Restoration Order
The Commissioner of Natural Resources hereby orders Gary Wayne Anderson and his/hers/its
heirs, successors, and assigns to complete restoration of die wetland located at (legal description) T-132
R43 W Sec 6 Buse TWP, part of Govt. Lot 6 (by Kenneth Kolle); West Otter Tail County
State of Minnesota.

Findings of Fact: Since the last TEP site visit in 2004 fill material was placed in wetland. Fill material
consisted of wood chips, woody vegetation, miscellaneous wood products, and clay fill. Area also
consisted of excavated ditches, and the placement of drain tile.
This order is issued pursuant to Mirin. StaL § 103G.2372 and MN Rule part 8420.0290.
VIOLATION OF TfflS ORDER IS A MISDEMEANOR
AND A DEED RESTRICTION COULD BE PLACED ON THE PROPERTY.
You must either:
A. Provide for restoration of the wetland in the manner required by this order. Complete restoration
must be accomplished on or before 11/1/2008: or
B. Submit a complete wetland replacement plan, exemption, or no-loss ^plication to die LGU. Otter
Tail County Land and Resource , within 30 days of receipt of this.ofder.
Restoration shall be accomplished by doing the following: Remove all Cll, which consists of: wood
chips, woody vegetation, miscellaneous wood products, and clay fill. All fill placed after the 2004
TEP site visit must be removed. All ditches must be filled in to natural grade, and tile must be
removed. Proper erosion control measures must be taken to avoid any wetland/ river impacts.
Prior to commencing work you must contact Brad Mergens at West Otter Tail SWCD, or Kyle
Westergard at Otter Tail County Land and Resource.

The enforcement authority shall rescind this order if the landowner obtains approval for an aftethe-fact
replacement plan, exemption determination, or neloss determination from theLGU. Contact person is
Kyle Westei^ard at (218)998-8102. If an after-the-fact approval is not received, the
landowner/responsible party must restore the wetland as specified in this order. Upon completion of the
restoration required by this order, the landowner shall ontact Brad Mergensat the West Otter Tail County
Soil and Water Coiiservation District ^18)739-1308 and request that a Certificate of Satisfactory
Completion be issued. The Soil and WatebConservaion District can only certify the restoration when the
functions and values are restored within the wetland.
If you choose to appeal the terms or conditions of this order, a written request must be submitted to the
Minnesota Board of Water and SoilResources (BWSR) Executive Director within 30 days of receiving
this order, along with a minimum filing fee of $200. If this wTitten request is not submitted to BWSR
within 30 days, this restoiatioh order shall become final.
