Motion was made by Randall Mann, seconded by John Everts and unanimously carried, to approve a variance of 5’
from the required side lot line setback of 10’(between Lot 95 and 96), a variance of 5’ from the required road-right-of-
way setback of 20’ and a variance of 5’ from the required soil absorption area setback of 10’ for the construction of a
24’ by 20’ garage located,5’ from the side lot line, 15’ from the road right-of-way and 5’. from the proposed drain field
and a variance of 8’ from the required 10’ road right-of-way setback for the placement of one line of the drain field 2’
from the road right-of-way with the condition that the existing metal shed must be removed from the applicants’
property and with the condition that no more than 25% of the total lot area can be covered with impervious surfaces.
Hardship is a substandard lot of record. - - .

William and Marion Krueger and Stanley and Joyce Koenig - Approved
William and Marion Krueger, Dent, MN, and Stanley and Joyce Koenig, Council Bluffs, lA,
requested a variance to subdivide a tract containing 6,125 square feet from an existing 96.3
acre parcel, by metes and bounds description and without a registered surveyor’s drawing, for
conveyance by William and Marion Krueger to Stanley and Joyce Koenig for the purpose of
permanently attaching this tract to their lake lot and the Koenigs are also requesting a variance
to place a septic tank within the road right-of-way. The property is described as part of
Government Lot 7, Section 17 and Lot 5, Kozelnik Beach Third Addition, Big McDonald Lake in
Edna Township. The audience was polled with no one speaking for or against the request. After
consideration and discussion, motion was made Cecil Femling, seconded by Robert Schwartz
and unanimously carried, to approve the subdivision of a tract containing 6,125 square feet of
area from an existing 96.3 acre parcel for the purpose of permanently attaching the tract to Lot 5
of Kozelnik Beach with the condition that a registered surveyor’s drawing must be presented at
the time of recording and with the condition that Edna Township apply for a variance to place
the septic tank within the road right-of-way.
David A. Trana - Approved
David A. Trana, Henning, MN, requested a variance of approximately 1.3’ from the required 2’
vertical separation from the ordinary high water level for the installation of a mound system
approximately .7’ above the ordinary high water level. The property is described as Lot 1 and
Lots 6 through 13, Block 3, Leaf Lake Pleasure Grounds, Leaf Lake in Leaf Lake Township.
The audience was polled with no one speaking for or against the request. After consideration
and discussion, motion was made by Craig Anderson, seconded by John Everts and carried
with Randall Mann voting no, to approve the variance as requested based upon the report and
recommendations as presented by the Land and Resource Department at the public hearing. It
was noted that this is a very sensitive area and the precautions recommended by the Land and
Resource Department are necessary to protect this sensitive area.
Howard O. and Marilyn Spitsberg - Approved
Howard O. and Marilyn Spitsberg, Dalton, MN, requested a variance of approximately 5’ from
the required side lot line setback of 10’, a variance of approximately 10’ from the required road
right-of-way setback of 20’ and a variance of 5’ from the required soil absorption area setback of
10’ for the construction of a 24’ by 20’ garage located approximately 5’ from the side lot line,
approximately 10’ from the road right-of-way and approximately 5’ from a proposed drain field.
The property is described as Lots 94, 95 and the Southerly One-Half of Lot 96, Sater Humphry
Ranch Camp, Ten Mile Lake in Tumuli Township. Dennis Delzer, Contractor, and Keith Sellner,
neighbor, represented the applicants at the public hearing. The audience was polled with Debra
L. Dalos expressing concerns with the variance request and presenting letters from herself, as
well as, from Roberta L. Dalos and John A. Dalos. After discussion and explanation the Dalos
indicated that they no longer had any objections to the applicants’ variance application. A letter
from the Tumuli Town Board granting permission to place a drain field within 2’ of the road right-
of-way was read for the record.

After consideration and discussion, motion was made by Randall Mann, seconded by John
Everts and unanimously carried, to approve a variance of 5’ from the required side lot line

Stewart Turing - Approved/Denied
Stewart Turing, Dent, MN, requested a variance of approximately 5’ from the required side lot
line setback of 10’ and a variance of approximately 15.4’ from the required road right-of-way
setback of 20’ for the construction of a 24’ by 24’ garage located approximately 5’ from the side
lot line and approximately 4.6’ from the road right-of-way. The property is described as Lot 8,
Engstrom Beach Second Addition, West McDonald Lake in Edna Township. The audience was
polled with Anna Lien speaking in favor of the applicant’s request. It should be noted that a
letter in support of the applicant’s request was also received from Anna Lien. After
consideration and discussion, motion was made by George Walter, seconded by Craig
Anderson and unanimously carried, to approve a variance of 15.4’ from the required road right-
of-way setback of 20’ for the construction of a 24’ by 24’ garage 4.6’ from the road right-of-way,
which will place the garage no closer to the road right-of-way than the structure located on the
Lien property, with the condition that all other structures located within the 20’ road right-of-way,
including the existing fence, must be removed before a site permit is issued for the construction
of the proposed garage. After additional consideration, motion was made George Walter,
seconded by Randall Mann and unanimously carried, to deny any variance from the side lot line
as no adequate hardship had been shown.
James Schubloom - Approved
James Schubloom, Moorhead, MN, requested a variance of approximately 4’ from the required
side lot line setback of 10’ and a variance of approximately 6’ from the required road right-of-
way setback of 20’ for the construction of a 22’ by 28’ garage located approximately 6’ from the
side lot line and approximately 14’ from the road right-of-way. The property is described as Lot
A2 of the Survey Lots of Government Lots 8 and 9, Section 1 of Dora Township by Sybil Lake.
The audience was polled with no one speaking for or against the request. A letter from Richard
F. Schultz in favor of the applicant’s request was read for the record. After consideration and
discussion, motion was made by John Everts, seconded by George Walter and unanimously
carried, to approve a variance of 2’ from the required side lot line setback of 10’ and a variance
of 6’ from the required road right-of-way setback of 20’ for the construction of a 22’ by 28’
garage located 8’ from the side lot line and 14’ from the road right-of-way. Hardship is the
extreme lot line bias to the road.
