On measuring the distance from the northeast comer of the garage to the center of the road we find the distance to be 50 feet. After our phone conversation, I contacted the chairman of the Township Board who suggested that I meet with the Township Board at their meeting on July 2, 2001. The Township Board issued a letter of approval for a variance of the approximately three feet that the comer of the garage extends into the set back of the road right of way. Attached is a copy of that letter and a drawing showing the area in question. I tmst these documents will conclude the matter. SINCERELY, KENT LADD cc: Marv Skov SCANNED August 9, 2001 Page 3 James Eggum and Marion Rund - Approved as requested. James Eggum and Marion Rund, Fergus Falls, MN, requested a variance to have a substandard back lot, by current ordinance standards, declared a buildable lot. The applicant’s lot met the requirements of the ordinance when the plat was developed in 1979, but due to a 1992 ordinance change the lot is now considered a non-buildable substandard back lot. The property is described as Lot 2, Block 1, Wingers Hill Top, Wall Lake in Aurdal Township. The audience was polled with Milt Paulson speaking generally for the buildable approval of these types of lots. After consideration and discussion, motion was made by Steve Schierer, second by David Holmgren and unanimously carried, to approve and declare Lot 2, Block 1, Wingers Hill Top, as a buildable lot. Ron Ronken - Denied Ron Ronken, Henning, MN, requested a variance of 46’ from the required ordinary high water level setback of 100’ and a variance of 18’ from the required top of bluff setback of 30’ for construction of a two story dwelling, with an attached garage behind the dwelling, 54’ from the ordinary high water level, 12’ from the top of the bluff and 10’ from the side lot lines. The property is described as the South Half of Lot 2 and all of Lot 3, Linden Park, East Battle Lake, in Girard Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Cecil Femling, second by Steve Schierer and unanimously carried, to deny the variances as requested as no adequate hardship unique to the property had been shown and an alternative is available which will not require the granting of a variance. and Mary Ladd - Approved Kent and Mary Ladd, Ottertail, MN, requested a variance of 3’ from the required road right-of-way setback of 20’ for the placement of a garage 17’ from the road right-of-way or 50’ from the center of the road. The property is described as Lot 2, Block 1, Brademeyer Third Addition, West Leaf Lake in Leaf Lake Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by David Holmgren, second by Cecil Femling and carried with Mark Steuart abstaining, to approve a variance of 3’ from the required road right-of-way setback of 20’ for the placement of a garage 17’ from the road right-of-way noting that the Leaf Lake Town Board has approved the request. Hardship is the ^terrain and topography and the applicants’ property. Francis and Louise Genereux - Denied Francis and Louise Genereux, Alberta, MN, requested a variance of 34’ from the required ordinary high water level setback of 100’ for the placement of a 40’ by 60’ shed 66’ from the ordinary high water level. The property is described as part of Government Lot 2, Section 20 of Edna Township by McDonald/Mud Lake. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Randall Mann, second by Richard Sha and unanimously carried to deny the variance as requested noting that a reasonable use of the property can be obtained by the applicants without the granting of a variance and noting that no adequate hardship unique to the property had been shown that would support the granting of the variance as requested.
