(6:50 p.m.) Paul Tenney and Lori Hoffman, Lots 15 and 16 Pulford’s Beach, Walker Lake in Amor Township, requested the following: Varies from impervious surface ratio requirement of 25%. Proposed project reduces impervious surface ration from 30.76% to 30.10% and eliminates a detached structure that violates lot line setback requirement of 10’. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Thomas Lee and unanimously carried, to approve the variance as requested in the application dated August 17, 2012 and as depicted on the drawing submitted with the application, which is dated July 29, 2012. The applicant's proposal will bring the property more into compliance with the requirements of the ordinance (reduces impervious surface coverage and meets required side lot line setback). Tyler E Riley - Approved the variance application as requested. (6:54 p.m.) Tyler E. Riley, Lot 7 Block 1 Deer Trail Estates, Star Lake in Star Lake Township, requested the following: Proposing to add an addition to existing cabin and put an entire new roof on the existing structure and the addition. The proposed addition to existing structure meets the required setback. The roof on the existing structure is 65' from ordinary high water level. Requesting a 15’ variance from ordinary high water level to put new roof on the existing structure. The structure will be no closer to the lake than the existing structure. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Thomas Lee made a motion, second by Michael Harris and unanimously carried to approve the variance as requested for the development as described in the variance application dated September 5, 2012 and as depicted on the drawing submitted with the application. The proposed development will be no closer to the ordinary high water level than the existing structure, will not obstruct the view from the adjacent properties and will be an improvement to the applicant’s property. Russell and Mary Baldwin - Approved the variance application as modified. (6:58 p.m.) Russell and Mary Baldwin, Lot 1 Block 1 Dahike Addition, Dead Lake in Star Lake Township, requested the following: We want to go from a 14' by 70’ to a 16’ by 80’ trailer. This will be 2’ closer to the lake shore. So 2’ longer from the old trailer site. This would be on the same spot as the old trailer is now. This would be 45’ from the high water level mark. Back patio/porch must stay 4’ from property line because of cement slab. Requesting setbacks due to substandard lot of record. Lot created July 22, 1970. The audience was with the adjacent property owner speaking for the variance as requested and noting that the applicants’ proposal will not obstruct their view. After consideration and discussion, Steve Schierer made a motion, second by Kenneth Erickson and unanimously carried, to approve the placement of a 16’ by 80’ mobile home 45’ from the ordinary high water level, as depicted on the drawing submitted with the variance application, and to approve the placement of the existing 10’ by 10’ porch, as depicted on the drawing submitted with the variance application at least 5’ from the side lot line. It should be noted that the applicants do have adequate room to place the existing porch at least 5’ from the side lot line. It should also be noted that the proposed trailer cannot be placed any closer to the side lot line than depicted on the drawing submitted with the variance application; therefore, either the existing porch will need to be reduced in size or the proposed 16’ by 80’ trailer will need to be shifted towards the center of the lot. Greg Remer - Approve the variance application as requested. (7:08 p.m.) Greg Remer, part of the Southeast Quarter of the Northeast Quarter, Section 33 of Otter Tail Township by Sherman Lake, requested the following: the lake was reclassified, which created a substandard lot. Variance for buildable lot, residential use. With 150’ setback from lake for future construction. Reclassified from GD to NE. The audience was polled with no one speaking for or against the variance as requested. Emails from Kevin Mold and Paul Hartmann in support of the variance as requested was read for the record. After consideration and discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback of 200’ for the location of a future construction site 150’ from the ordinary high water level. The variance as approved does not directly or indirectly grant any other variance for the proposed future construction. The hardship/practical difficulty is the change in the ordinance requirement. The variance as approved will provide the applicant with the ability to enjoy the same rights and privileges as others in this immediate area.
