expressed concerns regarding the increase in development and the
high lake elevation.
Motion: A motion by Sha, second by Estes to approve the Revised (July 29, 2003)
Drawing as presented, provided the culverts are sized and placed as recommended by
the Area Hydrologist. Note: The outlet of Sewell Lake (County Ditch #70) should be
evaluated. Voting: All Members in favor, except Boyer & Lachowitzer.

Motion / July 9, 2003: A motion by Bergerud, second by Boyer to table (at the Applicant’
request) to August 13, 2003 to allow the Applicant to provide: 1. A stabilization plan. 2.
A plan relocating the lake access. This material must be received by Land & Resource
Management no later than July 28, 2003.
Motion: A motion by Boyer, second by Maske to deny, due to the lack of information
and the sensitivity of the area, this project should be reviewed by a qualified engineer.
Voting: All Members in favor.
