The property is described as the northerly half of Lot 98, all of Lot 99 and the southerly half of Lot 100, Sater-Humphrey Ranch Camp, Ten Mile Lake in Tumuli Township. The audience was polled with Edward Thornberg speaking for the request. A letter from Eugene D and Myrna G. Hanson in support of the request was read for the record. The property is described as a 5.01-acre tract in Government Lot 1, Section 12 of Dead Lake Township by Marion Lake. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown and there is adequate area for the placement of a garage that will provide a reasonable use of the property at the required 75’ setback. David M. Eitreim - Denied David M. Eitreim, Garretson, SD, requested a variance of 15’ from the required ordinary high water level setback of 20’ for the placement of a water oriented accessory structure 5’ from the ordinary high water level. The property is described as Lot 2, Block 1 and part of Lot 3, Block 1, Reinke Beach, Eagle Lake in Eagle Lake Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by David Holmgren, second by Frank Lachowitzer and unanimously carried, to deny the variance for the placement of a water oriented accessory structure 5’ from the ordinary high water level and to require either the removal or the placement of the water oriented accessory structure in a location that complies with the requirements of the ordinance on or before March 1, 2002. It was noted that the Board of Adjustment would not have approved this location had a variance application been submitted prior to the placement of the structure. Charles James Reiss - Approved with condition. Charles James Reiss, Taunton, MN, requested a variance of 70.5’ from the required ordinary high water level setback of 100’ for the placement of 14’ by 20’ addition to the west side of the existing dwelling, being 29.5’ from the ordinary high water level. It should be noted that the addition will be no closer to the lake than the existing structure, no higher than the existing structure and will be 23’ from the property line on the west. The property is described as Parcel No. 27 of Government Lot 8, Section 3 of Nidaros Township by Stuart Lake. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 70.5’ from the required ordinary high water level setback of 100’ for the placement of a 14’ by 20’ addition to the west side of the existing dwelling, being 29.5’ from the ordinary high water level with the condition that before a site permit for the addition can be issued the existing 12’ by 12’ boat house must be removed. Hardship is a substandard lot or record. September 6, 2001 Page 4 Robert and Marion Oslund - Denied. Robert and Marion Oslund, Dent, MN, requested a variance of 5’ from the required side lot line setback of 10’ for the placement of a 24’ by 28’ garage 5’ from the lot line. The property is described as Lot 7, Block 1, Star Point Estates, Star Lake in Star Lake Township. A letter from Ralph and Joane Hanson in support of the applicants’ request was read for the record. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by Mark Steuart and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. It was also noted that the applicants’ lot is not a substandard lot and that there is adequate room for the placement of the proposed structure in a location, which will not require the granting of a variance. Darrel Forsgren - Approved as modified Darrel Forsgren, Pelican Rapids, MN, requested a variance to subdivide a parcel of less than 5 acres from an existing 71.39 acre parcel. The proposed tract will be 100' by 100’. The property is described as part of Government Lots 5, 6 and 7, Section 9 of Lida Township by Lake Lida. The audience was not polled, as there was no one in attendance at the time of this public hearing. After consideration, motion was made by Steve Schierer, second by Mark Steuart and carried with David Holmgren voting no, to approved the subdivision of an approximately 200’ by 100’ parcel from the existing 71.39 acre parcel. It should be noted that the area approved for subdivision and conveyance is all of that area adjacent to the road and lying between the parcel to the south and the parcel identified on the applicant’s drawing as the Roy Larson property. The Board of Adjustment acknowledges that the variance as approved does create a substandard lot, but that their are unique circumstances regarding the execution of a will and the completion a subdivision which the heirs thought had taken place 25 to 30 year ago. David M. and Shawn M. Olson - Withdrawn David M and Shawn M Olson, Frazee, MN, requested a variance to place a 14’ by 24' detached, unenclosed, floating foundation deck less than 10’ from the sewage system. The property is described as part of Lot 6, Block 1, Scalp Lake Acres, Lake Seven in Hobart Township. The audience was polled with no one speaking for or against the request. August 9, 2001 Meeting - After consideration and discussion, motion was made by Randall Mann, second by Steve Schierer and unanimously carried, to table the applicants’ request, for additional review by the applicants, until the September 6'^, 2001 meeting of the Board of Adjustment. It should be noted that the applicant (David Olson) verbally agreed to the Board’s action to table his variance request. September 6, 2001 Meeting - Prior to the meeting a letter was received from David M. and Shawn M. Olson withdrawing their request. The request was accepted by the general consent of the Board of Adjustment. Ben and Dorothy Krebs - June 7, 2001. Pat Eckert, Land and Resource Management Department, on behalf of Ben and Dorothy Krebs, ask the Board of Adjustment if they would reconsider their action from the June 7, 2001 meeting. Specifically the required side lot line setback and the required septic tank setback. After discussion and by general consent it was indicated that they would not be interest in reconsidering those issues.
