The Canvassing Board will meet on Monday, November 9, 1998 at 10:00 a.m. 0 Audit Committee Appointed Chairman Lee appointed Auditor, Wayne Stein, Accountant, Mitzi Pederson, and Accountant, Leon Anderson to work with the County Coordinator and Public Health Director to audit the Collaborative program. Budget Committee Report Commissioner Lindquist reported that the Budget Committee has reduced the budget by $400,000. He reported that the courthouse remodeling and jail remodeling is within the estimated budget. Mr. Lindquist stated that the Budget Committee is continuing to work to cut the overall county budget. Planning Commission Recommendations Conditional Use Permit - Larrv & Deb Otto: Commissioner Lindquist questioned how erosion control will be accomplished during construction of a stainA/ay and expressed a concern because of sandy soil in the area. He also questioned whether or not a decision on this CUP would set a precedent for future requests. Bill Kalar, Land & Resource Director, stated that as far as stabilization is concerned, the area is to be sodded on both sides with a silt fence installed as a temporary measure during construction. Commissioner Portmann expressed concern and requested that the Land & Resource Director view the property before action is taken. The Chairman stated that this CUP request would be deferred until next week’s regular board meeting after Mr. Kalar has had an opportunity to view the property. Preliminary Plat - “Second Addition to Sunrise Cove” Arthur S. Peterson et al: Motion by Lindquist, second by Portmann, and unanimously carried to approve the preliminary plat of “Second Addition to Sunrise Cove” consisting of 5 residential lots (Sec. 23, Clitherall Twp., Clitherall Lake 56-238) with conditions as recommended by the Planning Commission. Preliminary Plat - Jeff Kilde/ "K & K Beach”: The Land & Resource Director reported that this plat had been modified and now consists of two residential lots with the buildable area outside of the wetland area. Lengthy discussion followed regarding condition No. 3 of the Planning Commission recommendations that reads “No variances are to be granted on these lots”. Motion by Lee, second by Lindquist, and unanimously carried to approve the preliminary plat of “K & K Beach” consisting of two residential lots (Sec. 33 of Aurdal Twp., Wall Lake - 56-658) with conditions as recommended by the Planning Commission. The provision of recommendation No. 3 (no variances being granted on the property) serves as notice to the public. Conditional Use Permit - Brian Fronnina: Motion by Lindquist, second by Portmann, and unanimously carried to approve a Conditional Use Permit to help with a drainage problem and stop erosion (Sec. 22, Twp. 132N, R. 43W, Buse Twp, Horseshoe Lake, 56-834) with conditions as recommended by the Planning Commission. Ine. - Tabled to Novemher 4. 1998; A Conditional Use Permit Application to pull off sod and topsoil off 120' of shoreline on the east end of property - sod and topsoil removed would start near existing sidewalk and slope 3' down to 1998 high water mark 12' away. This is 150' from property line - on west end we wish to do the same for 100'. The bank is 2' high and would slope back for 10'. REASON: 1. No beach at all for most of 1998. A judge issued permission for Cormorant Lake to dump its excess water into Pelican Lake. We had a lot of sod and black dirt pulled into the lake by waves this past year. Having sand instead of sod will prevent this. 2. We have rocks along a lot of shoreline, but need some area to pull up paddle boats, kayaks, sailboats, rowboats and for small children's play. While onsite it was determined that the Planning Commission has 2 issues to consider while reviewing Mr. Fronning's proposal: In order to fill the crossing area (Terry Lejcher, DNR, has approved this), the project involves excavation of 244 cubic yards all being in the shore impact zone. In order to fill the existing ditch and excavate a new ditch, a culvert must be placed in the bottom, then covered. involve a wetland under jurisdiction. 1. 2 . Fronning RR l,Box 141 Dalton, MN 56324 Dear Mr. Fronning: PROJECT NOTIFICATION, DNR PROTECTED WATERS PERMIT REQUIREMENTS, OTTER TAIL COLTITY The Department of Natural Resources (DNR) is in receipt of your project notification form for filling to make access to property located in Section 22 of Buse Township, Otter Tail County. Based on my review of the information you sent me, I have determined the following; The project does not require a DNR Protected Waters Permit as long as the fill is placed above the stakes placed at the site by Area Hydrologist Terry Lejcher on August 24, 1998. Please be advised that you must obtain all required authorizations (local, state and federal) before beginning work. A DNR Protected Waters Permit application is required. Complete the enclosed application form and mail it to the DNR Regional Office in Bemidji at 2115 Birchmont Beach Road NE, Bemidji, MN 56601. Be sure to enclose the correct application fee. No permit can be processed until all application fees have been paid. □ Please be advised that any work in DNR protected waters or wetlands without a permit is a misdemeanor and is punishable by fines up to $700 and/or 90 days in jail. Thank you for your cooperation. If you have any questions, please contact me at 1221 Fir Avenue East, Fergus Falls, MN 56537 or by telephone at 218-739-7576. Dirt work requirement will be about 3600 cubic yards. The top of the driveway is to be 16 feet wide at a length of 850'. I ask for a time extension until 12/1/96. Possible sewer locations are shown as: 2. 3.The building setbacks shown are: Township Road - 20 feet, side lot -50 feet, and lake - 200 feet. 4. Contour lines are shown at 10 foot intervals based on the uses Quadrangle Mop. These lines are based on the N.G.V.D. 1929 Datum.\ 5. Drainage patterns will only be altered slightly from the existing contours. This will be due to house construction and yard landscaping. 6. The total proposed plat area is 122± Acres with 77± Acres useable. 7. A common docking area is proposed with 4 boat slips and 1 day dock adjacent to the proposed boat launch. A walking path is to be built so unit owners can access the Community Building without the need to drive vehicles. The paths will be built using wood chips and timbers and will meander so large trees will not be removed.
