After consideration and discussion, Paul Larson made a motion, second by Michael Conlon and unanimously carried,
to approve a variance of 64’ from the required ordinary high water level setback of 200’ for the location of a building
site 136’ from the ordinary high water level with the condition that no other variances can be granted for development
of this lot. Although this is a fairly new plat and this lot should have a building site at the 200’ setback the Board did
note terrain and water features unique to this specific lot within this plat which cause development at the 200’ setback
to be less than desirable and perhaps even impossible as their reason for granting the variance as requested. The
variance as granted should provide th^ppHeant with a reasonable use of his property and should not establish precedence for other lots within thiS'de^lopmant as there are terrain features which are unique to this lot. The
variance as appi^e^stabli^h€^^ilding^e location and does not address the size of the structure.

Charles Cheney, Jay Kleingartner and Mick Foss (representing Duane Brandt) represented the applicant at
the public hearing. The audience was polled with no one speaking for or against the variance as
requested. After consideration and discussion, Steve Schierer made a motion, second by Paul Larson and
unanimously carried, to approve the variance as described in the variance application and as depicted on
the drawing submitted with the variance application with the condition that the back lot conveyances
described in the application must be permanently attached to the front lots and with the condition that the
area contained within the back lots cannot be used when determining impervious surface coverage for front
lot development.

Brian Saeger, Lot 3 Block 1 North Ten Mile Estates, North Ten Mile Lake in Tumuli Township, requested a
variance of 64’ from the required ordinary high water level setback of 200' for the location of a building site
136’ from the ordinary high water level. The audience was polled Don Moebius requesting that the required
setback be maintained. After consideration and discussion, Paul Larson made a motion, second by
Michael Conlon and unanimously carried, to approve a variance of 64’ from the required ordinary high
water level setback of 200’ for the location of a building site 136’ from the ordinary high water level with the
condition that no other variances can be granted for development of this lot. Although this is a fairly new

Glen H and Shelley Tollefson - Approved the variance request as modified with conditions (7:50
p.m.)
Glen H and Shelley Tollefson, Lot 12 Moody Beach, Long Lake in Elizabeth Township, requested the
following; Wish to replace existing cabin with a new two story cabin staying in the same footprint, but
extending 15’ to the rear. Front setback 30’ 5" from property line (stake at lakeside), 33’ 10” from ordinary
high water level (match front of existing structure). East side setback 8’ 6” from property line (match east
side of existing fire place foundation). The required side lot line setback is 10’ and the required ordinary
high water level setback is 100'. The audience was polled with no one speaking for or against the variance
as requested. After consideration and discussion, Michael Conlon made a motion, second by Paul Larson
and carried with Steve Schierer voting no, to approve the. placement of a two story dwelling no closer to the
ordinary high water level than the general building line noted in red and circled in yellow on the applicants’
drawing dated September 15, 2005 with the following conditions: 1.) the proposed structure must be
placed at least 10’ from the lot lines and 2.) no more than 25% of the total lot area can be covered with
imperious surfaces. It should be noted that the variance as approved does not directly or indirectly grant
any other variances. The size of the structure as depicted on the applicants’ drawing is authorized as long
as the structure is placed in compliance with the approved variance and as long as it does not infringe on
any other setback requirement.
