from the 18’ maximum height of a non-dwelling structure for the construction of a grain bin having a height of 30’. It
was noted that the proposed structure will not restrict the view of the adjacent landowners, that it is not a dwelling and
it purpose is for an agricultural related activity.

Quarter and part of the Northeast Quarter of the Southeast Quarter, Section 20 of Leaf Lake Township \
by West Leaf Lake. The audience was polled with no one speaking for or against the request. After ■'
consideration, motion was made by John Everts, seconded by Linda Bergerud and unanimously
carried, to approve a variance of 12’ from the 18’ maximum height of a non-dwelling structure for the
construction of a grain bin having a height of 30’. It was noted that the proposed structure will not
restrict the view of the adjacent landowners, that it is not a dwelling and it purpose is for an agricultural

Philip Douglas - Approved
Philip M. Douglas, Erhard, MN, requested a variance of 50’ from the required ordinary high water level
setback of 200’ for the location of a building site 150’ from the ordinary high water level. The property is
described as the North Half of the Southwest Quarter of the Southwest Quarter and part of Government
Lot 7, Section 2 of Friberg Township by an unnamed lake. The audience was polled with Joe
Michnowski addressing concerns with a private easement on the applicant’s property. After
consideration, motion was made by Randall Mann, seconded by Linda Bergerud and unanimously
carried, to approve a variance of 20’ from the required ordinary high water level setback of 200’ for the
location of a building site 180’ from the ordinary high water level with the condition that if a bluff exist
the 30’ setback from the top of the bluff must be complied with and with the condition that all public road
and private easement road setback requirements must also be met. Hardship is the terrain features of
the applicant’s property.
Damian and Carol Ludwig - Approved
Damian and Carol Ludwig, Grand Forks, ND, requested a variance of 20’ from the required road right-
of-way setback of 20’ for the placement of a 24’ by 32’ garage 0’ from the road right-of-way, a variance
of 10’ from the required lot line setback of 10’ for the placement of a septic tank within the 10’ setback
area and a variance of 35’ from the required ordinary high water level setback of 100’ for the placement
of 12’ by 18’ screened porch approximately 65’ from the ordinary high water level (lake). The property
is described as Lot 1, East Shore, Tamarack Lake in Scambler Township. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, seconded by John Everts and unanimously carried, to allow the proposed construction
between the string lines established from house to house and from garage to garage with the condition
that no portion of the construction can be in the road right-of-way or outside of the back lot line and to
approve the location of the proposed septic tank so long as a 10’ separation is maintained from the
proposed structures. Hardship is a grossly substandard lot of record. It was noted that the granting of
this variance would not establish precedence for this immediate area.

MOTION AS FOLLOWS:
Motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to
approve a variance of 5' from the 18' maximum height requirement of a non-dwelling
structure for the construction of a 40' by 48' pole barn having a height of 23 . It was
noted that this structure will become part of an existing farmstead that has other
structures closer to the ordinary high water level than the proposed structure.
