A motion by Trites, second by Estes to table, at the Applicant's
request, to May 19, 1999, the Applicant is to provide a detailed
plan showing 15 to 20 designated parking spaces and compliance
with Ordinance requirements.
MAY 19.1999 - WITHDRAWNDoug & Mary Trana represented the Application and indicated that the proposal has been revised and now
includes: 1. A 25’ x 30’ 2 story addition, the second story will not contain any living quarters, but be used
for office/storage. 2. There will not be any additional seating requested. They did present a parking plan
which was placed into their file.
Bill Kalar indicated that since the revised request does not include an expansion of the commercial use, a
Conditional Use Permit is not required, although a Site Permit is required.
Since this is the case, Doug & Mary Trana requested to withdraw their Conditional Use Application. They
were informed that the $19.50 Recording Fee would be refunded.

Laura Johnson - Approved With Conditions:
A Conditional Use Permit Application to eliminate a berm and fill a hole that was built
several years ago to eliminate run-off from cattle into the lake. The cattle were sold
approximately 5 years ago. Details of the project are on file at the Land & Resource
Management Office. The property is described as GL 3 & 4 Ex Tracts (14.23 Ac).
Section 30 of Corliss Township; Little Pine Lake (56-142), GD.
Laura Johnson & Peggy Johnson represented the Application.
Elaine Johnson indicated that there has never been any manure placed into the manure
pit.
Motion: A motion by Zimmerman, second by Lachowitzer to approve allowing an
extension beyond Tract 11 provided: 1. A berm remains adjacent to the lake. 2. The
land slopes away from the lake. 3. The area is stabilized with sod or seed. 4. Approval
from the MPCA is obtained for abandoning the manure pit (the MPCA’s requirements
must be followed). 5. All concrete is removed from the site and disposed of off-site.
Voting: All members in favor.
Ronald Barth - Approved With Conditions:
A Conditional Use Permit Application to repair and remove existing wall that is currently
in place. Replace rotting posts and tin which is pushing in toward lake with treated
timber. Remove dirt fill that was hauled in when original wall was built and replace with
natural sandy fill. The property is described as Robinson’s Addition - Clitherall, of
Lot 25, Lots 26 & 27, Section 6 of Nidaros Township; Clitherall Lake (56-238), RD.
This Application was tabled at the April 21, 1999 Meeting with a motion by Estes, second
by Sha to table, at the Applicant's request, to May 19, 1999, allowing the Applicant to
present a revised plan.
Kathleen Barth represented the Application.
Motion: A motion by Trites, second by Schwartz to approve (as shown on the drawing
received by Land & Resource 5/15/99), provided that if the retaining wall shows any sign
of f^ure, the riprap must be extended to include the area where the wall is located.

No Formal Action:
Bill Kalar discussed with the Commission a “Making Land Use Decisions” seminar will be
put on by the MCIT, the AMC & the MACPZA. He informed them that the Land &
Resource Management will send 2 representatives and the County Attorney’s Office will
send 1 representative. After attending this seminar a summary will be presented to the
Planning Commission and the Board of Adjustment. Mr. Kalar indicated that if anyone
was interested in attending this seminar, they should contact him.
Bill Kalar discussed with the Commission a proposal from an area contractor regarding
installing riprap along with a lower sandy area behind (landward) the rock. The
contractor had indicated that they do this in Becker County. The Commission indicated
that in order to get a good understanding of the project, they would like to view some that
have been completed.
Bill Kalar & David Hauser informed the Commission that on May 18’" the County Board
overturned the Planning Commission’s recommendation on Pine Island Estates, Little
Pine Lake (56-142), allowing 8 lots as requested by the developers. They informed the
Commission that members of the County Board were not comfortable with the reasons
listed for the denial and it was felt that they were not specific to the lots being considered.
Adjourn: A motion by Lachowitzer, second by Boyer to adjourn at 10:15 P.M., the next
meeting is scheduled for June 9, 1999.

Jay & Melonv Taylor - Denied:
A Conditional Use Permit Application for shoreline improvements. The improvements
propose to restore the stability of the existing slope by replacing an existing and failing
wood retaining wall with a reinforced modular block wall. The proposed design will
eliminate the existing erosion forces at work and the potential attempt for a possible hill
slide should the existing wall be allowed to fail completely. With the removal of the top of
the slope and installation of the proposed reinforced walls we can eliminate the
disastrous forces currently at work, eliminate any massive erosion and provide a stable
and safe transition to the lakeshore.
The sincere intention of this design is to create a more natural and visually pleasing
shoreline site for all to enjoy. With the implementation of ornamental clump grasses and
other native plant materials we are able to provide a transition native in appearance and
which blends with the natural environment. The property is described as All Lot 36, 37 &
Lot 38 Ex the Wly 20 BIk 2 & Vac Rd Adj, Pelican Point, Section 4 of Dunn Township:
Pelican Lake (56-786), GD.
Mike Lloyd (contractor) represented the Application.
Motion: A motion by Estes, second by Trites to deny, reasons: 1. The proposal includes
too large an amount of material being removed. 2. The potential for erosion is great. 3.
The undisturbed portion of the slope is natural and stable.

I am writing to express concern on said application. While I want to do
nothing to hinder the Tranas’ ability to make a living and prosper, I am
greatly concerned that they are planning expansion when they do not have
adequate parking for the customers they currently serve. For years, our lot
which is adjacent to this one being discussed, has been encroached upon
as a parking lot, dumping ground, and urinal for customers of the next door
business. I realize the Tranas can do nothing about where their customers
park or where they choose to leave their garbage and body wastes;
however, it would be somewhat short sited not to address the parking issue
prior to expansion. If we are already being used as free parking, we can
only expect the problem to continue, and Otter Tali County can expect
continued complaints from us regarding this issue. Please note that in the
past, the Tranas have legitimately tried to solve the problem somewhat by
use of public land across Hiway 108 as a sort of a parking lot. Our lot then
becomes the path for customers who tend to, as I have already stated, use
our lot as public domain. Eventually, people get tired of walking and cars
belonging to customers of the business next door park on our lot, toss their
trash, and quite often, believe it or not, urinate in public view of our cabin
onto our lot. While the problem is a daily headache, around the fourth of
July during their street dance / keg party, it becomes near riot size. Quite
simply said, there is no street or shoulder or much more than two or three
parking slots in which to have a huge gathering. And truth be told, I feel
strongly that as a taxpayer that I should not have to provide free parking or
dump facilities for a business that wants to expand when it has not enough
legal parking spaces for current use.
I want to state again that this is not a get even tactic or a vicious attempt to
stifle a business. Perhaps there is a better way to meet the needs of both a
business that has no room to grow and a group of neighbors who is tired of
being grown over. At any rate, we need this issue to be studied as I see
many problems that need to be solved and issues explored prior to further
exacerbating what has become for us a daily, ugly issue all summer.
