DATED PROPERTY DWNER O -Ok OU. 11-02-04 Mbowman forms-apps waiver 60 day rule MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, April 5, 2007 The Otter Tail County Board of Adjustment met Thursday, April 5, 2007, with the following persons in attendance: Michael Harris Paul Larson Randall Mann Steve Schierer Rick Wilson Carl Zick David Hauser, County Attorney Bill Kalar, Land and Resource Management Mark Ronning, Land and Resource Management Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the January 4, 2007 meeting as mailed. David Hauser, County Attorney and Bill Kalar, Land and Resource Management Director- David Hauser, County Attorney, discussed with the Otter Tail County Board of Adjustment two recent legislative changes that have the potential to and/or will substantially impact the Board of Adjustment’s consideration of variance applications and the decision making process. Mr. Hauser noted that under current legislative provisions existing nonconforming structures that were legal when constructed can be repaired, replaced, maintained and improved without first obtaining a variance as long as there are no changes to the width, length or height of the structure. Mr. Hauser also noted that in the past the Board of Adjustment has granted variances contingent upon some other structure(s) being removed (tradeoff). Under current legislation this type of requirement is considered a taking and could potentially require Otter Tail County to paid compensation to the applicant(s) for the removal of the structure. Bill Kalar, Land and Resource Management Director, discussed how his office has been and will be interpreting these two significant legislative changes. Mr. Kalar provided the membership of the Otter Tail County Board of Adjustment with a document titled “Existing Non-Conforming Structure Replacement Policy - April 1, 2007". Mr. Kalar reviewed and explained the nine points listed on this document. A copy of this document has been attached to these minutes and has been incorporated as an official part of the April 5, 2007 minutes. The Board of Adjustment considered the following applications for variance: Wiimer A. Thun and Debra R, Thoennes - Denied (7:00 p.m.) Wilmer A. Thun and Debra R. Thoennes, part of Lot 10 Block 1 Leaf Lake Pleasure Grounds, West Leaf Lake in Leaf Lake Township, requested a variance of 80’ from the required ordinary high water level setback of 100’ and a variance of 30’ from the required shore impact zone setback of 50' for the purpose of removing the roof on the existing structure and for a 16’ by 22’ addition to the existing second floor. The proposed addition will match the existing 10’ by 16’ second story, but will be T higher. The audience was polled with no one speaking for or against the variance as requested.
