SPECIFY VARIANCE REQUESTED
We respectfully request a VARIANCE from the 20' roadway setback, ie.,
the actual Right of Way (ROW).
We wish to locate a garage 0+' from the recorded ROW and 10-f' from
the actual ROW.
HISTORY: Several years ago, the Township reconstructed the road, moving
it 22' to 25' to the north. The old ROW has not been abandoned or re
recorded to our knowledge. The Town Board has agreed in principal to
allow our garage to be located partially into the recorded ROW. We
anticipate formal approval at their June 1st meeting.
We believe granting this variance will not be detrimental in anyway to the
operation, maintenance or public safety of the road nor the community, (over)

other landscaping growing in the same Right of Way.

Motion was made by George Walter, seconded by John Everts and carried with Randall Mann voting no, to approve
the construction of a garage extending 26’ out from the corner of the proposed dwelling as depicted on the applicant's
plans. It was noted that this variance should place the garage approximately 20’ from the new road right-of-way and
approximately 10’ from the old road right-of-way. It was also noted that the granting of the modified variance would
provide the applicant with a reasonable use of his property. Hardship is a substandard lot of record.

to construct the proposed deep well 13’ from the replaced sewer line and the buried sewer line will
be 18’ to neighbor’s shallow well." The property is described as part of Reserve E, Leaf Lake
Pleasure Grounds,'West Leaf Lake in Leaf Lake Township. The audience was polled with no one
speaking for or agaVst the request. After consideration, motion was made by John Everts,
seconded by Randall Mann and unanimously carried, to approve the variance as requested noting
the requirements contained within the letter dated March 26, 1998 from the Minnesota Department
of Health. Hardship is a substandard lot of record.

ames Guddal, Plymouth, MN, requested a variance of 20’ from the required road right-of-way
setback of 20’ for the placement of a garage 0’ from the recorded road right-of-way and 10’ from the
actual road right-of-way. The property is described as Lot 3, Pebble Bay Second Addition, West
Leaf Lake in Leaf Lake Township. A letter from the Leaf Lake Board of Supervisors addressing the
existing road right-of-way was read for the record. The audience was polled with no one speaking
for or against the request. After consideration, motion was made by George Walter, seconded by
John Everts and carried with Randall Mann voting no, to approve the construction of a garage
extending 26’ out from the corner of the proposed dwelling as depicted on the applicant’s plans. It
was noted that this variance should place the garage approximately 20’ from the new road right-of-

Paul Ray - Tabled
Paul Ray, Grand Forks, ND, requested a variance 6T from the required ordinary high water level
setback of 100’ for an addition to an existing cabin 39’ from the ordinary high water level. The •
property is described as Lot 6, Kozelnik Beach Second Addition, Big McDonald Lake in Edna
Township. The audience was polled with no one speaking for or against the request..After
consideration, motion was made by John Everts, seconded by Randall Mann and unanimously
carried, to table per the applicant’s written request this application for variance until the July 2, 1998
meeting of the Board of Adjustment.
Donald and Donna Gervais - Denied
Donald and Donna Gervais, Pelican Rapids, MN, requested a variance of 60’ from the required
ordinary high water level setback of 100’ for the placement of an 8’ by 12’ screen porch 40’ from the
ordinary high water level. The property is described as the South 100’ of the East 166’ of
Government Lot 5, Section 31 of Dunn Township by Lake Lizzie. The audience was polled with no
one speaking for or against the request. After consideration, motion was made by John Everts,
seconded by David Holmgren and unanimously carried to deny the variance as requested as no
adequate hardship had been shown and to allow the applicants until September 1, 1998 for the
removal of the 8’ by 12’ screen porch. After additional discussion and consideration, motion was
made by John Everts, seconded by Cecil Femling and unanimously carried, to allow the addition of
a screened porch to the existing structure so long as the porch is no closer to the ordinary high
water level than the existing 24’ by 32’ structure and so long as all other setback requirements are
met.
