Richard Kellogg - Tabled Richard Kellogg, Frazee, MN, requested a variance to subdivide an existing 3.2-acre parcel into three metes and bounds descriptions. Lots 1 and 2 will have 23,400 square feet of area and Lot 3 will have 47,700 square feet of area. It should be noted that all three lots will have easement rights for access, an existing mobile home will be removed and the existing camping site will be terminated. Platted lots on a recreational development lake require 150’ of water frontage and 40,000 square feet of area. The property is described as a 3.2-acre tract in Government Lot 6, Section 27 of Hobart Township by Long Lake. He stated that he plans to construct a new sewer system on Dan and Joyce Peterson’s property on West Leaf Lake. Mr. Weller stated that he has applied for a variance through your Board to construct a sewage drainfield less than the required distance from a building. Your Board tabled this application awaiting a response from me. I am currently employed by the Mirmesota Department of Health in the Well Management Section. Our Section is responsible for the enforcement of Minnesota Statutes, Chapter 1031 and Minnesota Rules, Chapter 4725 (Well Construction Code). We do get involved from time to time with the placement of on-site sewage treatment systems when they are constructed at a location which either does not meet the requirements of Mirmesota Rules, Chapter 4725, or has the potential to impact a water-supply well. Our Section does not have authority to regulate the placement of sewage systems in relation to any other item, such as buildings, lakes, property lines. Thus, I am in no position of authority to comment on the placement of a sewage drainfield at a distance less than what is required by the applicable rule or ordinance. If you have additional questions about this, you should contact Otter Tail County Land and Resource Management or the Mirmesota Pollution Control Agency. If you have other questions which pertain to the placement of a sewage treatment system in relation to a well please contact me at 218/739-7585. Roger Johnson - Withdrawn Roger Johnson, Battle Lake, MN, requested a variance “to add a 10’ by 16’ deck with a screened in porch to the front of our home. We request that the deck could be located 33’ off the center of lot to the west. The porch would have a hip roof to meet the requirements of height for this structure.’’ The required side lot line setback for a water - oriented accessory structure is 65’. The property is described as the East 60’ of Lot 11 and the West 70’ of Lot 12, E-L-M Dale Beach, Clitherall Lake in Clitherall Township. Randall Mann informed the Board that he would be abstaining from any action on this request as he owns property that is adjacent to Mr. Johnson’s property. After discussion and consideration the applicant informed the Board of Adjustment of his desire to withdraw his request. The Board of Adjustment acknowledges the applicant’s request and authorized a partial refund of the applicant’s application fee. Scott and Jamie Stenseth - Approved Scott and Jamie Stenseth, Fargo, ND, requested a variance “to build one story above a pre­ existing sub-basement that had been built into a bluff. The project would be to build this “ground-level” story the exact dimensions of the basement, and would involve no new excavation or alteration of the bluff. The existing basement has a flat roof - consequently water runoff down the face of the bluff is poor. One benefit to the proposed project would be improved water runoff through attached gutters to pre-existing “on property” concrete gutters to the lake. The variance would allow the upper structure to be 53’ from the lake. Also, I am requesting a variance to replace an existing 8’ by 26’ concrete slab (used as a deck) on the “lake side” of the existing basemen structure. The slab is slowly moving away from the basement foundation and down the face of the bluff. My request is to be able to remove the slab to prevent future damage to the bluff. I would then stabilize the surface under the slab and replace the 8’ by 26’ slab with a “same - size" wooden deck on posts. The variance would allow me to replace the deck in the bluff approx. 45’ from the lake.” The required ordinary high water level setback is 75’ and the required top of bluff setback is 30’. The property is described as Sub Lot 5 of Government Lot 1, Section 26 of Lida Township by Lake Lida. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by John Everts and carried with Cecil Femling and Dick Sha voting no, to allow the second story addition over the existing basement with the condition that before a site permit for the addition can be issued the existing boat house must be removed with the exception of the slab, which can be covered with a platform deck.
