Conditional Use Permit - Bryan & Patti Smith:
Motion by Lee, second by Mosher, and unanimously carried to deny, as recommended by the
Planning Commission, a Conditional Use Permit to replace old steep, wood steps and
landings for the reasons as stated in the Planning Commission minutes of
September 22, 2005. The property is described as PT GL 8 (1.30 AC), Section 3 of Dora
Township: Loon Lake (56-523).
Conditional Use Permit - Scambier Township:
Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to rebuild a road with conditions as recommended by the Planning Commission. The
property is described as 470*^ Street starting at 30’ E of 17021 470^*^ Street to 580’ E of 17021
470^*^ Street, Pt of GL 6 & tr in SW cor SW% & Lot 4 & NE% ex tr, GL 5 ex tr. Section 29 and

impact on the iake, and expressed concerns regarding iake access.
Motion: A motion by Trites, second by Schwartz to deny, reasons being: 1. The road in
this location creates an erosion potential (into the lake). 2. The Applicant would increase
access to a development that is not appropriate for this area and it creates the potential for
a negetative environmental impact. Voting: All Members in favor.
Dennis Greenwaldt - Approved With A Condition:
A Conditional Use Permit Application (as stated by the Applicant): To upgrade an existing 66
foot ingress & egress easement road. The road will be constructed and upgraded to the
Minimum Road Standards of Appendix 3 of the Otter Tail County Subdivision Ordinance.
The reason for the request is Leaf Lake Township will be taking over the road and
maintaining for public use. Work to be done this fall. The property is described as Pt of GL
4 & pt of GL 2 , Section 20 of Leaf Lake Township; West Leaf Lake (56-114), RD.

Royces Resort / Richard & Priscilla Steqman - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): We would like to reclassify
the resort status to condo status; there would be no additional units. This would greatly
reduce the use of the lake from the resort as we have a 99% occupancy rate. There would
be far less people in each cabin and mostly on weekends. Also we would negotiate the
removal of some buildings near the property lines and possibly 1 driveway. 6 Units total -
Units #1, 2, 3, 4 & 5 are seasonal; Unit #6 is year around usage. The property is described
as Lots 1, 2 & 3 Birch Dale Resort, Section 10 & tr 25’ N & S & 217’ E & W N of adjoining
Lot 1 Birchdale Resort, Section 3 in Hobart Township; Wimer Lake (56-355), RD.
Richard Stegman represented the Application.
Motion: A motion by Schwartz, second by Estes to approve with conditions: 1. Removal
of the garage as indicated on the drawing. 2. Removal of the fish cleaning house as
indicated on the drawing. 3. Removal and sodding of a driveway. 4. One centralized
docking/swimming area is allowed; may retain the small dock near the boat launching area
for safety reasons (only available for boat launching). Voting: All Members in favor.
Bryan & Patti Smith - Denied:
A Conditional Use Permit Application (as stated by the Applicant): The purpose of our project is
to provide a safe series of steps and landings down to the lake. We want to replace the old
steep wood steps and landings with a permanent series of steps. By terracing the hillside
we will cut down the amount of storm water runoff to the lake and reduce erosion to the
hillside and beach. After the project is complete we will plant native plantings in the
terraced planting beds and improve the look of the shoreline. Approx 30 yds of topsoil will
be needed to provide good soil for the planting beds. We would like to start this project
end of Sept, early Oct. to be finished Nov. 1®‘. We feel with proper sodding and erosion
control in place we should not have any problems with the spring thaw/rain. The property
is described as Pt GL 8 (1.30 AC), Section 3 of Dora Township; Loon Lake (56-523) RD.
Bryan Smith and Richard Lahren (Strata Contractors) represented the Application.
Lowell Satterlle (Loon Lake Association) expressed concerns regarding the late starting
date (stabilization) and placing black dirt close to the water.

U Completion and submittal of the TIPCA application for
General Storm-uiater Permit for Construction Activity ('flu
RiOCXX)U is required prior to beginning any road
construction related activities on this project.
2) Design and implementation of a storm-water pollution
prevention plan CSHPPPJ is recgjired priix~ to beginning any
road construction relctted activities on this project.
3) Items addressed in the SNPPP shall include, but not be
limited to, the following:
4) Construction activities will be scheduled in such a
manner as to minimize the site area disturbed and exposed at
any one time.
5) Construction contractors must minimize soil erosion by
mulching, seeding and replanting or implementing erosion and
sedimentation control.
(>) Proper erosion control measures, such as silt fences,
rock dams, bale logs and inlet end outlet controls luith
velocity checks should be installed and monitored
periodically, to ensure that they are effective and In good
repair.
7) Soils disturbed by construction should be reseeded and
mulched promptly, preferably with a mixture of native
grasses and fortn. Erosion control measures should remain in
place until revegetated areas have recovered.
5J No storm water runoff, as a result of construction,
shall be allowed to enter any wetlands or lake without first
passing through sedimentation control devices to minimize
soil particles from entering these bodies of water.
If permanent wet sedimentation basins and/or regional
ponding is necessary, the size and location of these
features will be communicated to the surveyor prior to their
construction; to ensure that lot size reegjirements have not
been compromised.
lOj Groundwater contamination will be avoided through
proper handling and storage of petroleum products,
chemicals, hazardous materials and construction items during
the construction phase.
