Legal description of tract deeded from Gary A.Eckhoff & JoAnn Eckhoff
to Herbert & Eileen Eckhoff as joint tenants is:
The Northwest Quarter of the Northeast Quarter (NW-s of NE^) and the
West 450 feet of the Northeast Quarter of the Northeast Quarter(NE^ ofNE-j)
of Section 36,Township 134,Range 38.
The County recorder will not record the deed because it is felt that the
West 450 feet of the NE-!$ of NE^ is not a description which conforms to
County recording requirements. A variance is applied for because the west
450 feet is a natural break or boundary. If additional land was included in the
deed to make a conforming description such as the West Half of the NE^ of NE^,
a field of 210 feet in width would be created which would not be economically
workable. It is felt that a conforming description such as the West Half
of the NE^ of NE^ really is saying the West 660 feet of the NE^ of the NE^ and
is no better than a description stating the West 450 feet of the NE^ of^NE^.
The approval of a variance to prevent a costly survey is requested.
