Signature Of ApplicantqjFHPcLe.c4 \jThi CPu JtL^uJ (jeori 1 13 19_23 .X VApplication dated e-Date of hearing: ____ MOTION AS FOLLOWS: Time:M Motion was made by John Everts, seconded by Bert Olson and carried with Craig Anderson abstaining, to approve a variance from the top of a bluff and from the bluff impact zone for the construction of a 28' by 55' structure, with an attached 10' by 55' deck, setback 103' from the ordinary high water level with the condition that there will be no excavation in the bluff impact zone and the structure will not have a walkout basement. There should not be a drainage problem as the terrain slopes away from the crest of the hill towards the west away from the lake. The applicant's building plan does not call for a dwelling with a walkout basement. The granting of this variance request allows the potential buyers to enjoy the same rights and privileges as neighboring property owners. After much di^ussion and consideration, motion was made by Cecil Femling. seconded by John Everts and carried with Craig Anderson abstaining, to clarify that the approval of the Halbakken variance appliration was to approve a setback of 103' from the ordinary high water mark or at a building setback from the ordinary high water mark at the point at which the terrain begins to slope towards the back of the lot away from the lake. In making their decision the Board to)k into consideration that the potential buyers of the applicant's property presented a plan that did not rail for the construction of a walkout basement and the variance allows the potential buyers to enjoy the same rights and privileges as the neighbors. It was the Board’s understanding that the 103' setback was the point at which the terrain begins to slope away from the lake.
