Jan 17, 1989Dated 1 Justification for Variance Request Restructure Building Area 1)Present setback requirements on this peninsula shaped lot allow for only a narrow building area even though the lot equals over 12 acres in size. Therefore, a residential home is restricted from a view of the river and the distance to the riverbank slope prevents a walkout type construction. Please refer to the aerial photo. The marketability of this lot would be reduced since one camot take advantage of the amenities the lot has to offer. The request for variance would only apply to the South setback line therefore the Northern setback line would remain set at 200 feet. 2)Flood Area Not a Risk The 200 foot setback was placed on this area because of the Dayton Hollow Daittt lake area. The North ^ of Section 7 has 35-45 foot embankments which would seem to justify a variance from normal river setbacks since it is not in the lake area as compared to the South j of Section 7. River Oaks just to the North enjoys similar river widths and embankments and has 75 foot setback rules. Normal river setbacks are 75 feet. 3)New DNR Proposed Rules The DNR has proposed reducing these setbacks to 150 feet already and implementation is expected in 1989. However, our expectations to begin construction would be targeted for April-May 1989. 4)Summary of Variance Request a)The first choice of the applicant would be if the Board would grant a 75 foot variance. b)The second choice of the applicant would be the Board's decision to grant a 50 foot variance.
