After consideration and discussion, Steve Schierer made a motion, second by Rick Wilson and unanimously carried, to approve a
variance of 50’ from the required ordinary high water level setback of 200’ for the location of a future building site 150’ from the
ordinary high water level and to deny the variance as requested for the primary septic system. The hardship/practical difficulty is
the unique shape of this approximately 8 acre parcel. The variance as approved and the release of the highway easement will
provide a reasonable use of this property.

Parco! 5 contains 8.11 acres more or less, lying between the centerline of Couity
State Aid Highway No. 82 and the Ordinary Nigh Hater elevation of Mud Ledce,
a natural envirormenta! lake. It has approximately !4‘^ Feet of shoreline as
measured along the Ordinary Nigh Hater elevation of Mud Lake.
^ Currently, the northwesterly lOOO feet, more or less, of Perce! 5 is encumbert
W by a right-of-way easement to the Otter Tail County Nighway Depertment
running from the centerline of County State Aid Nighway No. 82 southwesterly
to the Ordincry Nigh Hater Elevation of Mud Lake. This area is identified as
R/H Pa~ce! 14 on Otter Tail County Right of Hay Plat No. 14.
He are intending to make a formal application with the Otter Tail County
Nighway Department, recgjesting a release of this right-of-way eas&nent which
lies outside of 75 feet from the centerline of County State Aid Nighway No. 82.
Prior to accepting the formal application and beginning the fr-ocess necessary to
release this portion of right-of-way, the Otter Tail County Nighway Deperbment
would like to know there is a buildable site within the lands being released.
Because of the uniqpe shape of the property an application of the 200 foot
building setback reegjirement from the shore of Mud Lake across Perce! 5
leaves a 513 sqpare foot triangular area O to 15 feet wide and approximately 4i
feet long.
This results in a practical difficulty to build within these setbacks.
Because of this practical difficulty we are reqpesting the following variances.
I. A variance recgjest of 50 feet from the setback reegjirennent of 200 feet
from the Ordinary Nigh Hater elevation of Mud Lake.
2. A variance recast of 50 feet from the rec^ired 150 foot setback for a
proposed Primary Septic Location from the Ordinary Nigh Hater

Re: Owner requested highway easement release in conjunction with variance application on OT County PIN
60000090080000 (northeasterly side of Mud Lake DNR # 56-587) in Government Lot 1 of Sec.9, Tumuli
Township
Dear Mr. Stein:
The Otter Tail County Highway Department has received a written request from Mr. Wayne Kolle to release the
excess (more than 75’ from centerline) highway right of way lying between CSAH 82 and Mud Lake in Parcel
16 shown on the OTC RIGHT OF WAY PLAT NO. 16.
This part of the County 82 corridor was originally Minnesota Trunk Highway 52 and was acquired as state
highway easement through a judgment in District Court in 1938. It was also part of a State Turnback (Release
No. 47) to the County after the Interstate 94 system was constructed. In 1980, a quit claim deed from the State of
Minnesota to the County of Otter Tail was recorded which covered the transfer of the highway easement to the
local road authority. In 2006 a 4.2 mile portion of County 82 was platted and reconstructed with no additional
permanent highway easement being purchased from the Kolle property.
While we find no written stipulation as to the need for the state’s original acquisition beyond the 150’ wide
corridor itself, the additional taking southwesterly to Mud Lake - which Mr. Kolle wishes us now to release -
appears to conform with the additional taking by the state on the adjacent property northwesterly along the lake.
After review of the 1915 version of the USGS quad map and the late 1930’s state road grading project plan and
profile sheets, it appears that there was a natural ridge which the new alignment for TH 52 followed from Gov’t
Lot 8 of Section 4 into Gov’t Lot 1 of Sec 9. This would have minimized the volume of material to be moved for
grading up the road bed. It also seems likely that buying all the way to the lake provided potential borrow
material for the large fill area further east on Kolle’s.
The County Highway Department intends to honor Mr. Kolle’s request for easement release only if the variance
request for a reduction in the setbacks is approved by the Board of Adjustment.
If you have any additional questions, please feel free to contact us at any time.
Sincerely,
Otter Tail County Highway Department
Richard West, P.E

Donna Hogberg - Approved the variance application as requested. (Continued) (6:48 p.m.)
After consideration and discussion, Paul Larson made a motion, second by Ward Uggerud and unanimously carried,
to approve a variance of 40’ from the required side lot line setback of 65’ and to approve a variance of 18’ from the
required ordinary high water level setback of 20’ for the placement of an 8’ by 20’ deck 25’ from the side lot line and 2’
from the ordinary high water level. The hardship/practical difficulty is the terrain features of the applicant’s property
and safety concerns for the property users. The variance as approved will provide the applicant with a reasonable
use of the property. It was also noted that if the applicant had constructed a platform it would have been a legal
structure not requiring a variance; however the addition of the handrails created the need for the variance. The
handrails are needed for safety.
Sunrise Properties - Tabled per applicant’s request. (6:58 p.m.)
Sunrise Properties, Lots Six and Seven, Block B Hursh’s First Addition to Linden Park and part of Government Lots 1
and 2, Section 26 of Girard Township by East Battle Lake, requested the following: Relocating structures from tier 1
to tier 2. Increasing the total number of units from 26 to 29. The maximum allowable density is 8. The audience was
polled with no one speaking for or against the variance as requested. After consideration and discussion and with the
applicant’s written consent (email dated November 12, 2014), Thomas Lee made a motion, second by Michael Harris
and unanimously carried, to accept the applicant’s request to table this hearing until a future meeting date to allow the
applicant an opportunity to attend the public hearing.
^Wayne Kolle -Approved the ordinary high water level setback variance as requested and denied the variance as requested for the septic system. (7:00 p.m.)
Wayne Kolle, part of Government Lot 1, Section 9 of Tumuli Township by Mud Lake, requested a variance of 50’ from
the required ordinary high water level setback of 200’ for the location of a building site 150’ from the ordinary high
water level and a variance of 50’ from the required ordinary high water level setback of 150’ for the location of the
primary septic system 100’ from the ordinary high water level. Glenn Howe. Surveyor represented the applicant at the
public hearing. A letter from the Richard West, Otter Tail County Highway Engineer stating that if the variance is
granted the easement would be released was read for the record. The audience was polled with no one speaking for
or against the variance as requested.: After consideration and discussion, Steve Schierer made a motion, second by
Rick Wilson and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback
of 200’ for the location of a future building site 150’ from the ordinary high water level and to deny the variance as
requested for the primary septic system. The hardship/practical difficulty is the unique shape of this approximately 8
acre parcel. The variance as approved and the release of the highway easement will provide a reasonable use of this
property.
Sam and Gwen Humann - Approved the variance application as requested. (7:22 p.m.)
Sam and Gwen Humann, part of Government Lots 6 and 8, Section 25 of Dead Lake Township by Dead and Alice
Lakes, requested the following: Replace existing dwelling and detached garage with new dwelling with attached
garage at 75’ from the ordinary high water level. Required setback is 200’ requesting a variance of 125’. The
audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a variance of
125’ from the required ordinary high water level setback of 200’ for the placement of a new dwelling and attached
garage 75’ from the ordinary high water level as depicted on the drawing submitted with the variance application. The
hardship/practical difficulty is the location of a lake on two side of the property which makes it impossible for the
applicants to meet the required 200’ setback.
Faye Engkjer - Approved the variance application as requested. (7:27 p.m.)
Faye Engkjer, Lot 10 Bowery Beach, Pelican Lake in Dunn Township, requested the following: Proposing to replace
the existing septic system with pressure bed. The septic system being 3’ from property line and 12’ from the dwelling,
required setback is 10’ from property line and 20’ from dwelling. Patricia Stock, A-1 Septic appeared with the
applicant at the public hearing. The audience was polled with no one speaking for or against the variance as
requested; After consideration and discussion, Rick Wilson made a motion, second by Thomas Lee and unanimously
carried, to approve a variance of T from the required lot line setback of 10’ and to approve a variance of 8’ from the
required 20’ setback from a dwelling for the placement of a septic system 3’ from the lot line and 12’ from the dwelling.
The variance as approved will provide the applicant with a reasonable use of her property. It was also noted that the
proposed location is the best, if not the only location for the proposed system as stated by a licensed system
designer/installer.
