The Kreisers were represented by Mike Rengel, Attorney. After consideration, motion was made by John Everts to deny, no ade­quate hardship shown. The motion was seconded by Craig Anderson but failed with Oehler, Johnson, Walter and Petterson voting "no”. Motion was then made by Carl Johnson to table until April. Motion failed for lack of a second. Motion was then made by Craig Anderson, to deny side lot variance. The motion was seconded by Victor Petterson and carried unanimously. Motion was made by Daniel Oehler to grant the variance to build ISO* from lake, attaching structure to be no closer to lake than existing building. The motion was seconded by Carl Johnson but failed with Everts, Petterson and Walter voting "no". Motion was made by Carl JOhnson, seconded by George Walter and unani­ mously carried, to table action on lake set back variance request until the April meeting to allow the board members a chance to view the property. Frank E. Tucker, Arcath, California, requested permission to construct second dwelling on lot for guest house, on the E 200' of W 22 1/3 rds of S 16 rds of G.L. 2, Section 20, Girard Township on West Battle Lake. Tucker was represented by Ronald Stabow. After consideration, motion was made by Victor Petterson, seconded by Daniel Oehler to deny, no adequato^hardship shown. Richard Lyden, Pelican Rapids, MN, requested permission to construct an addition to existing dwelling, 50' from ordinary high water mark, on property in G.L. 1, Section 29, Lida Township on Lake Lida. After consideration, motion was made by John Everts, seconded by Craig Ander­ son and unanimously carried, to deny, no adequate hardship shown, with a viable alternative to build onto the north side of cabin. Kim M. Anderson, Windom, MN, requested permission to place an 8' x 10' storage shed on cement slab next to the 6' fence on north line of Lot 5, Section 21, Leaf Lake Township, West Leaf Lake. At the re­ quest ef the applicant who was unable to be in attendance, motion was made by Daniel Oehler, seconded by Victor Petterson and unanimously carried, to table until the April meeting. Gary Gutzmer, Hawkinson, ND, requested permission to remove a rotting section of building, replacing with a 22' x 24' addition, 4' closer to lake, on the Ely 400' of G.L. 1, North Shore Clitherall Lake, in Section 11, Clitherall Township. After consideration, motion was made by John Everts to approve addition, encroaching no closer than 2' towards the lake than existing structure, hardship being unique shape of property and the fact there is no precedence being set in the area, because of the length of the property is ho conflict with any other building site. The motion was seconded by Craig Anderson and carried unanimously. Mike Valentine, Tergus Falls, MN, tabled from the December meeting, was brought up for final action. After consideration, motion was made by John Everts to grant approval to construct garage in same location as original structure, on the condition, the entire garage, walls and ceiling, be lined with 5/8" fire code sheet rock, or 26 guage steel, hardship being no other spot on lot to construct garage. The Marianne Divine request, tabled from the December 7th meeting, was again tabled upon motion made by Daniel Oehler, seconded by John Everts and unanimously carried. I thought it might be beneficial for you to know that I will be represented by my father, Ken Anderson at the hearing. In addition, I was interested to find out what the law is concerning a fence built on a property line. I have a copy of the Shoreland Mgmt. Ordinance of Otter Tail County and can find no reference to a fence. Does the building of a fence require a variance, or can any type of fence be built along a property line? If there is a rule governing the construction of a fence what is that rule and when was it enacted? I realize this is short notice, but I would appreciate hearing from you prior to the May 3 meeting. Dear Mr. Anderson: From your letter of April 27, 1990, it is my understanding that you have a copy of the Shoreland Management Ordinance of Otter Tail County. Since this is the case, I direct your attention to Sec.I.4. As you will see, the aforementioned Section pertains to vision obstructing fences which are the only type of fence we regulate. As per this Section, a vision obstructing fence must comply with the same setback requirements <Sec.III.4.a.) as any other structure located in the Shoreland Area. This particular regulation however changed on April 1, Commissioners. has been in effect since May 8, 1981. It was, 1990 by the Otter Tail County Board of Enclosed please find a document entitled Amendments to the Shoreland Management Ordinance of Otter Tail County. Item number 10 deals with vision obstructing fences which are, once again the only type of fence regulated by Otter Tail County. Dear Mr. Anderson: On May 3, 1990, the Otter Tall County Board ol Adjustment heard your request to leave your 8' X 12' storage shed next to your neighbor's (Estelle Amundson) vision obstructing fence. At that time, the Board ol Adjustment denied your request. They did, however, permit you to keep your storage shed in it's present location until such time as Ms. Amundson's fence was brought into compllanae with the provisions ol the Shoreland Management Ordinance ol Otter Tall County. I have contacted Ms. Amundson regarding this natter. As office was supplied with documentation which suggests constructed In 1980. a result, our this fence was The portion of the Shoreland Management Office which addresses vision obstructing fences was not established until May 8, 1981. We will, therefore consider this fence as being "grandfathered In*. This means that this fence will not have to be altered at this tine (should we find evidence that this fence was constructed after May 8, 1981, our position may change).
