September 8, 2005 Meeting - Bruce Barrett (Amy’ Father) and Pat (Friend of the Family) represented the applicants
at the public hearing. After discussion with the applicants’ representatives there was some concern that the applicants
might want or need variances different then the variances requested in the original application. After consideration
and discussion, Joe Maske made a motion, second by Michael Conlon and carried with Paul Larson abstaining, to
table this application until the October 6, 2005 meeting of the Board of Adjustment to allow the applicants an
opportunity to give additional consideration to there proposed development and to the requested variances and to
direct that if the applicants require variances other then those already requested that they provide the office with a
revised application no later than 3 p.m. on Thursday, September 15, 2005 and to direct the Secretary of the Board to
provide notification of the changed application by the normal notification process. October 6, 2005 Meeting - The
audience was not polled. Any Engerholm submit a letter prior to the hearing stating that she would no longer pursue
her variance request.

Discussion Regarding the following motion from September 1, 2005 -
Neil and Carmen Qualey - Denied the variance as requested and approved a modified ordinary high
water level setback variance. (8:25 p.m.)
Neil 3, Carmen Qualey. Lot 2". Shirley Beach. Cttertail Lake m Amor Township, requested the following:
This "equest is for a 2C by 22' two story addition attacned to the existing cabin and relates to the variance
approved on November 5, 2C03 for the same addition. This request further identifies the roof line
connecting the old cacin with the new addition. The lakeside roof line of the existing cabin will continue at
the same slope until meeting the second stony of the 20' by 22' adoition per the attached drawing. The
7/12 bitch will remain the same elevating to the new addition to a peak of 27’ which will be 29’ back from
the current sidewall on the laKeside. The ,'oof on the lakeside will be guttered with drainage being directed
away from the lake We also request aoproval. ;f deemed necessary by our contractor, to replace the
concrete footing on the existing cabin. No other cnanges are requested from previous aoproval on
November 5. 2003. Kurt Maethner appeared along with the applicant at the public hearing. The audience
was colled with no one speaking for or against the variance as requested. After discussion and
consideration, Cecil Femiing made a motion, second by Steve Schierer and unanimously earned to deny
the variance as requested as no adequate hardship unique to the property had been shown that would
allow for the granting of the variance as requested. Some members of the Board noted that they would not
have approved the previously granted variance had they known that the foundation for the existing
structure might need to be replaced. After additional discussion and consideration, motion was made by
Steve Schierer, second by Michael Conlon and unanimously carried, to approve the placement of a new
foundation for the existing 24' by 26’ cabin 37 5' from the ordinary high water level and to allow the
proposed 20’ by 22’ addition to the rear of the existing structure as relocated at the 37.5' setback. It should
be noted that the variance as aoproved does not directly or indirectly grant any other vanances that might
be necessary has a result of relocating the existing 24’ by 26’ cabin at the 37.5’ setback from the ordinary
high water level. It was also noted that the applicant can still proceed with development as authorized
under the previously granted variance.
October 6, 2005 meeting - The question under consideration is the following; Does the 37.5' setback
apply to completely new construction (foundation and structure) or only to the placement of a new
foundation for the existing 24' by 26' cabin 37.5' from the ordinary high water level and to the proposed 20’
by 22' addition to the rear of the existing srructure as relocated at the 37.5' setback. After discussion and
consideration, Randail .Mann made a motion, second by Steve Schierer and carried with Leona
Zimmerman abstaining to clarify that new construction s permissible under th^ar^nce as,acQroiied-Dn
