Motion
Motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve a variance to
subdivide a 2.58-acre parcel from and existing 57.92-acre parcel with the condition that a registered surveyor’s
drawing must be presented at the time of conveyance. It was noted that the proposed subdivision separates the
dwelling site from the balance of the farmland and other out buildings and that all buildings will be at least 10’ from the
lot lines. It was noted that the 2.58-acre parcel has access to a public road and has adequate room for two on-site
septic systems. •; - '

RE: Special Variance Request.
Roy A. Smith, Surveyor, has submitted a special request for consideration by the Otter
Tail County Board of Adjustment. Enclosed you will find a letter of explanation and a
registered surveyor’s drawing concerning his request.
Mr. Smith on behalf of Noel and Jan Schroeder, sellers and Derek Christenson, buyer,
has submitted this special request because of the possibility that the Otter Tail County
Board of Adjustment may not be scheduled to meet again until late March or early April
of 1998.
At the present time I have received four applications for our first scheduled meeting of
1998. This includes a variance application for this special request that you are now
being asked to consider.
The Subdivision Controls Ordinance does not contain provisions for the special
consideration of a variance request. I offered a couple of different options to Mr. Smith
and this is the option that has been chosen. Special consideration may not be
necessary or needed should the Board decided to hold a meeting on Thursday, January
8, 1998. Special consideration might not be appropriate since there is no specific
authorization to grant a variance in advance of the formal hearing process. Special
consideration also might not be appropriate since there are presently three other
applicants that have submitted an application for the first variance meeting of 1998 who
would perhaps like the same consideration as being requested by Mr. Smith.
In summary, Mr. Smith is requesting that the Otter Tail County Board of Adjustment
authorize the County Auditor’s office to accept for recording, prior to the holding of a
formal variance hearing, a document conveying a parcel of less than 5 acres. Should
the Otter Tail County Board of Adjustment grant his request then the variance
application would be scheduled for and formally acted upon at the first scheduled
meeting of 1998. I believe Mr. Smith has requested this special consideration because
he feels this is a reasonable request, which the Otter Tail County Board of Adjustment
would approve at their first scheduled meeting in 1998. Therefore, if special
consideration is granted his clients will be able to complete their transaction in 1997.

Dear Board Members:
I am writing on behalf of Noel and Jan Schroeder,
sellers, and Derek Christenson, buyer, of a 2.58 acre tract
of land located in the Northwest Quarter of the Southwest
Quarter of Section 20 of Leaf Lake Township. This summer the
Schroeders ourchased 57.92 acres of land in Section 20.
^art of the acreage included a farmstead. I surveyed their
acouisition and the 2.58 acre tract they are selling. The
2.58 ac>"e tract of land is a part of the farmstead. It
contains a house and a small out building. It has adequate
road access since it fronts on County State Aid Highway No.
61 and adequate area for 2 septic systems. The remaining
farm buidings including barns, quonset, sheds and garage
will be retained by the Schroeders with the 55.34
agricultural acres. The 2.58 acre tract is located within
1000 feet of Grass Lake which lies to the west across County
State Aid Highway No. 61. Since the ti^act is under 5.00
acres we are seeking a va**iance. We have missed the cutoff
date for the December meeting. The Schroeders have made the
necessary application for the variance and I have submitted
six copies of the survey showing the tract. The buyer,
seller and lender are desirous of having the documents
recorded before the 1st of the year. Since there is a
possibilty of no meetings in the first months of 1998 timing
is a problem. I have consulted with Auditor Wayne Stein
outlining our problem. Wayne has been very helpful in
seeking a solution. Please consider granting the Auditors
Office authorization to accept the deeds for this tract
after reviewal of the variance application. The enclosed
application could then be acted on at the first available
meeting.

Robert J. and Cheryl K. Sefkow - Tabled
Robert J. and Cheryl K. Sefkow, Fergus Falls, MN, requested a variance to “install holding tank to
replace nonconforming cesspool. The proposed location of the holding tank is merely a proposal. We
will locate the holding tank wherever permitted by the Board of Adjustment. The tank’s location is not
important to us. We simply want permission to locate it somewhere on the lot to eliminate the existing
cesspool altogether.” A sketch of the applicants’ proposed plan is on file with the County Auditor’s
office. The property is described as Lot 10, Parkdale Beach, Swan Lake in Dane Prairie Township.
The audience was polled with no one speaking for or against the request. After consideration, motion
was made by Craig Anderson, seconded by John Everts and unanimously carried, to table the
applicants’ request until the next schedule meeting so that the applicants have an opportunity to review
the information contained within the Land and Resource file.
LeRoy and Lorraine Tuffs - Approved
LeRoy and Lorraine Tuffs, Deer Creek, MN, requested a variance of 10’ from the required 20’ road
right-of-way setback to the north, a variance of 13’ from the required 20’ road right-of-way setback to
the west and a variance of 4’ from the required holding tank setback of 10’ for the placement of a 28’ by
38’ garage 10’ from the road right-of-way to the north, 7' from the road right-of-way to the west and 6’
from the holding tank. The property is described as Lots 1 and 2, Oak Grove Beach, Rush Lake in
Rush Lake Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously
carried, to approve a variance of 4’ from the required 10’ septic tank setback and a variance of 8’ from
the required road right-of-way setback of 20’ for the construction of a 28’ by 38’ garage 6’ from the
septic tank and 8’ from the road right-of-way at the Northwest corner of the proposed garage. It was
noted that the garage is 8' from the road right-of-way at the closest point and that the setback distance
is approximately 25’ at the Southwest corner of the garage. It was noted that adequate room would
exist for the maintenance of the septic system if the garage were placed 6’ from the septic tank.
Hardship is the biased lot line and the existence of a road on both the north and west side of the
applicant’s property.
