PAUL, MINNESOTA • 55155 October 2, 1974 Mr. David Hagstrom 5971 Old Central Avenue North Fridley, MN 55432 Dear Mr. Hagstrom: COMMISSIONER'S ORDER, APPLICATION 75-1035, EAST LEAF LAKE, OTTSRTAIL COUNTY, A field investigation by personnel from this department has indicated that the proposed work area supports a high quality habitat for the fish and wildlife using the East Leaf Lake area. This habitat provides a place for fish and wildlife to feed, reproduce and find cover. Any excavation in this area would impair or destroy this habitat with a re­ sultant detrimental effect on the fish and wildlife resource of this area. Furthermore, the field investigation revealed that the proposed fill site contained standing water, and that there were high water stains visible on the shoreline at an elevation higher than that of the standing water. Filling in this area could be considered as filling below the natural ordinary high water level of East Leaf Lake. Also, a conditional use permit would be required from Ottertail County for filling in this area. Minnesota Statutes, 1973, Chapter 105, quotes in part as follows: "In all permit applications, the applicant has the biirden of proving that the proposed project is reasonable, practical, and will adequately pro­ tect public safety and promote the public welfare." In view of our observations, we cannot conclude that your proposal is indeed reasonable, practical, or that it will promote the public v/elfare; therefore, the application is in all respects denied.
